President Rejects Mercy Plea of Hindalga Inmate


Belgaum, Jan 14 (DHNS): The gallows at the Central Prison at Hindalga here will soon have to be readied for executing a murder convict whose mercy petition has been rejected by President Pranab Mukherjee.

This will be the first execution in the prison after a gap of 30 years. The prison does not have a hangman and will have to find one.

President Mukherjee’s official website shows that the mercy petition of death row convict Saibanna Ningappa Natikar, lodged in the Central Prison, was rejected on January 4, 2013.

Natikar had submitted the mercy petition on April 30, 2005, following the confirmation of his death sentence by the Supreme Court on April 21, 2005. Saibanna was convicted for the murder of his wife and daughter. The Ministry of Home Affairs had recommended to the President death sentence for Natikar on November 5, 2012.

The Hindalga prison is the only one in the State that has the facility for hanging those on the death row. The last execution was carried out in the prison in November 1983, when murder convict Hanumanth was hanged. Official sources said the prison here houses 60 death sentence convicts and nine of them (including Natikar) had filed mercy petitions before the President. The appeals of the others are pending in the Supreme Court and the High Court of Karnataka.

Deputy Inspector General of Police (Prisons) S Ravi told Deccan Herald that the department was yet to receive a communication from the President’s office regarding the rejection of Natikar’s mercy petition.

On receipt of the communication, all arrangements will be made to carry out the sentence. The prison does not have a hangman as the requirement did not arise since the last execution. The prison will make all necessary arrangements, Ravi said. 

The convicts on death row have been housed in a separate cell inside the prison and they do not have access to other inmates.

Among the convicts, psychopath rapist and killer Umesh Reddy alias B A Umesh has been regularly petitioning the President against the prison personnel, sources said. Reddy, son of Ajjappa Reddy from Hiriyur in Chitradurga district, has been housed in the prison since October 29, 2006.

The mercy petition of Praveen Kumar Sapaliga from Peereyadak village in Puttur taluk of Dakshina Kannada district was submitted on October 26, 2003.

Four aides of slain forest brigand Veerappan - Simon (son of Anthonyappa), Bilavendran (son of Marrisgouda), Gyanprakash (son of Joseph from Kollegal in Chamarajanagar district) and Madaiah alias Meesekar from Mettur in Tamil Nadu filed their mercy pleas on February 12, 2004. Shivu (son of Munishetty) and Jadeswamy (son of Rangashetty) from Kollegal in Chamarajanagar district submitted their petitions on February 28, 2007.

The death sentence of rape and murder convict Bandu Baburao Tidke from Bagalkot, who died in the prison on October 18, 2007, was commuted to life sentence by the then president Pratibha Patil in June 2012, five years after his death.

    I am surprised to read the last para. of this article. Death sentence commuted to life sentence after 5 yrs of death of Bandu Baburao. Is this not a shame on our indian laws. As it is the convict has passed away in 2007 and president mercy comes in 2012. What difference does it makes ?

    Agree with you Lydia Lobo, Kadri. Sunil Salve must have known the benefit of "good behaviour" and must have acted and pretended to be good. The people who passed such pardon should be examined to find out whether he was really good or they were bribed to let him out. How could such a good behaviour person commit another rape and murder of 9 year old girl? A thorough detailed inquiry can bring out the truth.

    The people who are awarded death penalty have committed pre-meditated murders. The rapists and murders that too serial killers are a threat to the society whether they have reformed during their term in the Jail. I really wish the President of India refrains from acquiescing to such mercy petitions as these evil people can cause more harm to the society than it is already done. Death penalty is a deterrent to other criminals too, not to indulge in heinous crimes. If these are pardoned, how can fear for crime punishment created in the minds of criminals. Some of the crimes that we read about like the Delhi rape case, raping small children below the age of 10 or 11 and then killing them is an evidence of a devil mind which cannot be reformed and death can only eradicate this evil and give some solace to the near and dear ones of the victims who had suffered because of these ogres.
    As regard the culprits of Delhi rape I wish all the six notwithstanding the one claiming to be juvenile, should be sodomised in the same manner that they did to the victim before they are given the ultimate punishment of death by hanging.

    The last paragraph shows how much we care for tax payers money. The convicts sentence was changed to life sentence after five years of his death..!!!??? Why the papers are kept at the presidents office for more than 0ne month..???? Why we have to feed those murderers for free...!!??? Why money has to be spent on such criminals even after the death sentence is given..??? Cant we act swiftly and close such issues without any delays..???

    Noteworthy is that a death sentence gets commuted to life - five years after the convict dies in the prison. This is our law !

    The famous Praveen Kumar, killer of dozens of women (exact number is not known even to himself) has filed for mercy petition !

    After Sunil Salve of Shiridi (who came out on pardon due to good conduct from earlier rape/murder), went on and committed another rape/murder of a nine year old girl, I am sure the President will think ten times again before commuting death sentences.
