Bangalore: BJP MLA Sampangi Gets Bail, Prison Sentence Suspended

Bangalore, Jun 5 (IANS): The Karnataka High Court Tuesday granted conditional bail to ruling Bharatiya Janata Party (BJP) legislator Y. Sampangi and also suspended his conviction of three years and six months rigorous imprisonment given by a trial court in a bribery case.

Admitting Sampangi's bail petition, Justice V. Jagannathan ordered him to pay a surety of Rs.100,000 for his release. The court asked him not to leave the country without its permission. He is lodged in the central jail.

"We have appealed to the high court for our client's bail and suspension of his sentence under section 389 of the Criminal Procedure Code. The court felt that we had substantial grounds to seek the bail and suspension of the conviction," counsel Sandeep Patil told reporters.

Lokayukta (ombudsman) special court judge N.K. Sudhindra Rao Saturday found Sampangi guilty of violating section 13 (1) of the Prevention of Corruption Act by accepting Rs.500,000 (Rs.5 lakh) Jan 29, 2009 from a businessman over a land dispute at the legislators' home behind the state secretariat in central Bangalore.

The first-time lawmaker from Kolar Gold Fields assembly segment, about 100 km from here, is also the first legislator in the state to have been trapped by the ombudsman in a bribery case.

Sampangi's counsel also filed an interim application in the high court Tuesday challenging the trial court's judgement, including the conviction and the sentence.

The court has posted the case for next hearing to June 18.

    Anna Hazare started the anti-corruption movement alright - people of nation supported - this movement should have offices in all states and such cases like Sampangi's where he gets interim bail and suspension of jail term handed over to him by trial court should be looked into/taken up by this organisation.

    It took 3 years for lokayukta to hand this judgement and was nullified by HC within a couple of days. - Such cases /where corruption is involved and decisions are over-rided with haste, should be taken up by Anna Hazare & co.

    Then only people will have faith in that organisation.  It just fantastic - if all cases are disposed of with the same speed and manner

    Nowadays Our Indian law is very strict for the poor’s only, cases like who fails to pay (because of their weak economically) small taxes of their staying shelters.

    Justice delayed is justice denied, Indian judicial system provide the criminals safe heaven with so many provisions.It's making mockery of it's own judicial system by allowing criminals walk freely even after commiting henous crimes.     Looking at the orders passed till date by Lokayukta (Ombudsman) Special Court Judge N. K. Sudhindra Rao, I think he has bit aggressive nature. This person might be strong supporter of Non-Corrupt System and whoever comes with facing corruption charges, without studying their cases properly he puts them in Jail only to get relief from HC or SC.

    Justice Sudhindra Rao should have been the Chief Justice of Criminal Court so that he can pass the order of life term in very first day for all Criminals whoever comes to the Court. Only GOD knows what is the truth? Even accused in Corruption by other than Congress Party Leaders will face the music but confirmed Corruption made by Congress Party Leaders will be promoted to higher post and CBI doesn’t have guts to touch them at all. See the example of Jagan in AP, property inherited from his late father called as illegal but wealth looted by YSR being Congress CM was treated as FDI? “Tumhaari Khoon…Khoon but humhaari Khoon Paani?”

    Very interesting outcome this verdict is Lokayukta took "3 years" to come to an concrete verdict but with in "3 days" HC came to the conclusion that 1988 Act of prevention of corruption will not applicable!!!!Unbelievable but it real that HC gave him clean chit with in short span of time!!!What a verdict it is?All these kind of verdict specially made available to BJP MLAs and Ex minister(Reddy's bail episode)

    Why we have these kind of judges at all in our high courts - Is there a CJI who can look into this kind of anomalies happening every now and then. Lokayukta should check/investigate the judge who gave this interim bail to this corrupt minister who was caught red handed - if that evidence is not enough - then I think it is useless to go to any court in India for real justice. This is so shameful. Every Politician from any party gets bail and is free after that to continue their mis-deeds. Just great.

    Till date all had hopes that the judiciary will not fail its citizens and mete out justice fairly irrespective of rich and poor. Looking at the recent cases, which appear to be water tight cases with ample evidence the Honorable judges are casually granting bail and dismissing the lower court orders!! What a mockery of the system. The recent episode of a CBI special judge having caught taking 5cr bribe is a dangerous precedent for the Indian democracy! How can the common man raise his voice against corruption when the law enforcers and protectors of the law are themselves corrupted?? All the recent happenings in the judiciary augurs very bad for the future of India!! God save our country!!!

    This is well known fact the day Sampangi has got 3yrs 6months jail that he will get bail from our Karnataka High Court. If any verdict given against any BJP Govt by Lokayukta Court, High Court will will give its verdict in favour of the gentleman or Govt. Only Supreme Court can give its final verdict and 99% it will be over rule High Court Verdict. Read the case of MLA suspension. There is no law and order in Karnataka. Jai Ho Kannada Mate...

    Rakesh shetty means to say that nobody can do justice in such a short time.We all know that It is a case of Jan 2009 and the bribe issue in this case has Rs 50,000 in cash and Rs 4,50,000 by cheque payment.Do you mean to say that curruption cases should solve at the same speed as Bangaru laxman case.The High Court Bail is a temporary pain killer the actual antibiotic will be given soon by the Loakayukta officers who are followers and trained by Justice Santhosh Hegde.

    The first pain killer was the actual pain killer he received at Nimhans hospital soon after the arrest in 2009.The HC will soon process this case and and SC also will process this on fast track.If further delay means general public will lose their hope on the Indian judicial system.The whole world is watching the judicial process of India and the reputation of lawyers and judges is worsening day by day.The court is same for BJP or Congress, and the case is special when it is handled by Lokayukta courts.

    All are very scared to put right foot forward and stop corruption. If this MLA gets RI, others are all worried. They will also have to follow.
    So better to save one so that they can be saved.

    This is in consistancy with most politically sensitive judgements we seen in last 3 years. Where a trial courts judgement is reversed by High court and high court verdict is reversed by Supreme Court. In this game, it takes atleat six to eight months.
    The interesting thing to note is, nothing happens to the erring judge. If such is the state of our judiciary, can corruption be curbed? I personally belive judiciary is mother of corruption and politics is father. When are we going to wake up?

    This is how Indian law. How will corruption be tackled with these weak laws? This encourages people to accept bribes since they know court will grant them bail in any case. Why can't HC rules be as strict as Lokayuktha rules?

    THIS HAPPENS ONLY IN INDIA.

    Dr B R Ambedkar copied the laws from other countries and made the constitution. It was not his own.

    They should direct all criminal cases to High court and Apex court so that it can save tax payers money , one court pronunces the sentence and the other give Bail , Hpe all are referring to the same book of Law or few Judges did not qualify in the Test . This happens only in My India
