Mangalore: Bajpe rape case - Man gets 7 years in jail, prime accused absconding

Mangalore, Dec 5: The second sessions court on Wednesday December 4 sentenced a man to seven years of imprisonment for raping a minor Dalit girl in June 2011. The court also imposed a penalty of Rs 10,000.

Dinesh Amin (27), a resident of Pade Peroor Chavandipalke house was convicted of raping a 12-year-old student at Bajpe on June 24, 2011.

The main accused Manoj B Shetty (33), a resident of Kinnipadavu, Bajpe, is absconding.

Manoj, an auto rickshaw driver, had kidnapped a 12-year-old Dalit girl in his rickshaw when she was going to school, taken her to his rented house at Kaudur Padavu, and raped her. He then called Dinesh Amin to his house and the latter too raped her.

The duo threatened to kill her if she revealed the incident to anyone, stated the complaint lodged in Bajpe police station.

The police had arrested both the accused and the then Panambur ACP Puttamadaiah had filed a chargesheet in the court.

However, prime accused Manoj Shetty managed to get a bail from the high court. He failed to appear in the court in the final stages of the hearing and went absconding.

On Wednesday, the sessions court announced the verdict holding Dinesh Amin guilty of the crime. Out of the Rs 10,000 fine, Dinesh has to pay Rs 8,000 to the victim, and failing to do so would attract another six months in prison.

The verdict was pronounced by judge Uma M G. The public prosecutor was C Venkataramanaswamy.

    HIGH COURT MUST HAVE GIVEN BAIL TO MANOJ SHETTY ON THE BASIS OF SURITY GIVEN BY SOME PROMINENT PERSON. IN SUCH CASES THE PERSON WHO HAS RECOMONDED BAIL HOLDS RESPONSIBLE IF MANOJ SHETTY GOES ABSCONDING AND HE SHOULD BE TRIED OTHERWISE SUCH INCIDENTS HAPPEN VERY OFTEN AND SO CALLED PROMINENTS WILL BE MAKING MONEY BY MISUSING THEIR POWER.

    India is not changing its ages old law because....White dressing and topiwala people needs loopholes in the law to get out from their karma....So they are not so much interested in that.Their attitude is: "You rape....and we also rape India."

    Court charged penalty for acid attacker Rs.3 lack's, where as Victim spend on reconstruction surgery 3 in to 7 times!1
    Why court will not give one more chance for Vitim to flash similar acid to culprit convicted so that he can understand the pain and cost??

    @jennet prescilla , mangalore /muscat. I think there is no enough wisdom in indian law to prosecute genuine cases , albeit., what we find is a total misuse of law , even the legends like asange not spared. India sticks un resolution of child rights , which is 18 ( 16 for married girl) . but nature never lies , urban culture puts such.activity to very early age nowadays., thats why some countries have age of consent as 12. its not childs play anymore. i feel the courts have to accept.consent of even a minor girl if its a healthy relationship. there r couple of instances where courts bailed out cases involving minor married girls.

    Why India isn't following Dubai, Strict law will lead to very less crime. Rare Rape, Rare Crime in Dubai,

    Nawaz,its not that easy..if you propose death for rapist, then the trial must be fair..can you guarantee that?..there are several incidents of consensual sex, which later girl accused as rape!!..i dont agree that in Arab world rape is rare, its definitely happening.. since penalty is harsher for both girl & boy, complaint didnt get lodged & since press freedom also less its not get reported..

    In most of cases , its the consented relationship but boy gets punished because the girl is minor. If one takes unreported cases , major chunk of young population will be jailed ( including juveniles ) , because law says so. its hypocrisy to say., girl waits upto 18 to become intimate with anyone. it starts very early now a days , but goes unnoticed.

    What a perverted mind you have Roshan Braganza. This dalit girl is only a child of 12 years, who may not be knowing what sex is all about and you are talking about consensual sex? Shame on you. People like you always find fault with the women folk. What is the basic reason behind it. Always I have noticed that you pass derogatory remarks against women whether it is warranted or not. I do agree rape accusation has become a weapon to harass unsuspecting males, when they do not consent to the overtures of some females. However, every case is not like that. Most are genuine issues and the police and the concerned authorities thoroughly investigate before a person is convicted. Please spare your vile remarks and see the situation with a humanitarian eye.

    Everyday we are reading/hearing rape rape. 7 years of jail is not sufficient for these rapists. We need to amend our constitution/IPC for death sentence (hang) instead of 3 or 7 or 14 years of jail then only we can reduce rapes. We are practicing the law which was implemented 65 years ago which is not healthy law for the present generation, we need some severe laws to reduce such type of heinous crimes otherwise our democratic country will become r.p.st country.

    Only Rs.8,000 compensation to victim

    Keep them in jail for life and should not allowed to appeal in higher court nor grant bail. Penalty amount must be above RS. 1 million and the entire amount to be given to the victim.

    Here innocent girl will suffer for her entire life and in 10 years she will not recover.

    And with Rs.8,000 she cannot pay her education fee for one academic year.

    The main accused absconding till date! Very surprising that the court proceeded with the case without the main accused. The accused person may be living a normal life with the help of his friends or relatives. The police should go all out to find him.
