Bengaluru: Medical reimbursement - Advocate seeks governor's permission to sue Ambareesh

Bengaluru, Dec 20: A Shivamogga-based advocate, B Vinod, has written to the state governor and assembly speaker, seeking their permission to file criminal suit against state housing minister, Ambareesh. Through a three-page letter dated December 19, the advocate has sought permission to sue the minister for obtaining reimbursement of treatment as well as travel expenses of himself and his close ones, which is punishable under section 19(1) of Prevention of Corruption Act.

In his letter, the advocate has pointed out that as per section 13 (1), D(1), and 2 of Prevention of Corruption Act 1988, the above act of the minister is tantamount to criminal misconduct. He said that as per this act, a public servant who accepts or facilitates any other to obtain illegal gratification is punishable for criminal misconduct.

This incident reminds one of an incidentinvolving advocates, Sirajuddin Basha and Balaraju, also from Shivamogga, who had written to to the then governor for permission to prosecute the then chief minister, B S Yeddyurappa. The governor had given permission as sought, and Yeddyurappa was even jailed for a few days as a consequence.

The advocate stated above has claimed that Ambareesh, in addition to claiming Rs 1.16 crore as medical expenses at Singapore's Elizabeth Medical Centre, also had got reimbursement of travel expenses of his wife and personal secretary. He has mentioned that Ambareesh was also reimbursed Rs 5.93 lac towards expenses incurred at city-based Vikram Hospital. There is no provision to meet travel expenses of other persons, he noted.

He claimed that as per the provisions in force in the state, medical expenses can be reimbursed only when treatment is obtained within the country. In special cases, where treatment was got in a foreign location, a maximum limit of five lac rupees has been prescribed. Under these circumstances, the government was not in order in footing such a huge bill, he has argued. The advocate also said that the government would have sought to justify its action if Ambareesh was financially weak. He pointed out that Ambareesh is financially sound enough to meet medical expenses incurred at super specialty hospitals.

The petitioner also stated that he had written to the chief minister on July 19 this year, drawing his attention to the above payments, and seeking recovery of these sums from the actor-turned-minister, so that the government would be able to spend this amount for the treatment of poor patients. 'There has been no response. Hence I am compelled to approach the competent authority,' he added.

    The minister who made the grand declaration(When it was rumoured that Rajnikant is footing his bills)
    about his capacity to take care of his expenses is not even
    leaving a penny unclaimed from the government.

    As we all know the Minister's illness,perhaps,is self inflicted.
    The permissive lifestyle took its toll.Why public
    funds are wasted to cover the Minister's excesses.What was
    the Chief Minister's compulsion to categorize the claim as
    'special case'. Is he not rich enough to pay his bills?

    As a legislative member/minister Mr. Ambareesh has not
    covered himself with glory.What is apparent is he has been
    busy all these years enriching himself through questionable
    property deals.During the discussion on Cauvery river issue in the
    Parliament a few years back,while Tamilnadu MPs were
    attacking Karnataka,instead of countering it,Mr.Ambareesh
    submitted his resignation and ran away from Delhi.Even
    while discussion on sugar cane pricing in his home district
    last year the Minister was busy attending weddings and
    parties though he had committed to attend as the guardian
    Minister.

    If his admirers believe that he is their guardian angel
    they can raise donations and foot the medical bill of their
    beloved Minister rather than taxing others to whom his
    utility is zero.

    It is a good and bold move by Adv. Vinod reg Minister Ambarish's Medical Bills being paid by State Govt. My Concern is when in India we have best of Medical Facilities, why should he be going to Singapore, along with full family, personal Doctors & also his PS. This is like a paid holiday to him.
    Govt should stick to rules of limited Medical bill ( rs. 5.00lacs) reimbursement by them & rest amount should be paid by him. Why should Govt Treasury be poorer by 1.16 Crores using Tax Payers' money to pay his bill. These Ministers have loads of ill gotten money to spend on un-wanted things, let them also spend for their own good.
    Adv. Vinod, am sure you will succeed in this case. Wish you good luck & hope minister will be penalized for what he has done.
    Let Govt show us " Justice Prevails and spares no one.!!"

    If a medical bill could be reimbursed from the govt for it's ministers/mlas,Guvs etc,what happened in the past could be reopened for prosecution.Companies in the world foots it's employees medical bill why not such big institution,govt can't do it?beit for internal or external medical bill.Still I don't know what perks MLA/MINISTER gets in their specified period.Some are I did not endorse such huge medical bill transaction.On the lighter note AMBI IS NOT MERELY POLITICIAN BUT (FILM)ICON and adored film personality in Karnataka.

    yes, you are right. but as all know ambareesh though lousy guy in framing political strategy and somewhat uninterested also still commands enornous clout in vokalliga belt of mysore-mandya which has 80 assembly seats there.

    if he thinks someone is ought to finish his political career he will be very dangerous to the person as well as that party.siddhu as well as congress party will be in danger if they try to sideline him.
    bjp is sensing a opening here.
