Karkala, Oct 28: Relating to the dishonour of two cheques issued by Vinod Kumar T R, owner of M/s S M Minerals, and Ramesh V G, to town-based entrepreneur-cum-exporter, Bola Prashant Kamath, the chief civil and junior magistrate first class (JMFC) court here has awarded a decree in favour of litigants for payment of a record sum Rs 1,30,69,777.
The petitioner had alleged that the accused had failed to supply good quality iron ore to Bola Prasdhant Kamat as agreed upon. In the form of compensation for this failure, the accused had issued two cheques, one for Rs 25 lac, and another one for Rs 63,31,067. But both the cheques were dishonoured for want of funds when presented in clearing.
The aggrieved businessman then filed a criminal case in the chief civil and JMFC court. After conducting hearing, the court passed a decree after six years since filing the case. In the first case, the accused were ordered to pay Rs 41,10,000 to the petitioners. In the second instance, the respondents have been asked to pay a sum of Rs 93,79,777. In addition, they have been ordered to pay Rs 10,000 aeach to the government in both the cases, through decrees passed by judge of the court, Poornima.
In these cases, Bola Prashant Kamath was represented by senior advocate and president of Moodbidri Bar Association, K R Pandith, in the court.
