Bangalore: Kumaraswamy's Second Marriage - HC Dismisses Petition

Bangalore, Apr 9 (PTI): The Karnataka High Court today dismissed a writ petition seeking a direction to the Lok Sabha Speaker to disqualify JD(S) state President HD Kumaraswamy from membership of Parliament for allegedly committing bigamy.

The division bench headed by Chief Justice Vikramajit Sen dismissed the petition filed by city-based advocate Sashidhar Belagumba on the grounds of lack of proof.

The petition had contended that Kumaraswamy is prohibited from bigamy as he is a Hindu.

Belagumba had filed the petition in the High Court in 2011, charging Kumaraswamy with going in for a second marriage to Kannada actress Radhika. He contended that the JD(S) leader, a Lok Sabha member, ought to be disqualified from Parliament membership as he has committed a ‘crime’ by marrying again while his first wife Anitha is alive.

The petitioner referred to Section 494 of IPC (marrying again during lifetime of husband or wife) and to Radhika’s admission in the press and its confirmation by Kumaraswamy.

The JD(S) leader had also confirmed fathering a child with Radhika, according to the petition, which said Kumaraswamy is prohibited from bigamy as he is a Hindu.

The petitioner, however, had stated that he was not seeking any prosecution of the JD (S) leader. ”Every Indian citizen should be treated equally and the law of the land uniformly applied to everyone as enunciated in Article 14 of the Constitution,” the petitioner had said.

    Kumaraswami is politician so no body can question him , he is cheating his wife and people of Karnataka ,all bureaucracy and law is controlled by this Gouda father and sons .And moreover he is son of ex priminister and ex chief minister .Why we want to worry as long as Radika don’t register RAPE CASE against him.

    In Islam a married man can have marriage with another woman with mutual conscent approval or conveincing the first woman for new bond with second woman, If the first Or second woman not aggreed then marriage is voidable contract.

    Marrying another guy/girl with the permission of existing partner is acceptable.. but law should be there to punish those who will cheat their partner and marry again.

    What the petitioner doesn't seem to know is, even if bigamy is a clear violation of Hindu Marriage Act 1955 and the violator is punishable for up to 7 years of imprisonment under IPC 494/495, only the complaints from either of the wives can be entertained and not from any Tom, Dick and Harry or Sue, Anne and Mary.

    When he was CM, he was doing Village Stays (Grama Vasthavya). He used to stay a night in other people house. That time he made relationship with many young women across Karnataka.

    Radhika's relationship also started during that time. But it was during town stay (nagara vasthavya). Now everyone knows his true intention of Grama Vasthavya..

    I guess petitioner failed to substantiate proofs of his second marriage even if they (accused) accepted in front of press.Radhika and HDK on record showed the public that they were really husband and wife.But Court also needs hard proof instead of circumstantial evidence. Having said,that should accused were average citizens, court might take cognizance circumstantial evidence.Politician's conviction, be it in corruptions or criminal or any kind of litigation were negligible in India95!!!
