Alape rape case- convict sentenced to life imprisonment

Mangaluru, Nov 18: In one of the most sensational rape case judgments, 6th Additional and Sessions Court (Special Court for Rape Cases) judge H S Pushpanjali Devi sentenced convict Nagesh (25) for rigorous life imprisonment in the rape on a woman aged 69 years in Alape, Padil in Mangaluru.

Apart from the rigorous life imprisonment under IPC section 376 (Rape), the judge also imposed a fine of Rs 5,000. In case the convict fails to pay the fine amount, he shall further undergo simple imprisonment for 2 years.

Under IPC section 448 (Trespass) court also sentenced the convict a simple imprisonment for six months and fine amount of Rs 1,000, In case the convict fails to pay the fine amount, he shall undergo simple imprisonment for 2 months.

Further under IPC section 397 (Robbery or dacoity) court sentenced him rigorous punishment for seven years and fine of Rs 5000 and In case the convict fails to pay the fine amount, he shall further undergo simple imprisonment for 2 years.

Under IPC section 506 (Criminal intimidation) court sentenced him for 1 year simple imprisonment and fine of Rs 1,000, In case the convict fails to pay the fine amount, he shall further undergo simple imprisonment for 6 months.

Court also directed that the fine collected should be given to the victim as compensation.

Public Prosector Shivaprasad Alva was the prosecutor in the case.

Nagesh (25) was convicted on November 14,2014 by Judge H S Pushpanjali Devi at 6th Additional and Sessions Court (Special Court for Rape Cases) for the offences committed on June 14, 2013 in which a woman aged 69 years at Alape Padil in Mangaluru was raped and subjected to misery. The theft had also taken place on the same day.
