Bengaluru: No faith in CID probe, cannot rely on DNA report - Raghaveshwara

Bengaluru, Dec 16: Advocate representing Sri Raghaveshwara Bharathi Swamiji of Ramachandrapura Math told the state high court that they do not have even five percent faith about the possibility of probe into rape allegations levelled against the Swamiji being conducted by criminal investigation department (CID) in an objective manner.

This statement was made by advocate, B V Acharya, representing the Swamiji before the division bench of Chief Justice D H Waghela, and Justice R B Budhihal, on Monday December 15. Placing arguments on behalf of the Swamiji in the appeal filed seeking quashing of the first information report registered against the Swamiji in connection with the above complaint, the advocate also expressed doubt about the veracity of the DNA report.

'Going by the manner in which the probe was conducted, and the stance owned by the agency, we do not have even five percent faith in this investigation. CID did not properly conduct the probe, and the forensic laboratory report does not represent truth. Therefore, we have no reason to rely on the DNA report furnished by the agency,' he stated.

Advocate for the government registered strong objection against these arguments. Intervening in the matter, the bench said that it is for the subordinate court to take a decision on the charge sheet that may be filed by investigation offiers there.

B V Acharya also sought time to file counter objections to the objections filed by complainant, Premalata, and her husband. The bench fixed the next date of hearing to January 6, 2015.

    Details may be counterproductive for many here, but vast section of his followers may agree.
    People can understand as to how the system may be used to as tool to obtain a persons wested interested objectives & observation clearly reveals this. One person cannot be checked for months & months, without cross checking other relevent persons to the incident. Comments here can just express ones views, & it doesn't help in buying time. Judicial matters are seperate, & it searches every corner regarding details pertaining to the allegations.
    Blackmailing case was observed & the process began after the cross examination before Magistrate. If Countercase which was filed after arrest, are given such a importance, tomorrow many may use this as a tool to suppress the opponent. Now, the way & methord of investigation itself raises doubt of its fairness. The fair Trial in months to come may bring clear picture of the incident, & as who stands where.

    I have been observing Mohan's comment for some time. Every time it has been counterproductive without much substance.
    I am pained to see such educated people brainwashed by such Swamis. Guys grow up think objectively. This guy is trying every trick in law to evade and buy time.
    In the beginning me and my family thought it was a case of blackmail. Now we all agree that this so called Swami is guilty and had sex with that lady. It may consensual...but that doesn't matter here.

    Instead of preventing the case prolonging or coming down heavily on the Swami’s well-paid legal team for: on second thoughts, attempting to change (considering the most clinching evidence) the original grave charge of Rape under Sections 375 and 376 of IPC (Rape) into a most convenient charge of mere harassment under section 354 viz., Sexual Harassment, which has a totally different set of far lesser punishment, it is regrettable to see the case go on and on. The latest news is of another adjournment to next year! (Jan 6)
    The accused Godman who apparently did various acts of voyeurism, claiming to be Lord Rama himself, appears to be successfully casting a spell on everyone, even when there are absolutely no more excuses left.

    Do you think the daily arguments, comments in favour of Swamiji will influence the Judiciary system ? The Court considers the material facts, evidences beyond any suspicion, the truthness or realistic part of complaints, circumstantial evidence, observations on cross-examination, etc. & not these sorts of debates or comments passed in media.

    If we are his well-wisher, should we necessarily be from his community ? People criss crossing caste have been respecting him & note that he respects all. Any dislikes doesn't bar from expressing our views. Isn't it ?...

    I wish that real unseen hands be brought to justice, who have used this couple as pawn.

    You will never understand the reality untill you know the Swamiji personally and participate in Mutts daily tradition and strict procedures.
    Mutt has cooperated all the procedure of CID investigation. The harm Premlatha n Co had done with the help of money, media and politics is immense.
    which has done severe damage on our very humble and honest Swamiji. Still he has swallowed all the pain and approaching the problem with a divine patience.
    If somebody else is there in his position they would have either lost the battle in his halfway. Whatever the battle he is doing is not for him. Its for his disciples.
    Its for dignity of Mutt. Its not him, its we the desciples dont want him to do Peetha Tyaga. He had already offered that to us. But we will fight it out the false complaint.
    This pain will be understood only when you become a victim of false complaint of such a huge cunning motive.

    Even before the tests were out, a leading Kannada daily reported that there were 2 males involved on the basis of the DNA test! Some were
    overjoyed on reading the news!Looks like the editor had got some special 'prasad' from somewhere to write this news! 2 Males! Now there is nothing on that paper!Same paper which had gone gaga over injustice done to a lady by some other swami! C'mon is there not a lady involved here too -the editor?What 'prasadam' did you have? Quite unbecoming of some religious heads

    There is no strange in Media taking 'sides'.
    Even before the results of lab tests were out, some TV channels where in full swing chanting the reports of presence of some traces. Looks like these media got some special 'Vitamin' from somewhere to talk about this news ! Injustice done to Swamiji never came up in news, & in the debate, efforts was seen to suppress the speakers in favour of him. What 'Vitamin' did they receive ? quite unbecoming of some unseen hands.
    holding so many devotees & followers to ransom !
    Naturally such people will surely pay for their deeds.

    Religiously he could be the best Swamiji for all his disciples i.e. when religious ceremonies are done or taught. That is the frontal view.
    No dispute on that at all.
    But are the disciples very very sure what is going on behind the scene\behind the curtain? are they 24 hours with the Swamiji to vouch for him? That is my question.
    "Kama" takes over one and all at certain point, when there is an opportunity, at least for once and needs release.....
    I have no comments on this particular Swamiji..

    That's why devotees where insisting for enquiry of all places of events as she has mentioned in her complaint. Definetly it may be tough for them. Why ? Because in some places as mentioned by her, event didn't occur so far, or on the days mentioned by her, & in some places she was never present. In one event in Nanthur, where in 6 Cameras where used, she was not traced even in 1 Camera, & it shows other artists. Meaning, she never came to the event. If clearcut enquriy is not done, this is the result. So naturally now, trust lies only with Court.

    Can someone humbly explain one single reason, as to why are some people and a few in the media calling an absolute crook of a cheat as a Seer or Swami?

    Even before the complaint of multiple-rape, well-fed obese Hero, openly and publicly enjoyed the close proximity, controversial interactions and personal relationships with dozens of carefully ed dancers, singers and film stars, breaking away from every single well-established tradition and sacrosanct rules strictly followed by all the most-respected Seers, Peetadhipathi's and genuine Brahmachari's of the past. One can never visualize shame brought on the helpless Havayaka community, while many united families especially in certain parts of SK have now been broken, ever since this controversy polarised matters amidst passionate sentiments. Some say, irreparable damage has already been done thanks to the misadventure and shocking indiscipline of a nincompoop.

    What’s more, thanks to the 1000 year old Math’s fortune and highly corrupt coterie with direct connections to real estate, money laundering and underworld, despite Nirbhaya & 100 others cases, Hero has all the money-clout to prolong matters in our snail-paced courts.

    The sudden, shocking if-not shameless reverse gear, after the DNA matching news, indicates the absolute liability is now clearly determined and hell-bent on being a sadist too!

    @ R Krishnamurthy,why do you want explanation from others.Ask your own conscious as to whether the allegations on the swamiji are true or false.If you and your fellow accusers of swamiji are so concerned about the traditions of the math, why did you sit mum all these days.Please note that if a small hint of the so called sexual advances were found any time, do you think devotees would have been silent.So far other than the so called victim, none ever had any complaint on the swamiji.It is the force behind this victim who want the swamiji to leave the peetha so that their vested interests can be easily met.All know the character of the people who are against the swamiji.

    The question here is why such apprehension .... now.., is it wrong to presume that till the time DNA report come out there was some hope.
    Being a divine person ..., instead of such apprehension he should have faith in almighty god & bravely face the law of the land and come out clean by reflecting and thus reflect the divine qualities to influence the degenerated people of the society.
    I feel swamiji should not give an impression to his followers to question his divine power.
    Lot of disrepute is already brought to Havyaka brahmin community.
    Above all the loss of Prof Shastri is the pinnacle of all this pain.

    After repeatedly claiming that the ongoing investigations will reveal the 'truth', demonstrate his 'innocence' & pleading with everyone for patience, (while actually not even cooperating & trying everything to derail the investigation, threaten & silence victim, later attempting to change IPC charge of rape to mere sexual harassment..etc), now that everything is black & white and 'multiple-evidences' have finally got the sage to a indisputable closure: The shameless, most crooked Swami suddenly claims that he does not believe in the State or the investigations!

    Not completely surprising since right from the beginning, the Godman (whose escapist actions had already proved his guilt), his corrupt goons & so-called supporters were above the law, dictated and decided on everything!

    Well, there seems to be no end to this expensive joke at the cost the common man, Justice, not to mention the exchequer. The repeated humiliation, absolute mockery & contempt of all laws and investigation is indeed shocking.

    Strangely, while 1000’s of cases are decaying for ages, the division bench would have decided that further excuses, delaying tactics and appeals..etc is simply not maintainable & case closed, so that punishment according to IPC (Rape) can be pronounced.

    # The couple where arrested after detailed examination before Magistrate, & after his instructions. Couple was arrested & cross examined, & once the matter was shifted to IA, no/very low progess in the regard was made.
    # Neither report favour/against has been made on this case so far. Why ?
    # In initial comlaint filed by her daughter, no word of haressement is given & only protection is sought. The word haressement was added later, & even then rape was not mentioned. Only in later stage hectical attempts where made to add word rape.
    # IA started its work, & devotees expressed confidence on it. But....
    # So far around 200 hours he has been in front of IA, of which 50 hours are recorded. But so far no enquiry or interogation of Co-artists, Places of events, etc. Why ?..
    # Many other cases which arouse at same or later, like that Thirthahalli or Karthi Gowda has winded now, but here it looks only one agenda 'to defame swamiji'.
    # Beside his daily appearing before IA, repeated attempts where made to cancel his bail or pressing for 3 tests by IA. The court had clearly mentioned to conduct DNA sampling only, & not to haress him or conduct in such way to humiliate him. Some TV channels also where interested in this episode.
    # Reports of Medical Test began to spread the day before, in the facebook, & how come it was leaked even before it was submitted to Court ?
    # Medical Reports reveal DNA matching. How come the 1 DNA matches with 2 seperate DNA on cloth ?
    # AG represents only major cases, but not in each & every sittings on behalf of the party. Why was he so interested in each sittings in this case ? ( as per some Media reports )
    # Also, no results so far on investigation on death of brother of this couple.

    Anyway, the matter is in two bench division now, & Honourable High Court may clearly look into the matter & every details. Now, all parties may be cross examined to get details of investigation, & truth may come out in few months.

    This is my reply to you . This because you had given a rejoinder to my comment the last time a news concerning the same matter had appeared.
    I had asked why the woman complainant was put in judicial custody for a month?
    Your answer was that it was not the handiwork of the concerned! If it was not, than the all the forgiving(sarva sanga parityaagi) should have seen to it that the one who had sung, performed during his
    programmes should not have been punished/harassed for that matter. She was his / the Mutt devotee and had offered services. When it was happening under his very nose , he preferred to keep mum? He was not in the know of it?

    One more thing. This Mutt near Eden Club at M'lore runs a school.You know this place? This is a very very sacred place once visited
    by the very very revered and a once in an era saint Sridhar Swamiji.Just visit this place once to feel the 'aura'. So many including me have benefited from visiting this place.My only grief is that our holy traditions, the work done by all our great saints,
    sages has been brought down to nothing because of some who really 'do not know what it is all about'.
    Simple as that.
    Who is bothered with 'technicalities'.??
    There are certain 'dos and dont's'
    regarding running very very traditional religious institutions.
    You just follow.
    Do not innovate and succumb! If you do..You repent! That is what is happening.
    You think all this would have happened if everything was 'right'
    and according to tradition?You know of the sanctity of the 'idols', 'linga's' being worshiped at the Mutt..don't you?

    If yes, then you are guilty of telling people like the swami in question, do whatever crime you would love to commit and get away by destroying evidence.

    A crime is a crime, even if no evidence whatsoever could be traced.

    Enough evidence is found to punish swami without any further ceremonies.
