Mangalore: Woman ASI alleges mental, sexual harassment by ACP

Mangalore, May 24: Through a complaint addressed to the city police commissioner dated Thursday May 23, Shreekala K T, working as assistant sub-inspector of police (ASI) in the city (south) police station, has accused assistant police commissioner, T R Jagannath, of mentally and sexually harassing her.

“I have been working in police department since the last about 20 years. During the last 18 months, I have been discharging duties as assistant police inspector in the city (south) police station. I have two daughters, studying in 5th and third standard respectively, and my husband is in a foreign country,” the ASI said in the complaint, a copy of which is in possession with daijiworld.

Shreekala has claimed that she has never shown any negligence towards her duties, but has accused assistant police commissioner, T R Jagannath, of harassing her during duty hours. She says she finds it difficult to discharge her duties and to run her family, because of this attitude of her superior.

“ACP Jagannath deliberately summons me to his room located upstairs, shows to me files with which I have no connection, abuses me with derogatory words, and sends me away rudely. He also refuses to grant me weekly off or sanctioned leave. When I seek casual leave for attending to family duties, the same is refused. Even when I fall sick and send all the necessary documents through the station house officer, he sends them back deliberately,” she says in the complaint.

The ASI said that she was suffering from high fever, and had provided necessary papers upon rejoining the duties on August 31, 2012, but the ACP in writing asked her as to why she should not avail of voluntary retirement from service.

“When I explained this problem to the police inspector, I was advised to vibe well with the ACP. None of the ASIs in the city are placed on night duty. But the ACP instructed the inspector to send me on night rounds alone, without any vehicle. I had to lock my children inside my home for attending to this duty,” she has explained. She also says she was bit by a street dog during the night rounds, and that she had obtained permission from the police commissioner to avail leave because of this incident.

She has further explained that the leave application from May 25 to 30 for visiting her native place, Kottayam in Kerala, sent by her to the ACP was cancelled by him. “As per the advice of the employees of his office, I approached him on the evening of May 21 to explain my personal problems, but he shouted at me with obscene words, and ordered me to go back,” she added.

She has requested the police commissioner to ensure that she is able to discharge her duties without mental or other kinds of harassment from the ACP, to get sanctioned leave when necessary, and to take action against the official for behaving in an indecent way against her. Copies of the complaint have also been marked to the state director general of police, home minister, health minister, Karnataka State Women’s Commission, Bangalore and Mangalore.

City commissioner of police, Manish Karbikar, has stated that the allegations made by Shreekala are being investigated by law and order department deputy commissioner of police, M Mutturaya. He noted that the complainant has not given specific details of sexual harassment which finds a mention in the subject of the letter.

    As per the labour law of the country even police staff are entitled for leave. It makes sense if the women police are given job in a most conducive environment. If found guilty the ACP should be punished for his ugly behaviour. Men always have ego over women especially when they are lone servers.

    I read in news paper that this ACP is hanging around in the same police station for the past 20 years. If this is true what is the reason for his long stay here at Mangalore when othe Police Officers are transferred from this place to other stations. Transfer rules are applicable to one and all. Why this disparity? Thats why he is showing his adament attitude that too with ladies. According to me lady police should not be entrusted with night duties.

    Dear Charles D'Mello, Pangala, Do not get angry my friend... To the best of my knowledge, police duty is considered officially as an emergency duty. Weekly off & Casual Leave etc. are on those "non-busy" days. It is not "Post Office" or "Bank" or "Taluk Office" job.

Sick leave has to be taken when one is sick and nothing is emergency when one is sick....!!!!??? What emergency you are talking about...!!!!???? There is no mention about emergency in the at all dear. This is nothing but harassment by ACP. Why he is silent so far..??? Is he finding escape routes...!!!????     It seems the only fault of the ASI is she is a woman. This ACP must be suspended first before conducting any investigations. He can be instituted if found not guilty, provided the investigations are fair and just.

    I can't understand where is the sexual harassment in this case? I don't agree that the ACP's order for deputing this officer for night patrolling duty is not lawful. He would have deputed her along with other officers. An uniformed officer can be deputed for all duties depending upon the situation. It is upto the ACP to justify why he has deputed a woman officer. In cases where a woman needs to be arrested or searched a woman police officer's presence is a must.

    I have lots of sympathy & respect for womanhood. But duty is a duty. No compromise on public safety & security. By seeing the reaction to my earlier comments, I feel her husband can come back from foreign & stay with wife. Take care of wife and children. Money is secondary as ASI's salary can not be too poor.

    1) She was made to go on rounds at night - No women constable are made to go on night rounds. Clearly ACP is involved in harassment.
    2) In corporates, Women are given more leaves than men - It is because women have more responsibilities towards home, Here she was not given.
    3) I have personally seen ACP or high rank officials treats their subordinates in a very bad manner and even abuse or filthy languages once when I was in police station for passport verification.
    I wish Women constable gets justice here.

    My she should leave the job....no..... she should have the courage to face person ...let him go and sit at home. He should be terminated from the service immediately( suspension is not effective treatment) or he should be demoted as ASI (based on humanitarian ground since his family should not suffer).A proper investigation is carried out and if he is found guillt he should be punished severely...its one example of such incidents ..there are many who belong to such category should be brought into the notice by the public and get appropriate treatment....
    Home ministry and Womens Commission..should look into this matter immedaitely and give proper treatment to that culprit...

    ACP abusing an ASI - possible, a woman ASI- highly possible.

    Why many readers are attacking women in this news item as well as in Murthy news item?

    We are not generalizing, but what does overall data say? If indeed women were so guilty (heartless, scheming, abusive, manipulative), I wonder why it is men raping women and not vice versa?
    Why it is female sex ratio in danger and not vice versa?
    Why the crimes against women are more and not vice versa?

    It is not easy for women to wash their linen in public. If they do, it must be the tolerance limit has been crossed. Introspect and then comment, this forum is an educative one mutually.

    A impartial enquiry by third party is a must to look into grievances of woman police official. Couple of days back, corporate world witnessed Phaneesh murthy scandal where how a boss can really exploit woman employee with sexual misconduct. In India it is rampant in Defense, University, government organisations where women face difficulties to discharge duties efficiently. Women commission has not taking strict action against erring bosses. To convince the realities of the case, a woman has to struggle a lot. In our patriarchal society, woman complaints are not seriously taken. I think this ACP rogue must be kept in suspension till a neutral party inquiry gets over. If the woman employee is having some beauty, bosses wil have an eye on them. How bad our society is in treating our own sisters in a dignified way. If a police officer undergoes this kind of trauma, what is going to be the fate of public ? Especially when a woman/girl goes to lodge a complaint in a police station ?

    Well, K.J. George must look into this matter personally and see to it that this becomes a examples for other erring bosses. Minister George are u listening ? If ACP is not able to control his desires n urge in public service, plz give him proper medicine sir.

    ASI Sreekala, these kind of things happen in every DEpt. Institution.You have to balance between your job and family life.You have to sacrifice one among the two.Leave matter is the only subject where the superiors can exercise their power and the subordinates are the victims.Since you have opted to be a working woman that too with a responsible post, You have to perform your duties on challenge despite mental tortures without clubbing sexual harassment. having served in an institution for 40 years ,going through all this kind of situations ,this is my sincere advise to you.Life is a challenge, face it.

    He should be dismissed from his job permanently and booked under the appropriate sections of the law for life time, so that it will be a warning to other rougues in the police dept.

    Home minister must conduct full enquiry into such incidents, so that honest police personnel will be able to discharge their national duty without any interference.
