Mining: Fence Ate Grass in Karnataka, says Supreme Court


New Delhi, Sep 7 (IANS): In blistering criticism of the Karnataka government for looking the other way when iron ore in the state was being illegally mined, transported and exported, the Supreme Court Friday ordered a CBI probe into the illegal extraction and export of 50.7 lakh tonnes of iron ore from the state's forest areas from January 2009 to May 2010.

The apex court forest bench headed by Justice Aftab Alam, directed a CBI probe while accepting the report of its central empowered committee on environmental matters recommending the probe. Slamming the Karnataka government, the court said it was a case of 'the fence eating the grass'.

Justice Alam said: "Can anyone imagine that the state authority, right from bottom to top was not aware of the illegal mining of iron ore to the tune of 50.7 lakh metric tonnes, its transportation and export. The state machinery, instead of governing, was involved in all these illegalities."

Senior counsel, Raju Ramachandran sought to resist the ordering of the CBI probe, saying that the state CID was already investigating the matter. The court said that the state CID would be fully knowing what was happening while it was happening and asked, "Have you arrested a single person involved in illegal mining so far?"

The court directed that no authority or court will entertain any plea arriving out of its order for a CBI probe, effectively meaning that any matter in respect of this direction can only be raised before it.

    In a Democratic Country like India, everyone have to accept Supreme Court’s verdict. But instruction to CBI headed by none other than PM of India who himself is reeling under “Coal Gate Scam” of 1.86 Lakhs Crores of Rupees!!!! If same Justice Aftab Alam hears the cases of this Coal Gate Scam I wonder how he will blister his criticism of Central Government headed by PM and we want to see to whom he will instruct to investigate the scam since CBI too headed by PM!!!! May be he will pronounce that “Fence ate Grass as well as Owner too”. We also want to see how Congress Party Leaders in Karnataka will react and dance to condemn the “Coalgate Scam” since it is very clear from latest news that almost all Coal Mining were awarded to Congress Party Leaders kin and relatives!!!!

    Quantity-wise this Belikeri Iron Ore theft has been considered as the biggest theft in the history of mankind.
    The CID/CCB of Karnataka has been investigating this case since last 2 years but the progress is Zero. This is the efficiency and Honesty level of Karnataka CID/CCB. An individual like S.R. Hiremath could dig many times more than the well organized CID/CCB. This is a Slap on the face of CID/CCB, who are notorious for putting 'B' Report in all the cases concerning Politicians, and harassing innocent people regarding trivial cases by putting lengthy charge-sheets. Fence eating crop is common in India since Independence, but politicians & dishonest companies together eating Five lakh tons of Iron Ore will never be matched in next 100 years atleast. Well done Hiremathji by approaching Supreme Court for handing over this case to CBI. Otherwise it would have been impossible to bring out the truth with the kind of investigating agency like CID/CCB in the hands of Karnataka Polticians.

    Supreme Court ruling seen an eye opener to the normal person ie the voter.The corruption arises everywhere and mostly the competion is seen inbetween BJP and Congress.They talk about drought,doing thier visitings to the places,maybe NO! they are following and strenghtening thier base for their coming elections.Supreme Court ruling 'The Fence Ate the Grass' A great saying anyway! .

    WHY SUPREME COURT IS MORE INTERESTED IN KARNATAKA MINING ALONE WHEN CENTRAL GOVT. IS ROCKED WITH BUNCH OF SCAMS . LATEST BEING COAL-GATE WITH LOKASABHA NOT FUNCTIONING AND SUPREME COURT IS SILENT ON THESE ISSUES SHOWS FAVOURING CENTRE FOR THEIR ANTI PEOPLE ATTITUDE.

    Governments duty is to guard Mines, Natural resources, Forest etc, so that its proceeds are used for subsidy to poor/Public utilities etc.
    Further, Govt. basic duty is protection of its innocent citizens and ensure peace
    But during present Govt. tenure,attackers are protected, peace disturbed, and aggrieved persons are punished in various instances! Supreme Court has made right observation, Fence ate grass in Karnataka !

    'Belikeri mines escape' was probed by Lokayukta top official under the guidance of then Lokyukta Chief Justice Santhosh Hegde.Later,to the surprise of all officer in-charge shunted out from the office to divert the probe findings!!!That means under who's behest these unwanted stupid things has taken place?
    Some salient features of Belikeri episodes(LOKYUKTA REPORT)
    1)Bundles of fake tax receipts were found in possesion of check points
    2)Bundles of fake permits has found
    3) Favorable officers were posted in sensitive places of Geology/Mining/Forest offices
    4)Any adverse report or refusal by officers on record showed gate pass to another department.
    5)From Bellary to Belikeri or end of Karnataka border to Hyderabad, virtually there is no feeling of Govt of Karnataka existed.
    6)650 officers from Villege accountant to IAS/IPS/IFS officers had been named in the probe
    7)HAFTAS are collected from other mines company by Govt minister!!
    8)There are several EXIM companies involved in the Mines illegal export and one company was from GUJ,who's CEO present@ Yeddy's swearing in ceremony in Bangalore!!! All these factors fingers @ present BJP govt of Karnataka.Yet govt did nothing to arrest the looting until NGOs and political parties swung in to action which resulted in appointment of CEC.

    Mines looting episode is mother of all corruptions in India.The specialty of the case is that it is state sponsored and who were extracted mines were either politicians or law makers or ministers!!BJP GOVT OF KARNATAKA IS A PRODUCT OF MINE LOOTING MONEY.If these aspects are not dealt or inquired or did not bring to book,it will be biggest shame for democracy.It is CONGRESS PARTY which took PAADA YAATHRA towards BELLARY which brought the news of Mines looting @ fore.Secondly,PARIVARTHANA SAMAJ by Mr Hiremath who fought court battle single handedly, resulting in appointment of AMICUS CURE(CEC-CENTRAL EMPOWERMENT COMMITTEE)by SC."UPPU THINDAVANU NERU KUDIALE BEKU"
