Mangalore: ACP case - Special committee to investigate sexual abuse at work

Mangalore, May 25: A special committee has been formed to deal with matters relating to cases of sexual harassment against lady staff in work places, said Manish Karbikar, city police commissioner at a press meet at his office here on Saturday May 25.

The move comes in the wake of allegations of sexual harassment levelled by ASI Sreekala against ACP Jagannath.

"It is true that we have received a complaint from Mangalore south ASI Sreekala alleging sexual harassment and use of foul language against her, when she had gone to request for leave. Taking this complaint into consideration, a special team has been formed to investigate the matter," he said.

The team has been formed under certain guidelines set up by the Supreme Court, to curb the sexual harassment against lady staff in any organization, company or other places, as per the judgement on writ petition number 666/70/1992, dated 13/08/1997.

The team that has been set up in Mangalore comprises Kavitha B T, ACP, as the president, K Kalavathi, police inspector as secretary, with members Hilda Goveas, assistantt administrative officer, Mangalore city commisioner's office, Pauline Mariyappa, branch superintendent,  crime branch commisioner's office, Dr Rameela Shekar, dean, School of Social Work, Roshni Nilaya, Vinay A Gaonkar, police inspector, CSB, Ramachandra B Maladevara, of Urwa police station, Girija, PSI, CSB and Nagini, APSI, Ullal police station.

"Sreekala's case will be investigated by the committee and appropriate action will be taken against the accused if found guilty. Until the investigations are complete, both ACP Jagannath and ASI Sreekala will continue their present duties and in the same station," Karbikar said.

"No order for suspension has been passed for the time being, but ACP Jagannath is on leave for 10 days from tomorrow. Until then, Mangalore north ACP Ravi Kumar will be handling both South and North police stations," he said.

DCP Mutturaya was present at the press meet.

    No one knows what is the truth ? who & all is commented here nothing knows about Ms Shrikala or ACP. due to grudge any one might have spoiled ACP's Name. we cannot directly blame ACP without knowing the truth. So be patience all the truth will come out..........soon. He is having 34 years of service,from the department no one given the statement about him. They might tell about better than normal public. please don't give one sided result atleast try to know other side of the case.

    The ladies who are working any office cannot be considered as sex objects. They should be treated as either sister or mother. The employment of the ladies is necessary because cost of living is going to be very high. I am at present in Mumbai I know what is happening in the Police dept. Sometime they act worse than the criminals. Once I had a call from P.A. of C.P. of Mumbai because the matter went to his table, the Senior P.I. of Bandra Police Station refused to register an FIR. Registering FIR not the discretionary power of Police Officer as some time they think. If the Cognizable offense is committed any person Police Officers are bound to record the FIR.See the case of Ramnarayan Gupta of Mumbai who has been killed in encounter by the Police. When the Bombay High Court convinced that it was fake encounter. It directed one Magistrate of Andheri Court to conduct the inquiry whose name is Smt. Sheikh when she started conducting inquiry, the Senior P.I of Andheri Police Station threatened her with dire consequences with the cell phone of P.P. Now both are languishing in jail in Mumbai. If there is any complaint by the lady police officer is there it should be dealt with impartial because nowadays many Senior P.O. are in pay roll with under world.

    This investigation is a eyewash....so far ACP is not suspended, then what is useless investigation...!!!!???? Are you trying to fool general public...!!!???? Why both of them will work at the same station....!!!!???? Are you trying to blackmail the lady emotionally and trying to come to a out of court solution...???? Our Newly elected MLA's are keeping their mouth shut (May be still celebrating their victory..!!!??)...I do not understand what they can do for Mangaloreans....!!!???

    this report itself shows us the answer and the outcome of the investigation clearly ... a man who has denied a lady sick leave or any other leave has gone on a long leave of ten days as soon as his rubbish was exposed like a coward going into hiding unable to defend himself and the commissioner who is another paper tiger who does not justify what ever he does and puts more ladies who are in police dept on the commitee so that they can be bullied easily by the monstorous acp .... now if the comissioner has brains he should suspend the acp immediately for not granting leave for others and taking it himself for being unable to face public and defend himself

    With malice towards none, I must say here that the amount of sexual abuse cases occuring throughout our country, it looks like we men are either perverts or this sexual abuse has become the weapon of choice for many women.
    I am not saying there is no sexual abuse happening at work place. However, many of them are just used to frame a superior or a colleague for ulterior means.
    All said and done, I am not in favor or against the ACP. One will never know if he was framed or if he really was a pervert. But he deserves and has the right to a free and fair investigation. The first one must be a internal investigation comprising a neutral female officer. If need be a second investigation this time a external one must be conducted. Both while the ACP is kept under suspension.
    But, end of the day, the ACP has to be treated with dignity until he is proven guilty.
    Please note: I dont know this ACP so my suggestions are not based on those lines. It is just an observation.

    Action should be taken only if he found guilty...
    Point to be noted my Lord.... He will never be found guilty. He will come out clean just like our white wearing politicians. Shrikala was mentally stressed when she complained to the higher authorities- will be the outcome.
    Thanks to our 1947 rule book which had torn many of its pages due to constant reading and studying by our politicians.

    On going through the names of special committee to investigate the matter of sexual abuse it is found that most of them are from Police Department. The Committe should be formed from all departments. If majority of them are Police Officers, the accused being a Police Officer, there is every likelihood/chance of using his influence on the committee members. The Police Commissioner should know all this before forming committee. This being the case there is no hope of getting justice to the Lady Polic e Officer. By the by, why these ACP's are detained for so many years in one place. Doesnt the transfer rules applicable to these cadre of officers. Police Commissioner should look into the matter and try to find out the reason why he is overstayed in one place without any transfer. It is funny to note that the ordinary police officials get transfers to distant places. Whereas the officers try to anchor for more than a decade or may be more.

    In Indian Judicial System, best way to stop discussing about any issues that order for an enquiry and wait till final report. It means both parties restrain from talking about their problems till completion of enquiry as enforced in Indian Judicial System. If any one Party is already knew that they have done wrong then start influencing the enquiry committee by requesting them to delay the enquiry report to such a period that people tends to forget the real issues after few years. This is what happening in most of the scams like 2G, Coalgate, Helicopter, CWG, etc, etc. Again if any Party is near and dearer to any Political Party Leaders, then just forget about justice. Take the example of Sarada Group Chit Fund Fraud case. Owner of this Group is very influential person in TMC but had business dealing with Mrs. Chidu being appointed as Lawyers cum Legal Advisers by paying her one crore of rupees as fees

    If ASI and AC work at the same station till the investigation, then I am sure the lady will never get the justice....!!!???? She will be brainwashed or emotionally changed..!!?? Please ensure ASI and ACP work in different stations and will not talk to each other till the investigation is complete.

    This investigation should be conducted by a retired District and Sessions Judge and not by the same Police Dept. It is a known fact that the ACP himself will benefit and not a junior Female officer. What do you feel ?

    The feminism creeping in Police force too!. The lady ASI may have many complaints , so as ACP . Nobody pays heed for plight of police men and work pressure they go threw. ASI works under ACP , even if he shouts at woman this can be treated as 'harassment ' w r t pathetic Indian law. Men voices are no where to be heard , as political classes are busy with pleasing women. . . . .//. . . . After drafting of work harassment act , fake cases are on rise , so many innocent men are nailed , just because they talk tough on their women colleagues ( not harassment by any standards ). Alternatively if a lady boss harrassess a male subordinate , there are no clause to protect men. Law should be in such way to be fair for all , and women should not be given extra leniency in any workplaces as such. If a female works under male boss , he has every right to shout at her , after all its work , dead line are threw. But what happens is women take advantage of law to prosecute boss or colleague itself. The above lady ASI if found lieing should be severely punished.

    The tainted ACP is should be shunted out from Mangalore and the police department must come out clean. The onus remians with the police commissioner and he should act. If not the people of Mangalore will not keep quiet since the ACP is involved in many cases and found to be very dishonest. We need good officials who can be good public servant.

    Sir,most of the SIT team members are below the rank of ACP!!!Why can't Sreekala,s petition taken in to officially (FIR)and investigate as per the merit and circumstantial evidence?This episode running more than a year between accused and victim.If police department can't give justice to ASI ranked officer then how can we expect the justice for common man.Apart from that there are other two complaints registered against officer in question and therefore need serious investigation.Please ensure ASI, Sreekala's safety and outside element may force her to reach out amicable settlement!!.

    I fail to understand why ACP Jagannatha is still continuing in office while investigations against him are instituted ? Reduce Jagannatha to common man status before conducting any fair n credible investigation. Otherwise there is no meaning to investigation dear commissioner saab. Resignation or sacking is the first step to initiate any reasonable investigation. As the case involves woman employee, it is very serious issue. Do not allow ACP to influence or threaten investigations. Common-sense must prevail on part of city police commissioner.
