'Hate Speech': HC Dismisses PIL Against Kalladka Prabhakar Bhat

Bangalore, Jan 10: In a relief to RSS chief Dr Kalladka Prabhakar Bhat, the high court on Wednesday January 9 rejected the PIL (public interest ligation) filed by Komu Souharda Vedike seeking re-investigation into his alleged hate speech last year.

The high court chief justice K Sridar and justice BV Nagaratna rejected the plea that was filed by Komu Souharda Vedike district president Suresh Bhat.

On January 22, 2012, RSS had organized Hindu Samajotsava in Uppinangady where Kalladka Prabhakar Bhat had allegedly made a provocative speech against Muslims. In this regard, a complaint was filed in Uppinangady police station.

Police who investigated the complaint registered a ‘B’ report to the court, which meant that the allegations against Prabhakar Bhat could not be proved.

As there was no police action on the complaint, Komu Souharda Vedike had filed PIL in the high court, which sent notices to Kalladka Prabhakar Bhat and to the state government, and also sought transcript of his speech.

Complainant Suresh Bhat had filed an objection to the 'B' report submitted by the police. The court in its judgement stated that there was no need of re-investigation nor was it necessary to create a special investigation team.

The court further said that as the matter was being examined by the Puttur judicial magistrate, the high court could not interfere. The PIL was thus dismissed.

    Basically it was not at all a hate speech. He raised his voice with strong local words against bad deeds of few people (not all) belonging to non hindu communities in his speech. At the same time he praised good people of the same minorites. And that is true as well. Pseudos couldn't understand this and considered his speech as hate speech.
    Its sad that we Indians never open for constructive criticism.

    The Constitution of India and its hate speech laws aim to prevent discord among its many ethnic and religious communities. The laws allow a citizen to seek the punishment of anyone who shows the citizen disrespect
    "On grounds of religion, race, place of birth, residence, language, caste or community or any other ground whatsoever".
    The laws specifically forbid anyone from outraging someone's "religious feelings". The laws allow authorities to prohibit any means of expression which someone finds insulting.
    What this law is meant for if the police and Govt authority cannot implement this law against RSS activist Kalladka Prabhakar Bhat. Justice Santosh Hegde, I want you to help us put him behind bar or we will feel that there is one law for the majority Hindus and another for the Minorities, SCs and STs. Come on, in this 21st century we are not living in a “Banana Republic”. I want the world leaders to condemn such open bias in the Govt system against the minorities.
    Sometimes we minorities feel insecure in this well appreciated Indian democracy.
