Mangalore, Sep 11 : Akku and Leela have been working as scavengers for last 42 years in Government Women Teachers' Training Institute at Udupi (Karnataka) for a meager basic salary of Rs 15 per month all the way.







From 1971, these two women were repeatedly requesting the higher authorities in the dept of education to sanction minimum wages given to scavengers /sweepers. In 1999, they approached the Human Rights Protection Foundation, an NGO, for guidance and support. Even after two years of systematic correspondence from the NGO, there was no result.

In 2001,they were guided and helped to file a petition with the Karnataka Administrative Tribunal at Bangalore. Soon after filing the case, the Education Department stopped even the meager salary they have been paying. But the two ladies continued to work without salary in the hope of getting justice from the Law courts.

On 25-7-2003, The Karnataka Administrative Tribunal (KAT) ordered for the regularization of services of the complainants in 90 days (copy enclosed). Nothing happened for fourteen months in spite of repeated representations from these ladies.

On 6-9-2004, the ladies filed contempt proceedings against the government. Immediately, the education department filed an appeal to the Karnataka High Court against the order of KAT.

On 4-10-2004, Karnataka High court dismissed the appeal by the government after hearing and ordered the Government to pay the salaries (copy enclosed). Notices were issued for contempt of courts when salaries were not paid.

Instead of paying their salaries, in 2005, Karnataka Govt preferred special leave petition before the Supreme Court of India (SLP No: 533/05) challenging the order of Karnataka High Court.

On 22 -1-2010, Supreme Court of India passed the judgment ( Civil Appeal NO: 860-861 of 2010, copy enclosed) directing the Karnataka Govt to consider the complainants' claim for regularization of employment with the principles laid down by Constitution Bench in State of Karnataka & others Vs Uma Devi & others. On 25 – 6- 2010, the victims once again approached various officers including the secretary to the Govt of Karnataka, to regularize their employment and pay arrears due to them (Document- 5)).

The scavengers have not received their wages even after two and a half years of the Supreme Court verdict.

Now the authorities are saying that the women are not employable because they have reached the retirement age ! However, the key point here is that they were indeed below the retirement age when the verdict was pronounced by the Supreme Court !

Now the hapless illiterate women are asking whether there any other court above the Supreme court of India so that they can get their hard earned salaries.

As a first step I have submitted application as per RTI act - asking the Education Secretary, Karnataka - that the steps to implement the supreme court, cause of the delay and implication of contempt of court.

    Unbelievable to imagine such things happen in front of our eyes in the 21st century.

    Dear people of Karnataka,

    let's protest against the injustice meted upon these two honest ladies and ensure that they recieve all their dues plus damages.

    The people who exploited them must be made public and put to shame, and penalised as well.

    We dont know yet how many such persons are suffering under the hands of corrupt officials in Coastal Karnataka.

    If SC's decision is not adhered to, by the Karnatka Govt. and they have the time and money to file cases (involves Lawyers fee/Court fees and many other expenditure) just to torment these very very low paid employees of government, these government officials are really heartless and relentless in not paying the dues to these two ladies.
    Are they gone so low as to pocket even these poor workers of lowest category and such a minimal amount?
    I hope God punishes them severely for tormenting these employees.
    Evn SC is in-effective where it's directions/rulings are blatantly ignored, especially, by present Karnatka Govt.
    It is high time SC restored their power as the supreme lawmaker of India.
    If not let God/s have mercy on all of us.

    Do the govt either BJP or Congress believe in the concept of Janatha severye Janardhana seve..I suggest SC should order the release of all dues to them with compound interest, like their salary, perks, DA, PF, medical leave, CL, PL and should give them pension thats applicable to grade IV employees....Justice needs to be done...

    Govt cannot give proper judgement on this issue means its a shame for them.First of all they were working for such a low salary i dont think anyone in 21st century will get that and where are the authorities who was taking work from these two ladies they should be ashamed of themselves. look at those poor ladies who was waiting for their judgement in their favor.Great thing about these ladies is that even though they are not getting the salary they worked honestly we should appreciate.Hope Mr.shanbogh will succeed in getting justice in favor of these two ladies.We should extend our support for these two.jai hind

To think of it these ladies have worked for Rs 15 per month where-as scores of people in India who are on pay-roll and who get a fat salary even without working(see the filth on pavments )

    Recent past we have seen so many High or Supreme Court Judges are condemning & criticizing State or Central Governments. But they took less initiative to clear the back log of decades old cases till date. Since so many cases are pending in High or Supreme Courts, why don’t they start 7 days a week and 12 months continuous services in various Courts by appointing more & more Judges and court staff to work on rotation basis to avail their stipulated leave as per law, so that they can serve the mass without any delay? Everybody fingers at others but no one ready to clean the mess in their own house!!!

    Hey, Hey....and finally what was SC verdict (Civil Appeal NO: 860-861 of 2010) directing the Karnataka Govt to CONSIDER the complainants' claim. Sheer lacks the SPINE to command, payout instantly?

    Our laws are flaunted by all sorts of loopholes. When will our Justice System mandates its verdicts? For a fact, our very behavior has been churned out today, just like these outcomes. This is evident from the YES and NO we say nodding our head god only knows whether it is an yes or a no!

    Even if we add another 80 million gods to our existing beliefs fate of our country is precariously in danger!

    Sad part of the whole episode is that this has happened in the education ministry which is supposed to mould our students into law abiding citizens.
    Last 42 years saw various govenments changing. So there is no scope to blame ITALIANS, or BJP. That's why the CAPITAL LETTERS TRIO and their opponents didnt find any scope to make comments here.

    As a reader said, this must be shown on national tv. I request Daijiworld to take up such issues (which you always do), but at the same time provide a exclusive platform to such people to get justice. However all said and done, even after the supreme court order, if the authorities have not paid compensation then it not just amounts to contempt of court, but also shows the egoistic character of the concerned officials. Lack of committment. Such officers must be stripped off their jobs clothes, and sent to jail. As citizens of India, we are entitled to be respected by these junk officers. Because we pay thier salaries. But its different here.
    So lets think out of the box. Can we ask, Yeddy sir, or the reddy brothers, or the A Raja's or the Coal block benefecieries, or any other unnamed minister from the state or central government who are neck deep in hard currency, please come forward and pay these poor ladies a crore each. I am sure it will not make a dent in your pockets. And please, we will keep this information confidential.

    Ridiculous.....!!! This spells out the inhumane actions of our States Education Ministry. If Educated people try to trample illiterate people of their rights even after the supreme court Orders, then certainly justice is denied (blindfolded as is the statue of Justice. Only people with goodwill will have to come forward and help these ladies with some donations.....

    First of all my salute to these 2 great women for their patience. They must have lived only with God's blessings because in Rs.15/- you cannot buy fish for one day. As said by Gerald instead of fighting for no reason and no value we should help generously to thes ladies. One morething this is due to our politicians either Congress or BJP they have not done anything for poor and specially women. God bless these two sweet ladies and also to Ravindranath Shanbhogue for his tireless help.
