Gang-rape Case: Two Accused Want to Become State Witnesses

New Delhi, Jan 6 (PTI): In a desperate bid to escape punishment, two of the six accused in the Delhi gang-rape case today told a court that they want to become witnesses on behalf of the state while two others pleaded for legal aid.

Out of four accused, who were produced before Metropolitan Magistrate Jyoti Kler inside her chamber after expiry of their 14-days of judicial remand, Pawan Gupta and Vinay Sharma refused to take the service of legal aid counsel and expressed their willingness to become witnesses in the gang-rape-cum-murder case.

Besides the two, Ram Singh and his brother Mukesh who were also produced before the court, have asked for legal aid counsel in the case for their defence.

Legal experts feel that an accused cannot hope to become a witness especially in a case of heinous crime like the Delhi gang-rape-cum-murder to escape punishment.

Usually in a case where investigators find it difficult to gather evidence, they could ask for an accused to become an approver to get crucial evidence and in return, the accused could get lighter sentence or escape punishment, the experts said.

The magistrate, meanwhile, extended their judicial remand till January 19, and asked them to appear before the court concerned on January 7 as per the production warrant issued to them after taking cognisance of the charge sheet filed against the accused on January 3.

"All the accused persons were informed that they can seek legal aid in the case, if they have not engaged any counsel. Accused Pawan and Vinay have refused to take service of the legal aid counsel and have submitted that they want to become witnesses on behalf of the state," the magistrate said in the order dictated in the open court room after the accused were sent back to jail.

The court also said, "Accused Ram and Mukesh have not engaged counsel so they want legal aid. They be provided the legal aid counsel.

"Let all the four accused persons be produced before the court concerned on January 7."

The magistrate in her order said, "Accused Pawan and Vinay have been directed to move an appropriate application to become witnesses in the case before the court concerned."

The fifth accused arrested in the case Akshay Thakur will also be produced before a court tomorrow as he is in judicial custody till January 9.

However, the case of sixth accused - a minor - will be heard by a Juvenile Justice Board.
While the accused were produced before the judge in her chamber, she dictated the order in open court room and no direction was given by her for prohibiting any media person from publishing or printing the proceedings.

A court had taken cognisance of the charge sheet against five of the accused yesterday under sections 302 (murder), 307 (attempt to murder), 376 (2)(g) (gang-rape), 377 (unnatural offences), 395 (dacoity), 396 (murder in dacoity), 394 (hurting in dacoity), 201 (destruction of evidence), 120-B (conspiracy), 34 (common intention) and 412 (dishonestly receiving stolen property) of the IPC.

The victim, a paramedical student, was brutally raped and assaulted in a moving bus here on the night of December 16 and died of her injuries on December 29 in multi-speciality Mount Elizabeth Hospital in Singapore.

    what better witness then the friend of the victim. just do the justice to these animals and let every one learn from this any girl,women is not a thing that can be used by men as an when they want. all of them must be given no chance to live in this society if given many mors six will come. best punishment for these is take them to a same spot where they committed the most inhuman crime and shoot them in open. if the victim was alive she would have asked for this =and nothing else. secondly this is the high time that scrape this NWC/SWC soon because they just hold on to their office and do nothing good why to wast our money to pay them for doing nothing.

    It appears that the rapists are members of a powerful group whose leader indirectly justifies rape blaming women/victim for rape through his repeated statements. How does the accused knows that if they become state witness their sentence will be reduced unless someone is indirectly guiding these animals trying to protect these vultures ? Nation should unite to give justice to innocent soul of victim, the bold daughter of India.

    Its quite interesting, that how these uneducated criminals came to know that they can be a witness, just to avoid death punishment. Even educated people dont know this is possible. Its clear that some influential people are guiding these criminals how to act inorder to take advantage of our judicial system. No mercy to these 6 criminals.     Why a witness is needed now. Their crime is crystal clear and aprt from the statement of deseased girl, her male friend is the solid proof to share the events taken place and the role of each one in the crime.

    Government in India is THE problem, so let us not give them more tax rupees. Instead, we need to empower citizens, especially women to protect themselves. Let Government liberally appoint Special Women Police Officers from all parts and sections of society and authorize and regulate private training centres for them. Similar to America of the past, this is a time for citizens to protect themselves through trained private security services and arms. If this trend shocks the police out of corruption and incompetency then a policy review can be considered in 5 to 10 years. However, at this stage placing confidence in the Government's police system is naive.

    WHY ONLY TWO ACCUSED WANT TO BECOME STATE WITNESSES ? Let all five become state witnesses and point finger at so called minor who is in juvenile jail.So,all five get big relief..And about minor who is 17 year old will become 18 years within 4 months.So,Juvenile jail can't keep a major prisoner .He must be released from juvenile jail and he can't be sent to normal jail because prisoner from juvenile jail can't be transferred to any other jail..THAT IS INDIAN LAW..so all are safe..Damini gone..why do you worry about past !! Now I think that our freedom fighters made a mistake..! Do you..?

    They should not be given a chance to turn into state witnesses. I don't think their witness is required to prove the heinous crime perpetrated by the very same goons to prove the guilt. There is ample evidences to prove the same. All the six including the juvenile should be sent to gallows as early as possible and no mercy appeal should be entertained in this case.

    There is no need to be state witness as we have already live witness as her boyfriend.Concerned institution might thought otherwise in accepting U TURN to convict others by hook or crook but circumstantial

    Seems like someone has already informed the duo about the loopholes in our system about the option of avoiding Max sentences. Death sentences to these rapists is a minimum & easiest punishment for the heinous crime committed. They should be awarded harsh life sentence instead after chemical castration and leave them to rot to death in pathetic conditions in the jail.
