Delhi gang-rape: All four convicts awarded death sentence

New Delhi, Sep 13 (IANS): As a nation waited for the judgement with bated breath, a judge Friday just took only a few minutes to sentence four men to death for the merciless gang rape of a young woman in Delhi last December resulting in her death.

Additional Sessions Judge Yogesh Khanna, who presided over a fast-track court, said their "hair rising beastly and unparalleled behaviour" definitely qualified it as one of the "rarest of rare cases.

"Hence, I award the following punishment to each of the convict," the judge said, symbolically breaking the nib of the pen.

"Accordingly, the convicts be hanged by neck till they are dead."

The four men - Mukesh (26), Pawan Gupta (19), Vinay Sharma (20) and Akshay Thakur (28)- were convicted Tuesday in the case that shook the nation and got global attention.

The judge sentenced the four to death for murdering the 23-year-old trainee physiotherapist. On Tuesday he had found the four guilty on 11 counts, including murder, gang rape and dacoity.

"The subjecting of the prosecutrix (victim) to inhuman acts of torture before her death had not only shocked the collective conscience but calls for the withdrawal of the protective arm of the community around the convicts," the judgement said.

"These are the times when gruesome crimes against women have become rampant and courts cannot turn a blind eye to the need to send a strong deterrent message to the perpetrators of such crimes," the court said.

"The increasing trend of crimes against women can be arrested only once the society realize that there will be no tolerance from any form of deviance against women and more so in extreme cases of brutality such as the present one and hence the criminal justice system must instill confidence in the minds of people especially the women.

"The crime of such nature against a helpless women, per se, require exemplary punishment," he added.

As soon as the judge read out the sentence, Vinay Sharma fell down and started crying "Sir ji, Sir ji (please sir, please sir)" addressing the judge.

But soon the police took all the accused away.

Additional Public Prosecutor Dayan Krishnan said after the judgement was delivered: "All I can say is that I have done my job. I have never seen brutality like this."

He added that now the judgment will go to the Delhi High Court for the confirmation and the process take a maximum of 30 days.

Speaking to reporters outside the Saket court, defence lawyer A P Singh said that the death sentence was 'politically motivated' and he would appeal to the higher court. He slammed the government and home minister for influencing the decision of the court. When reporters pointed out whether he statement was not contempt of court, he said it was not.

"If the country wanted this case to be a deterrent, I will wait for two months to see the crime scene. If no rape takes place due to death being given in the instant case, I will give in writing that my clients be hanged," he said.

Mukesh's lawyer V.K. Anand said: "We will appeal in the high court. This did not deserve death sentence."

After the judgment was announced, there was loud cheering outside the District Court, Saket, where hundreds of people had gathered since noon.

The 23-year-old woman was brutally gang raped on a moving bus by six people, including a juvenile. The accused then threw her and her male companion out of the vehicle -- without clothes -- on the cold December night.

The woman died of her grave intestinal injuries Dec 29 at Singapore's Mount Elizabeth Hospital.

One of the six accused was found dead in a cell in Delhi's Tihar Jail while a juvenile involved in the crime was Aug 31 sent by the Juvenile Justice Board to a reform home for three years, the maximum under the juvenile law.

Death due to pressure from people: Akshay's family

Patna, Sep 13 (IANS): The death penalty awarded to the four men convicted in New Delhi's Dec 16 gang rape was given "due to heavy pressure from people across the country", said the family of Akshay Thakur, one of the convicts.

Akshay Thakur is among the four men who were sentenced to death Friday for the brutal gang rape and murder of a 23-year-old physiotherapy intern in New Delhi.

"Court's order is on expected line due to heavy pressure from people across the country. We were hoping against hope," Akshay's father Saryu Singh told IANS.

"Even God has left us at the mercy of the court that awarded capital punishment to my son," said Saryu Singh, a marginal farmer in his 60s, over telephone from Lahang Karma village under Nabinagar police station jurisdiction in the Maoist affected Aurangabad district, about 150 km from here.

Akshay's mother Malti Devi, in her mid 50s, and Akshay's wife Punita Devi, are inconsolable after they watched news that four men including Akshay were sentenced to death.

"For all of us, it is a saddest news. My mother and sister-in-law have been crying and have fainted at least thrice after they watched the news," Abhay Singh, one of the two brothers of Akshay Thakur, said.

Abhay said the entire family and some relatives remain glued to TV to catch the news since early Friday.

"We watched TV and were hopeful for some relief. It proved useless as Akshay's fate was decided the day he was convicted by the court. It (The sentence) was merely delivered now," he said.

Dinesh Singh, another brother of Akshay, said dozens of local mediapersons and people from nearby villages gathered outside his thatched house to know the mood of the family after the court's order.

Every single deed is recorded in the book of karma and settled in the same manner as they committed. If anyone killed 100 innocents, he will be killed and given life again and again till 100 times.     But has anyone thought of researching why these people did such a unhuman act?
    So as to learn and prevent the source of it.
    Could be drugs, Could be too much porn on phones, Could be jealousy.
    I believe there is always a trigger or source for a fire. It should be found and removed from root so no other women gets raped in our country.

    Firstly we should appreciate the Police Dept. and the Dental Doctor of Puttur origin who have produced strong evidences to the Court. Otherwise this verdict of awarding death sentence to these four the most cruel accused would not have been awarded, whatever the protests are from the public. Further the advocate of Accused is still backing thr culprits which is a shame on his part. May be the convicts awarded death sentence but tomorrow they may submit mercy petition to the President of India. Again there will be delay in implementing the Court order.

    Finally the rapists got what they deserved. I think this is the fastest judgment in the history of Indian court proceedings which is because of publicity it got all over the world and the pressure from the government and all the political parties alike, as well as outrage of the citizens. The defence lawyer is asking for mercy to these gruesome killers and says the verdict was politically motivated. Would he say the same if one of his family members were in place of the victim?
    While rape is a heinous crime against women, killing them after rape should never be forgivable. The image of India is tarnished by these criminals. Because of this, the number of women tourist is reduced. Again, juvenile or no juvenile, there should not be any exception in giving death sentence. If a juvenile can do what adults do, why not punish him like adults are punished.
    Nobody knows how many rapes are happening daily in India and one of the reasons for ever increasing number is the rapists think that the girls don’t report the case in order to safeguard their identity.

    Fast track court has decided. Their job is over and they have lived upto it..
    BUT
    This is only beginning of a long process, unless all other higher courts support today's decision, this is going to be a long long case and who knows some of them may be freed\out on bail too.
    There are people with clout who can influence the judiciary. It is nothing new. There should be a check on the funds the culprits are getting for defending themselves. Then it can be found out the person\s helping them and their purpose in doing so. To change the present sentence to lesser, they need big money...

    Wish the award of death sentence was last and final and cannot be revoked.
    So we have to wait and see ...

    Justice to NIRBAYA.Glad capital punishment is awarded.

    It came to lime light because of national wide protest. I wonder who will provide justice to all those who hails from small villages and justice is never met. Not even their complaints is recorded in police stations.

Just to get money they would stoop to any level, even if they need your blood they will not hesitate to take your life. for them their money-making is their trade.     Awarding a death penalty is always a wrong decision though the case had evoked nationwide outrage in India and led the Indian government to bring in a stringent anti-rape law.
    The only moral justification for killing a person is direct self-defence. When a criminal is defined in prison, he does not threaten society, so killing him is not justified by self-defence. And even if capital punishment deters others from committing similar crimes, this would be an indirect defence against murder rather than directly from the criminal being killed. Direct self-defence implies killing someone who himself, at that time, is a threat to other persons, and this precludes taking human life just for punishment.
    Some studies have concluded that capital punishment is not a greater deterrent than imprisonment. Even if the death penalty deters crime, deterrence alone does not justify the penalty. Deterrence has to be balanced with the human rights that even criminals have.
    I am of the opinion, capital punishment is morally wrong, then to deliberately kill someone, who has already been captured and no longer a direct threat to society, is murder.
    Capital punishment gives the government the legal right to commit first-degree murder. What kind or moral message does that send? That murder can be proper. We might debate over the circumstances of when murder is proper, but having established the principle that murder is not absolutely wrong, the state is brought down to the level of the criminal: both are murderers. But society and government should be nobler and more righteous than a murderer. There cannot be any place for capital punishment in a democratic society.
    There are four morally justified purposes for punishment. First is the protection of society. The second morally proper reason for punishment is to reform and rehabilitate the criminal. The third legitimate reason for punishment is deterrence. The fourth reason for proper punishment is the restitution of the damage.None of these four morally legitimate reasons for punishment includes revenge. Vindictive killing and infliction of pain might make the victim or his relatives feel better, but this goes beyond what is morally justified for restitution and protection. Two wrongs do not make a right.

    Though this was a most deserved case for capital punishment,
    as you said, most brutal punishments like beheading in autocratically ruled countries too have not reduced the rates of such crimes per studies!!!

    Most important is increasing awareness and changing our attitude towards women that of respect and not an instrument for pleasure!! And if one might have noted most of the accused convicted in such crimes are from the most poor strata of society having no basic education, no job, addicted to drugs, and just living an animals life!! Has anybody from the rich, influential, powerful have ever been convicted and even send to jail? It is mostly the poor and ignorant in our country who are always send to the prisons and gallows (some studies suggest many innocents framed up are languishing in jails who do not even know what crimes they have done), because they do not have access to the best of lawyers!!

    Let's see what is the outcome of Asaram Bapu case (which most might have forgotten), which looks to be genuine with strong evidence if news reports are to be believed!!

    This is just an opinion and the capital punishment d is in the right direction!!

    I dint get it.. Why is A. P Singh getting so sentimental about these criminals? shouldnt he be just happy that he tried his best to save them from gallows, honestly even he must be knowing these were the criminals of this gruesome crime. How the hell does he expect them not to be hanged, ofcourse rapes will not stop if they were to hang today but if we use reverse logic..If these criminals were to get a lighter sentence wouldnt the other criminals be emboldened that they can get away with such crimes lightly especially since not all cases get high profile attention like this one !

    Do you remember the infamous Delhi Tandoor Murder case held during 1995. one Sushil Sharma killed his wife Naina Sahni and took the body to a restaurant. The body was chopped into pieces and put in a Tandoor to burn. He was sentenced to death on Nov 7, 2003. His appeal is now pending in the Supreme court or President and he is living happily with taxpayer money. Afraid all the four men will get same treatment. MAY GOD SAVE MY COUNTRY.

    Hats off to Delhi court.A Landmark judegment indeed.This will go a long way in ensuring justice to all pending rape case presently with various courts across the country.Courts should expedite all pending cases expeditiously keeping the Delhi court verdict in mind.Many cases are nipped in the bud by various vested interests needs to be reinvestigated.Judgement is a great hope for parents of girl child in particular in the country.
    Now let us wait for the court verdict on Manipal rape case.

    As per the recent Scientific Research Report it is observed that, there are many GENTLEMEN including MINOR BOYS get raped by a WOMAN which most of the time goes unheard, unseen or though partially known but, not made much noise by the Men due to fear of the society or Helplessness due Inefficient law system in India. The Law system can not be Gender Biased as it is at present. When Female gets raped by a Male in India it becomes high point of discussion by the Woman dominant Men as well female. But, when Male gets raped by a Female it becomes unpotential and of less importance.

    In other words, Indian Judicial System suffers Gender Biased Law system which is a outdated and unscientific Law of Uncivilized, Uneducated and Beat-cultured tribes. Civilized, educated and Cultured society always thinks the Law Unbiased Law system at any point of time and such Unbiased Verdicts are always Welcome. We civilized don't welcome this Death Sentence which is Gender Biased, compromised and Partial. Did we give a Death Sentence to a Girl in Bangalore who with her new fiance killed and crushed the Innocent Boy and Murdered him in a quiet place who her Old Boy Friend...??? Did we make all India Protests started from Zammu to Kanyakumari for the same...??? Did this Bangalore woman take advantage of the Gender Biased Law system in India to murder her Old Boy Friend...??? Where is she absconding now...???

    Just because they got death penalty doesn't mean they are suffering for the brutal crime they committed.The other freak Ram Singh was having a good time in jail(playing badminton) just before he committed suicide. So who knows how these criminals be treated after they are jailed. They should be brutally killed instead. And yes the juvenile, how can he not be punished the same way as the others where he was also totally involved in the crime. He too should be killed coz it was him who ed the rod into the girl. So I think it is time for the public to take action against the rapists.Please come out with a solution to punish them. Being a girl my heart pines for nirbhaya for the misery caused to her by the bloody bas$#%%s.

    Hang the other accused who is said to be a Juvenile with them, he can not get away with the lighter punishment of 3 years in Jail. All the people who committed such a heinous crime should be punished with death. Same should be followed in all rape cases including Bombay, Manipal cases.     Indian courts sentenced 1,455 prisoners to death between 2001 and 2011 and only 03 convicts have been hanged in the last 17 years(including Ajmal Kasab)

    Our president will eventually grant clemency in this case too.

    All this Hype will eventually lead no results and the government will feed these merciless animals with taxpayers money for the rest of their lives.

    Thank God. Lastly justice has been given to Late Nirbhaya in a short period of 9 months. They should have been opportunity to appeal only in Supreme Court within one month. Hope they appeal any higher court, the court will uphold the decision given by the Fast Track Court. The juvenile, should also to be put on trial after attaining the age of 18, till that time he should be in reform home. The law should be amended accordingly else all juvenile will commit the offence as they know that there is no capital punishment. The statement given by the defence lawyer A P Singh is of contempt to the court and he should be given show cause notice for this.

    Will death sentence be awarded to rapists of Manipal gang rape case? Will death penalty be imposed on a bus conductor who raped a girl continuously for three days ( girls parents were labourers and had gone to their native when girl was alone at home ) ? Will conductor muhammad who tortured women and similar perverts get serious punishment from our courts ?
