New twist: Beltangady accident was not murder, says complainant

Beltangady, Nov 24: In a new twist in the Nekkilu accident case which had taken the life of a youngster and resulted in the arrest of a man on charges of murder, the person who had pressed murder charges has now retracted his statement.

On November 20, an accident between a Bolero car and a bike had resulted in the instant death of Dinesh Gowda (23), who was said to be close to Praja Prabhutva Vedike chief Mahesh Shetty Thimarodi.

Soon after the accident, hundreds of people gathered at the spot and protested, and even damaged the Bolero. Balakrishna Poojary, a supervisor in the Dharmasthala agricultural department, who was driving the car, had escaped from the spot.

Later in the evening, Dinesh's uncle Siddappa Gowda had filed a complaint in Beltangady police station, and accordingly, the police arrested Balakrishna on charges of rash driving and murder. Siddappa in his complaint had alleged that it was a 'planned' murder.

However, when Siddappa and Dinesh's father Babi Gowda were produced in the court the next day, they said that their complaint was improper. They said it was not a murder and was purely an accident.

They also pleaded with the judge to allow them to withdraw the complaint. The judge reserved the order and said that he would examine the case.

Balakrishna Poojary was produced in the court and sent to judicial custody for 14 days.

Sharmila, I agree with you. A few days ago on TV9 Sowjanya's parents claimed that this driver, Balakrishna Poojary had approached them & warned them not to participate in any protest of their child's rape and murder. Now, the same guy killed an active member of Praja Prabhutva Vedike. How can it be an accident and a co-incidence ? Why all of a sudden, overnight the father and uncle of Dinesh changed their statement ? Certainly we have a threatening and a murderous republic in and around Belthangady. Brain mapping of driver will reveal his role in this whole mysterious episode. Money and power are having the upper hand now, but, the time will change and truth will prevail. Jai Hind.

All accidents are not murders. The person can take the revenge by hitting the vehicle on his enemy it amounts to murder. The complainant cannot make haphazard statement before the Police and the court. One side we make allegations against the police for not acting and other side we make the different to dilute the case. This is not proper. The person who made the statement accusing the accused had committed murder, he is liable for prosecution. The Magistrate may reject the application and commit the case to Sessions Court which will decide the matter. In mostly rape cases in Mumbai this type situation arises but even high court also reject the such application and ask the state to start the trial.

In this forum we are talking about Murder or attempted to murder not rape.
Most of the cases money speaks, not lawyer speaks.

    Guys,
Accused is in judicial custody.Inquiry is on.Let us wait for the judgment.Jumping into conclusions without any idea will lead us in wrong directions. One can see there has been lot of attempts to create unrest in that place.

If you call this "Accident" as "Murder" , then all accidents on roads will be called as Murder if someone is killed. Here, rash driving is accepted, but drivers intention is not to kill..

    Hi Jaimini
Even if it was not planned murder! Police must register murder case in every rash driving. Every driver who drive rashly should aware that his driving may take away the innocent life

Rash driving is threat to either our self or other road users,so if the accident takes place bcoz of that, must be considered as murder, why not???
