PM a Public Servant, should be Brought Under Lokpal - Justice N Santosh Hegde

New Delhi, Nov 28 (PTI): There is nothing wrong in bringing the Prime Minister under the jurisdiction of Lokpal as like others he is also a public servant, former Supreme Court Judge and erstwhile Karnataka Lokayukta N Santosh Hegde said today.

"What is wrong in the Lokpal having jurisdiction over the Prime Minister? Is the Prime Minister not a public servant? Aren't there cases of corruption against PMs in other countries? In Japan, you find every other year a Prime Minister is prosecuted.

(Former US President Richard) Nixon was prosecuted... What is so great about the PM?," he asked

Noting that the position of the Lokpal was akin to "giving a dog a bad name and kicking it", he said there have been allegations of corruption against Indian PMs in the past and added that only the President and Governors are excluded from being prosecuted and not the PM.

"We have had allegations of corruption against two former PMs - Bofors and the JMM bribery case. In a democracy, how can a person merely because he is holding an office be excluded from prosecution?

The Constitution excludes the prosecution of the President and the Governors in some cases...One can't apply the same principle on a man who passes executive orders on a daily basis," he told PTI.

Responding to a query as to how he expects Arvind Kejriwal's newly-launched 'Aam Aadmi Party' to perform, Hegde raised doubts about its success saying it was not an "easy job".

"My only apprehension is how far will a political party survive because of the very many demands of the political system, these days. It requires a huge amount of money to elect nearly 546 Members of Parliament from Kashmir to Kanyakumari. It is not going to be an easy job.

"It is a good thing in principle, but in reality, can it succeed?" he asked.

On being queried on Kejriwal's possible expose on corruption in judiciary, Hegde said, "Haven't we heard of malpractices in judiciary? We have had one Supreme Court judge against whom impeachment proceedings had started, but it was not completed. We had one Chief Justice against whom impeachment proceedings had been initiated- Justice Dinakaran- he resigned, so it came to an end.

"We had Soumitra Sen from Calcutta High Court. Impeachment process started against him (and then) stopped; didn't go anywhere. We have a charge sheet filed against Justice Nirmal Yadav of Punjab High Court. We have 34 judges of the Allahabad High Court, who are being investigated by the CBI.

"So, there is corruption there and therefore, he must be having some material against some judges," he said.

On being questioned if self regulation was the way for the judiciary to control corruption within its ranks, he said, "We have tried it and it has not succeeded.

We have tried it all these years...About the judiciary, everybody said that.. we will self-regulate, we will control, the superior court will look after the subordinate courts...nothing has happened," he said.

Hegde replied in the affirmative to a query on whether he is willing to have a Lokpal that has the authority to investigate and prosecute judges.

The very judge who is being investigated can go to the court- of which he may be a judge - and then question the investigation, he said.

"Who will investigate the judges? Somebody should be there. You want to have a separate investigating(sic)vigilance body of retired judges, then create it, that is okay, but it should not be out of the purview of investigation.

"That very judge, who is being investigated, can go to the same institution, court of which he is a judge and then question the investigation," he said.

    Certain emergency & utive decisions can be taken only by the PM or the PMO . This may not be there in the rule book. Such emergency decisions are taken on the spot for the good or in the best interest of India. Political scenes are changing overnight throughout the world ,so do foreign policies of nations.

    Justice Santosh Hegde must differentiate between a Tahasildar & the PM / PMO.

    Although the PM is a public servant, he / PMO should not be brought under the ambit of the Lokpal. There are certain utive decisions which only the PM can take in an emergency.Take for example an incident like the highjacking of an aircraft to Kandahar, Afghanistan.At critical times only the PMO functions in such situations whether good or bad or say, the Kargil intrusion by the Pakistani forces.

    Certainly, I do not agree with Justice Santhosh Hegde on this score although I respect him.

Mukherjee had viewed himself, and not the inexperienced Rajiv, as the rightful successor to Indira following her assassination in 1984. Mukherjee lost out in the ensuing power struggle. He formed his own party, the Rashtriya Samajwadi Congress, which merged with the Congress in 1989 after reaching a compromise with Rajiv Gandhi. Mukherjee's political career revived when Prime Minister P. V. Narasimha Rao appointed him Planning Commission head in 1991 and Foreign Minister in 1995.

    Even today Congress dint Promote Pranab to Presidents post. Only Congis will say so. As he was torn in the way, Actual fact is Madam wanted to make the road clear for Yuvraaj Gandhi(for what qualification or achievement...is a MILLION $ Question) to climb the PM chair after Madam gives RED card to MSS that enough is enough, we are already a laughing stock in the world managing this circus company.

    Nothing wrong on comments made by Dinesh Poojary, Kundapura/Bengaluru. As rightly said PM should have shown ATLEAST some guts againts present political scenario of the country. He may be a able/well/over qualified BUT what i feel India needs a GOOD LEADER/MANAGER. PM should make clear and bring confidence on public and not on politicians.
    Even Mr. Hegde talks with time. For change the present way out is to support IAC, Anna, AAP and bring to power.

    With the exception of the heads of three administrative sectors, viz. the President/Governors, Chief Justices & Speakers/Chairman of Parliament/state assemblies, all other top utives should come under the purview of the Lokpal. Otherwise there can be numerous hurdles in the independent functioning of the lokpals.

    Justice N Santosh Hegde's recommendation that PM a Public Servant, should be Brought Under Lokpal is true in a democratic Country!
    Also, all those leaders who influence the masses and political parties, whether holding public office or not but are deriving benefits and protection from Government/Public treasury should also be brought under Lokpal.

    Problem with our democracy is people are not voting a Prime Minister of the country or Chief minister of a state directly ,so that people can directly ask him to deliver work.MPs and MLAs who are getting elected by money power and chosen by Partys which are owned and controlled by individuals who are not concerned of the country or the society.We need to elect a leader directly like in US or France.Vast majority of our voters are in fact sheeps.

    Though he was there in Politics even before Sonia Gandhi came to politics, it was Sonia who made him prime minister.

    This is what people hate about congress. Prime Minister post is always reserved for Gandhi Family or choice of Gandhi Family. Look now, Rahul Gandhi is projected as future PM, does congress facing dearth of better candidates for PM post? Obviously NO. There are well qualified, well experienced people in Congress. But they never get a chance to rule this country, nor they have voice to express it.

    Mr. Manmohan Singh was there in politics even before Mrs. sonia Gandhi came into politics. He is a highly qualified person. As Justice Santosh Hegde said it is not a easy job in a country like India which is too complex.
    Hope Lokpal will come into existance and person Justice Santosh Hegde will be on top of it.

    Sorry Mr. Hegde. The current PM our country is a ITALY LADY servant, not public servant. He is blind over all corrupt ministers of this cabinet, he could not take any action against them so for. But still people call him PRIME MINISTER OF COUNTRY. His ministers are continuing looting, while he continue to be silent.

    We know a Kannada proverb 'MATHU BELLI, MOUNA BANGARA'. But a person should speak wherever and whenever required. It seems a password has been set to his voice box and Sonia Gandhi only knows this password. Whenever she enters the correct password, he will speak.
