Udupi: Man tortured by wife seeks changes to IPC Section 498A

Udupi, Jan 7: Santhoshkumar Bhagwana Potdar from Thelasangha village of Belgaum, in a press meet, claimed that he was fighting against the misuse of IPC Section 498A. He said that he was tortured by his first wife.

Speaking to the media persons, he said that most of the dowry harassment case complaints are lodged by women. In some instances, women are making false claims of torture and violence under this law. He wanted the law to be made non-cognizable and bailable.

Potdar has done his post graduation in MSW, MA (Psy), (PGDCA), Ph.D., and is a medical consultant and social activist. Being a victim of domestic violence, he demanded the creation of a national men’s committee for welfare of victims.

Potdar counsels other victims like himself and their families. He said that he would like to re-open old cases of those who were punished by a court of law. According to him, negligence, misbehavior and verbal assault are punishable offences. He said that misuse of the law was not a problem of the law but of the police and judiciary.

Lastly, he wants to make remedies in IPC Section 498A. He is badly frustrated by the attitude of his first wife. So, he is seeking justice against her. He has planned to undertake an ‘Andolan’ from Belgaum to New Delhi by foot. It will be a historical awareness campaign of 2,500 km. There are 40 various social organizations involved in the awareness programme.

Now that he is married for a second time, he said that his present wife supports him in everything. “Sometimes an innocent man can be a victim. Unfortunately, there is no such law that enables a man to lodge a complaint against cruel women. I would to like to submit a copy of my demands to the Prime Minister of India,” concluded Potdar.

    Law must be fair to both sex. Women must be respected and protected, as men. In all DV/498a cases, both husband,wife and their families must undergo LIE TESTs, expert psycho logic, both clinical and counseling, in some cases Psychiatric under Hon.Court's direction. Women/men should be able to approach Hon.Court without interference of Police/Lawyers. There must be separate, cell in the Hon.Courts to receive complaints from women/men. Keep the Police/lawyers away from family issues. Evidence is important, without clear evidence no one should be punished.

    There is very heavy misuse of such gender biased laws, which are blatantly used by conspiracy minded females to harass and extort money from the male and his family!! Even majority (nearly 58%) of reported rape cases are all fake as per a recent survey, most of them are consensual acts or even by seduction (female is the real culprit here) and later when their job is done and the demands are not met blatant rape/molestation cases are filed to extort money!!

    Many respectable men and their families have been put to utter misery and loss of face by such fake complaints of dowry/rape/assault etc!!

    Nowadays, it is dangerous even to talk to a a woman, forget touching her as one never knows when a molestation case is filed!!

    Finally, it is reported by surveys that several filthy rich middle and old aged women regularly abuse teen aged boys for satisfying their carnal favors by giving them costly gifts and other goodies, surprising that not a single such male child abuse, seduction case is reported by the media, WHY!! Interestingly, if am not mistaken, the youngest father in the world is a 12 year old boy who was abused by his mothers friend and she became this youngsters child's mother!!

    It is the right time that we remove our horse blinders and make gender equal laws to protect so many innocent men from immense mental agony and physical trauma initiated by the corrupt, greedy, and dubious people and their families!!

    Even the courts have taken cognizance of these fake reports and there have been recent landmark judgements wherein so many innocent people accused in such fake cases have been acquitted!! Jai Hind

    I am facing 498a and DV from women in Kanpur. It was hardly 6 months of marriage and she had a very weird attitude from the very beginning.

    I am quite sure it is a conspiracy as I have many evidences which I am going to produce in the court.

    Nice work by him .. Not only 498A section but also government's plan to re-introduce Marriage Amendment bill should be scrapped . So guys write email to H'ble law minister at sadanandagowda@yahoo.com for protest against anti male law . This is the time otherwise most of the men will be looted by gold diggers . This law is more dangerous than 498A , DV and any other law . So lets stand together against introduction of anti male and anti family Marriage amendment bill.

    At times this is so very true. The IPC section 498A is misused.

    Some women do harrass their spouse and there is insufficient protection or rather lack of protection for battered Husband's. Its a sad state of affairs.

    Mutual respect is paramount for a successful marriage.

    I hope this 'Andolan', will in some way help to change or bring about a change in the mindset of people, that:
    1) We women only are harassed
    and an effective law is enforced for the protection of men, from false accusations.

    That means some are good and some are getting married for want of MONEY and Luxurious life. Such incident I have seen inn my family also.

    When Boy family told to end the relation for some reason, girl family told not to do so, because girls reputation will be at stake. But after marriage unfortunately it does not lasted long and divorce took place and boy had to pay alimony as per courts order.

MA in Psychology (pardon if I am wrong)…….no use at all!!!!! Mr. Potdar….. I will give you some “Art of Living with our own wife” if you want…… A very important thing is…..

    You listen to your wife very carefully and even if you are not interested in her story at least pretend carefully……

    Never dare to say NO to her for anything…..

    Never try to stop her when she is retaliating in angry mood even for silly and nonsense issue….

    Never try to claim or celebrate the victory in quarrel with your wife…

    And so on…………then you see “Life is Beautiful”……………………..
