Court dismisses CID petition against Raghaveshwara Swamiji

Bengaluru, Feb 17: A subordinate court here dismissed the petition filed by Criminal Investigation Department (CID) seeking cancellation of anticipatory bail granted to Sri Raghaveshwara Bharathi Swamiji of Ramachandrapur Mutt relating to a rape case filed against him.

In its petition, CID had contended that the Swamiji was not fully cooperating with the investigation and that he was not making himself available for conducting of medical tests. On the basis of this, it had sought cancellation of bail.

When the petition came up for hearing on Monday February 16, advocates for the Swamiji, Arun Shyam and Shambhu Sharma, pointed out that CID had initially said that the Swamiji was not cooperating with investigation. They said that the CID had since changed its stance and now claiming that the Swamiji had not been cooperating in conducting three medical tests.

They stated that the Swamiji had fully cooperated in the investigation, and participated in about 58 hours of investigation and seven hours of medical tests. They also informed the judge that during the hearing of Swamiji's plea seeking cancellation of first information report against him, the additional advocate general had stated before the division bench of the high court that the CID investigation has been concluded and final report would be filed in the court soon. This statement also finds a place in the orders passed by the division bench of the high court, they stated. They argued that there is no meaning in conducting tests once investigation has been completed.

During the hearing in the high court, the judges there had questioned the relevance of the three tests the CID said were needed to be conducted on the Swamiji.

After hearing the arguments, judge of the district and sessions court here, B G Rama, dismissed the petition filed by the CID.

For those to whom 'Truth' is not important & only 'Tarnishing' is important, this developement is really a setback !... When DNA Sampling is already got from Blood, what's the need for 3 more test. Naturally, the hon. court has rejected their plea for cancellation of bail.

    He had protested against Minining Mafia some years back near Kodachadri Hills & started receiving threats. Also, a CD fabrication was done by some wested interested people of NK, & all people involved in the racket where caught just before it got released some years back. A Black-mailing episode for 10 crore was done against Matha targeting him & all black mailers where caught few months back. In all cases, a smell of life threat was felt later, & naturally he is given Security by State....& with these sought of falsified fabrications he definetly may need Security in future.

    You see People through Stones at fruit bearing Mangoe trees & not at ordinary trees. So you may need Security to protect from rogues.

    The DNA Samples received from Blood can be tested anywhere. But so far they haven't followed the rules laid by law. They should have divided it into two equal parts & tested it in seperate Recognised Labs. The questions arises now as, if it dosen't tally, what to do ? Perhaps, for this reason they might have been insisting on 3 more Tests, so that they can copy & paste !... & prove what they want. This is a good judgement & definetly a setback for people with fraud intention !..

    Why people are so obsessed with Swamijis rather than God. Treat this as an any other case and punish him if he is guilty. By the way why he is not cooperating with all tests if he is innocent.
