Udupi, Jan 20: A day after a minor girl and her father were allegedly abused and assaulted by a group of around 40 persons over a land dispute, protestors gathered at DC's office at Manipal on Monday January 20, demanding stringent action against the accused.

A memorandum was submitted to the DC, in which the girl's mother Jacintha D'Souza alleged that Dheeraj Shetty, Vishwanath, Suresh, Sushant, Shiva, Vanaja, Nalini, Subraya, Nithin, Satish, Harish and fifty other people blocked the way to their house by building a stone wall.

"When the road was blocked last November with a similar wall, the deputy commissioner had got the wall removed and had warned the concerned not to venture into such acts in the future, and the tahsildar had asked to take pictures if anybody blocks the road. When the accused started building the wall on Sunday, the girl took their pictures, for which she was assualted," the memorandum stated.

"We complained about it to Shirva police station in writing, but police have taken no action in this regard and nobody has been arrested. We request you to once again visit the place and impart justice to us," the memorandum stated.

Meanwhile, a counter complaint was filed by Shyamala Acharya, the other party involved in the land dispute. In her complaint, she stated that when a compound wall was being built on Sunday, Jacintha and Philip D'Souza opposed their action and verbally abused and insulted them.

Speaking to daijiworld, MP Jayaprakash Hegde said that he has already spoken to the superintendent of police (SP) and instructed the police to arrest the accused.

Denying reports that he had not taken action in the matter, Vinay Kumar Sorake said that after the police failed to register the case, it was he who instructed them to file an FIR against the accused.

Udupi, Jan 20: In a shocking incident reported in Shirva here on Sunday, January 19, a group 30 - 40 people allegedly assaulted a 17-year-old BSc student Asha D'Souza (first name changed) and abused her with filthy language in connection to a land dispute. The girl's father who came to her rescue was also allegedly assaulted and abused by the people.

The girl has identified some of the accused as Dheeraj Shetty, members of Kuthyar panchayat and belonging to Bharatiya Janata Party (BJP), along with Suresh, Sushant, Subya and Vishwanth. Shockingly, a woman identified as Vanaja was also part of this miscreant group, sources said.

The girl alleged that Sushant was recording video while assaulting and abusing her.

Shockingly, the Shirva police have shown utter indifference to the case by not taking the incident seriously. Soon after the complaint was filed, the girl and her father were taken to the government hospital in Shirva, but doctors there only noted down her version, but did not administer any treatment or medicine, it is alleged.

Even 24 hours since the incident, the accused are roaming freely, and even district incharge minister Vinay Kumar Sorake has not responded to the case. Reportedly, the miscreants have close connection with the minister.

In a situation where police, hospital, and the minister have remained mum, a father and daughter belonging to a D'Souza family are suffering due to the corrupt system, said an eyewitness to daijiworld.

Speaking to daijiworld Asha D'Souza said she has been treated badly not only by the miscreants led by Dheeraj Shetty, but even the police who sided with the miscreants and ill treated her and her father.

A massive protest by all communities has been planned in Shirva if police fail to arrest the accused by the end of the day.

    In November 2012 one person our neighborhood made a road with red soil, which leads to his house. Since the road is in touch with our land, he encroached our pathway which was in touch of new road. The pathway was 3 & half feet in width and length was more than 100 feet. My mother opposed his plan, but he did not stop. We are a large family, every now and then they come to our parental house. But nobody took any initiative. When I went to my native place I saw what had happened?. There was lot of pressure from my mother to take action against the encroach-er, I did not discuss the matter with anybody and the neighbors watching the situation. I came back to Mumbai I sent a legal notice in my name to the encroach-er and other depts. One day police vehicle came to the spot inspected the spot, next day parties were called and statement recorded at the Mulky Police Station and the encroach-er admitted he has done the wrong and he will remove the red soil which put on our land after some days he removed 25 percent of the soil and stopped the work. In the mean time Police has sent the report to me and I was satisfied by Police action. But entire encroachment was not removed and after one month I sent a reminder to the encroach-er.As soon as he received it he called me and entire encroachment was removed. When all this things happened, I was in Mumbai and the people in my place do not know till today how the encroachment is removed. I did not explain to them also. For every action there should be logic and wisdom. I have seen in many occasion if there is little friction people have a habit of making more false allegations.

    I am not surprised that shirva police has not registered the complaint, because they never do any work without M vitamin, for example December 26th shankerpura Besp(Pangla) lady has attacked by the person in the night, I called police over the phone, do you know what they asked me? do you know who is that person? Which way he attacked her? Where he has gone after that? Shame to the police department, even now nothing happened about that case, I request home minister to transfer everyone and bring fresh hand to deal with such cases.

    In the picture I can see only a few people and that too old and a few ladies in the police station this is because Most of the young people from shirva are in gulf busy with their job and welfare associations, so who will fight for the rights of the community or poor individuals. We have seen most of the time we call the so called MLA's and in charge ministers for the inauguration and opening ceremonies in church functions and community get togethers. so where is time for them to come during the hour of need? Real estate is money now and in few years south Canara and Udupi will be a concrete jungle. we are a lost generation.

    If there is assault there should be injury in the body which shows contusion and bleeding,then only police can register FIR otherwise if 4 r more people participated in the assault, police can book them for rioting. Every case, police has no right to arrest the accused and more over people does not want court proceedings also.

    As per my knowledge goes:
    If more people assault sure there will be injury, even if beaten in hand other than the place of nose and mouth If beaten to the nose and mouth bleeding will be there sure.
    If beaten in club/dhonne there will be be injury sure.
    If beaten hard in hand only other than the nose and mouth only swelling or die of the hand will be there.
    If not the mobile phone video is sufficient as evidence if mobile video is shot.
    Whatever be the case, the police should register the complaint of a person as FIR. Refusal for FIR means police have soft corner from the ghoose.

    FIR is the first information report which can be recorded or registered by the police officer for the commission of cognizable offense and police have every right to arrest the accused without a warrant which they know. Otherwise arrest warrant requires to arrest the accused. I have made a complaint u/s. 417 of IPC with Mulky Police station, it was sent by post, police did not act on it and met PSI him personally, he assured me and call the opposite party for inquiry and he told me that he will call me before them also which did not do. After some time I received a warning letter from him stating that I was wrong when again went to the police station he was promoted and become CI. But still I can dig up the case but since place of work is here it has become slow.

This is nothing unusual in congress party leaders' behavior, when an election approaches. Their concern for the minority community meant for speeches only.

    District in charge minister Vinay Kumar Sorake has not responded to the case ?????. History repeats!!!!. In the year 1994 similar thing was done by then Minster Vasantha Salian to one of Christian Family in Shirva. For this later he paid the price for that & he defeat in election because one of members of that family!!!!!!!. It looks Sorake also walking footsteps of Salian!!!!!!!
