Mangalore: 'File rape case, probe role of male kidnapped in Deralakatte incident'

Mangalore, Jan 5: "Following the Deralakatte incident, the police arrested eight accused but the charges against them are not strong enough to put them behind bars; this in turn will help criminals escape from the law,"  said K S Sharma, national member of advocate organisation Akhil Bharatiya Adhivakta Parishad.

Addressing a press meet here on Sunday January 5, he said, "Though the victim alleged in her complaint that the accused molested her and forced her without her consent to engage in a sexual act with her friend, the police have failed to register a rape case under the section 376(D). The lapse of the police officials to register a rape case is clearly visible," he said.

"Though the gravity of the case is so intense, police have failed to register suitable IPC sections like 375(b), 375(C), 376(D) and 201 for criminal conspiracy, destruction of evidence, gang rape etc. In the complaint the victim also clearly mentions 'Dr Hambal (the other person who was kidnapped with her) and the accused spoke between themselves’, but after this incident Dr Hambal was neither investigated nor charges of criminal conspiracy framed against him. Police are clearly ignoring this case. The role of Dr Hambal should be probed in this matter. A person who has been threatened and is in a state of fear would not perform sexual intercourse unless his mind permits," he said.

"The victim was not sent for a medical examination. She is suffering from mental stress and the police should have subjected her to counseling and should have tried other modes to gather information in order to avoid the culprits escape law. The accused come from a criminal background who are involved in various other crimes," he said.

"Sections like 375(b), 375(C), 376(D) and 201 should be invoked against these culprits and they should not escape from law. If  these conditions are not met, Akhil Bharatiya Adhivakta Parishad will take the responsibility to submit this case to the High Court and fight a legal battle against injustice and demand a probe under the supervision of High Court including a special investigation team like CBI to probe into this matter.  A suo moto case can also be registered under IPC 120(b)," he added.

Sudhakar Jolli, Ramkrishna Rai, Ravichandra P M, Jagadish Kaup Male, Captain Brijesh Chowta was present on this occasion.

    Recently in Goa,one of the staff and the head of the Thehelka were on the lift has been charged with rape.I don't why this speculation to the police department to bring under rape this clear case of rape.Hope the culprits will be treated suitably and imprisoned.Thanq.

    Home stay attack was mentioned and seen as rape by many medias as well as many progressive thinkers, but Derlakatte incident is just kidnap according to them, where real rape happend,,,,, again one more proof for double stndrad psedo Seculars.

    I wish these people should have taken similar steps in our Soujanya's rape and murder case as well. Oh sorry, our Soujanya was neither a doctor nor her parents are financially strong. However, her rapist/murderers have a strong political and financial back ground.

    It is so Long this incident happened .still the case is prolonging withopen end.noone is punished.no proper Investigation is done.it is a shame.and torture to the victim mostly a woman.does it mean the Boy knew what will go on?or Police are now good warmed up not to go Forwards?if it was their own People were probably fast Action was taken.
