Bengaluru: No power to apartment buildings without occupancy certificates

Bengaluru, Jan 12: Beware! Buyers and prospective owners of flats in housing complexes and apartments in Karnataka!

The State Government has decided that housing complexes and apartments will not get electricity connections in the State if developers/owners of houses/residential complexes do not get building plans sanctioned and occupancy certificates (OC) from the authorised government agencies concerned.

The new rule would not be applicable for all housing units having dimension up to 8,000 sq ft build up area and building height of 50 ft.

Karnataka’s Energy Minister D K Shivakumar, who met office-bearers of building contractors association in Bengaluru on Monday, later told reporters that the new rule would be implemented in accordance with a circular issued by the Urban Development Department, which applies to housing structures in the entire State.

He said obtaining a building plan sanction and occupancy certificate (OC) from authorised government agencies was mandatory for providing electricity connections for houses/residential complexes.

In Bengaluru, builders of apartments have to obtain building plan sanction and OC from the Bruhat Bangalore MahanagaraPalike/Bangalore Development Authority for power connections.

The Urban Development Department’s circular has instructed the BBMP and BDA not to issue "No Objection Certificate" (NoC) and OC for structures that have violated any of the building by-laws."

The new circular has been issued in the light of the fact that thousands of apartment blocks and houses have obtained water, sewage and power connection in Bengaluru and other cities without getting their plans sanctioned and without obtaining OC.

"We have been forced to tighten the rules as BWSSB is finding it difficult to provide water and sewage connections to unrestricted constructions," Shivakumar said.

Violators have to bear a penalty in the form of a 25 per cent higher tariff cost on the energy consumed, he said.

    First of all, why do these govt. officials sleep when so huge buildings are constructed illegally in the first place...???!!

    Secondly, they will pass draconian laws that will only make room for getting bribes from builders and developers.

    Builders and Buyers need to unite and fight this corrupt practice of the govt. with full force.

    I lived in bangalore, and i was owning the apartment which was 30% illegal ... which i came to know later. I sold it. There was lot of litigation , even karnataka bank had given loan for the construction and p[pledged the land documents in the bank. Now who will suffer ... innocent owners who bought the flat on loan hoping one day this flat will be their asserts.. bull##hit.. u don't trust bank people.. don't trust government official .. don't trust anyone ..... ALL R CORRUPT.. please invest your hard earned money with proper guidance ....

    This is nothing but new plan to make more money! This way, builder has to BUY OC from govt. So, each builder will pay a min of 10Lakh per building. Count the no of flats coming un in cities.

    Who want to purchase Flats in bangalore or in mangalore all are looking to move to Gujarat...First ask this congress minister's is POWER - electricity available in state or that also they need to buy it from Gujarat.

    No O.C. No power? so flat buyers are penalized for builders fault!
    Did buyers gave any commitment to Govt to adhere rules of Development Controlling authority?
    What is the punitive action on the Builder / Developers, and remedial measures to flat buyers,investors?
    Why Govt is not compelling the builder to exhibit upto date facts on the project at the site itself? How else buyer should refrain from buying or make an investment decision? Is Govt not taking taxes from buyers? Are they also not party it irregularities? There should be compulsions on builder more than buyer!

    Once the building is done and the Compliance is applied by administration is just unprofessional. This will affect a common citizen who invest his hard earned money.

    Instead administration put a legal board in the site before they start as not approved by Government of Karnataka. There should be a certificate on Billboard like Dubai who is contractor, picture of project, All permissions etc. That's the beauty of Dubai.

    Any bookings taken by builder after this will be criminal, because many go on websites and agents and book apartments. Fast court should be set for settlement.

    Never buy a flat without door number, yo cannot apply Ration Card, Voters ID etc.,

    Well said. If any building is not regularized such that even a single document is not in place the govt should seal the plot and stop the construction totally. the builders will simply fleece innocent buyers who will end up with even demolition after paying up their life time savings

    Its funny that apartments can even be sanctioned when all the requirements are not in place, there after a lot of violations take place and no govt official is held responsible even the public have no voice to complain. Even if such a building is being build next door i have no rights to complain on the violations is this social justice. A few babus make money and we live in misery.
