Revenge motive: Daijiworld photographer accused of sexual harassment

Mangalore, Aug 15: In what appears to be a case reeking of revenge motive, Daijiworld photojournalist Dayanand Kukkaje, who is well-known to the readers of daijiworld around the world, has been accused of sexually harassing a girl.

Kukkaje has been contributing pictures not only to daijiworld but also to some leading print editions in the city as well as around the nation.

Based on a girl's complaint, the Pandeshwar police on Wednesday August 14 took Daya into custody.

However, Daya has clearly denied the allegation and said that the girl who filed the complaint is not even known to him. He has said that it is a consipiracy by his rivals to defame his name and spoil his reputation.

"I have always been under threat from fellow photographers who could not bear to see my success in the field. But I have been doing my work sincerely with sheer hard work and comittment, and gained appreciation from people around the world. I will fight back, as I know I am innocent," he told the reporters in the police station.

Moreover, it is to be noted that the police arrived at around 9 pm to take him into custody, and they were reportedly accompanied by two men and woman photographers, all of them his rivals.

"The timing of the arrest itself shows the motive behind this. Tomorrow being Independence Day is a government holiday. I can apply for bail only on Friday," he said.

The girl stated in her complaint that Daya got friendly with her over Facebook and later took advantage of her in his flat. Daya however has clearly said that he has not done any such thing.

Of late, there have been a number of instances where the law on rape has been grossly misused for vicious motives. If the allegations are finally proved false, as Daya himself believes, a defamation case against those responsible would not be ruled out.

It is learnt that Dayanand Kukkaje's lawyer is preparing to file a counter-case on a lady photographer who has been reportedly sending abusive messages, emails and personally passing telephone messages against him.

    Is it usually done that the police take along with them the complainants and the photographer during custody of the accused?
    Firstly, the higher authorities should question the police in their involvement with those people.

    We don't know the reality but looks like fake allegation against the journalist. Many women than men taking advantage of law and try to defame or put behind bars which has become very common the law and order should peep deep into this matter and should bring to light the truth.... there are many cases where they hear allegation one side the innocent is punished.... law and order given to us for our upliftment not too ruin life someone who's nothing to do with it.... jealous,revenge...... is the cause sometime....All RAPE cases are not raped ones they're COOKED ones

    The whole story is cooked up by his rival lady photojournalist to defame Daijiworld photojournalist Dayanand Kukkaje.
    Police should go deep into the whole conspiracy and hook this culprit syndicate. If true than she has to pay a chunk for defaming Kukkaje.

    If Mr Daya kukkaje believes hat it is been done by his fellow photojournalist or photographers, ithink this case should also have to be looked after by the DK photograpers association.. or the press journalist association.. why the associations of both professions are keeping quite? is it not coming in their agenda.. If Daya kukkaje is true in his statements both associations should ban those professional whom daya is naming.. And if daya is culprit police should act as per indian judicial system ...

    Very serious case indeed. The police should investigate the case in detail. Its a sexual harassment case similar to that of Pandeshwar lady SI who filed case against DCP. So ultimately it will become a false complaint made out of vengeance. Its just like the saying operation successful but patient died.

    The person who is falsely accused of sexual assault may well never recover from the serious damage that you do to their reputation. Accusations of sexual assault are very serious and should never be taken lightly. The problem is that far to many people use accusations of sexual assault for their own gain . If it found true what that lady claims, he must be punished, otherwise the lady must be punished severely.

    What is Sexual harassment? According to United Nations Gender equality and the empowerment of Women:
    Sexual harassment is any unwelcome sexual advance, request for sexual favor, verbal or physical conduct or gesture of a sexual nature, or any other behavior of a sexual nature that might reasonably be expected or be perceived to cause offence or humiliation to another, when such conduct interferes with work, is made a condition of employment or creates an intimidating, hostile or offensive work environment. While typically involving a pattern of behavior, it can take the form of a single incident. Sexual harassment may occur between persons of the opposite or same sex. Both males and females can be either the victims or the offenders.

    In this article the name of the girl is not published. The girl stated in her complaint that Daya got friendly with her over Facebook and later took advantage of her in his flat. It is mentioned The girl became friendly with Daya in the Facebook and directly to Daya's Flat. This is really fishy. How did Daya pullout this girl out from the facebook to his flat. In this article it is not mentioned when this incident took place.
    If this girl had gone to Daya's Flat, how did she go, When did she go, why did she go, and what was her intention. The girl has to prove that she had gone to Daya's Flat. If the girl complains Sexual harassment by Daya then did Daya invite the girl there is no such proof or evidence. It may be the opposite case too that the girl may have gone to Daya's Flat to harass Daya without invitation. The girl has to prove that Daya Invited her with an Invitation, and if there was a sexual harassment, she has to provide proof or evidence of sexual harassment either with a video recording or physical assault, or a medical test or by DNA testing. If nothing can be proved than it is a case of defamation. Daya can sue this girl for defamation for a huge amount as Daya is a professional photographer for many articles.

    Looks like this is "RAPU" with usual notations.....

    Normally this type of timing is chosen by Police to intimidate defendant...

    It reminds me private Contract carriage buses were seized and nationalized during emergency on Saturday night to intimidate private bus owners.... Justice Govind Bhat of Karnataka High Court while declaring this act of State as illegal passed strictures on state for ing specific timings to deny petitioners time to approach the courts...

    Normally police do not behave like this with journalists.....looks like Mangalore police is moving to all time low....

    We just hope that the above lines prove your honesty.
    While reading on  a website any normal person will understand that kukkaje is nowhere at fault. If at all the girl wanted to complaint, why didnt she do it before going out with kukkaje for a cup of coffee ? Is it that she had no money for a coffee, but had sufficient time to loaf with a man?
    Why did she wait for Kukkaje to RAPE her... and then lodge a complain. The female who had no guts to confront the love in front of her own parents, will dare to go to Police station? Seriously - only Investigation and Medical report can prove the truth. Its also true that in reality all Fraud cases, Revenges take place just a day before the weekend or prior to public holidays.

    In this article it is nowhere mentioned as RAPE, it is only mentioned as Sexual Harassment. The term RAPE is the extreme word and has severe consequences. There is a big difference between sexual harassment and Rape. You need to be very careful before you comment.
