288 percent rise in teen rape suspects, India mulls new law

New Delhi, April 25 (IANS): Rape is the fastest-growing crime among juveniles; 86 percent of teens arrested for various crimes come from poor families, only six percent were homeless and less than six percent were girls, crime data for the last 10 years reveals.

Arrests of juveniles in the 16-18 age-group increased 60 percent from 2003 to 2013, the highest among all three juvenile age groups, according to data from the National Crime Records Bureau (NCRB), a division of the home ministry.

Juvenile arrests for rape rose 288 percent over this period and arrests for theft increased 68 percent, the data showed.

Contrary to popular belief that juveniles from broken homes commit the most crimes, 81 percent of teens arrested in 2013, lived with their parents, the data revealed.

The figures lend perspective to an unfolding national debate around a cabinet decision to enact a law that proposes trying juveniles as adults.

The demand for such a law arose after a 17-year-old was sentenced to three years in a reform facility after he and five others gang-raped and battered a physiotherapy student in a Delhi bus on December 16, 2012.

The proposed law provides that in the case of heinous crimes committed by adolescents aged 16 to 18, for examination by a Juvenile Justice Board to assess if the suspect should be regarded as a child or an adult.

Children living with parents committed most crimes

As mentioned earlier, juveniles living with parents accounted for more than 80 percent of arrests - 35,244 in 2013, according to the NCRB report.

No more than 2,462, or six percent, of juveniles arrested in 2013 were homeless and 5,800 lived with guardians.

Seventy-seven percent of juveniles arrested in 2013 belonged to poor families with annual incomes up to Rs 50,000.

As many as 8,392 juveniles arrested were illiterate and 13,984 had gone to primary schools.

When juveniles arrested are beyond the law

As many as 379,283 minors were arrested in the period 2003-13 under the Indian Penal Code (IPC) and special and local laws, according to the NCRB.

In 2013, 28,830 kids between the ages of 16 and 18 were arrested under IPC and special and local laws, comprising 66 percent of juvenile arrests in India.

Of 43,506 juveniles arrested in 2013, 1,867 (4.3 percent) were girls. Over 10 years from 2003 to 2013, 357,935 boys and 21,348 girls were arrested.

Madhya Pradesh, Maharashtra lead in teen arrests

From 2003 to 2013, Madhya Pradesh reported 75,037 arrests of juveniles followed by Maharashtra with 72,154 arrests.

In 2013, 43,506 juveniles were arrested. Maharashtra, with 8,012 juvenile arrests, ranked first, followed by Madhya Pradesh (7,365), Tamil Nadu (3,142), Andhra Pradesh (3,133) and Rajasthan (2,882).

The number of juveniles arrested on rape charges rose 288 percent, as we said, from 535 in 2003 to 2,074 in 2013. As many as 10,693 juveniles were arrested on rape charges over 10 years from 2003 to 2013.

Similarly, arrests on the charge of assaulting a woman “with intent to outrage her modesty (section 354 IPC)” and “insult to modesty of women (sec 509 IPC)” rose 117 percent compared to the previous year.

Most juveniles were arrested for theft in 2013: 7,969 of them.

Over to parliament

Parliament will now decide if juveniles can be tried as adults.

One of the major amendments include removal of a clause in the law that relates to the trial of a person above the age of 21 years as an adult for committing serious offences when the person was between the ages of 16 and 18.

The amendment also increases the period of preliminary inquiry by the Juvenile Justice Board in case of heinous offences committed by children aged 16 to 18.

The amendment to the Juvenile Justice (Care and Protection of Children) Bill, 2014, will be introduced in the current session of Parliament.

    @Ashwin suratkal. Coming to your second point. After the enactment of crpc 2013 and amendment of evidence act there were exponential spike in sexual assault cases because girls started to misuse laws to settle scores against their partners. A simple RTI application can reveal staggering 60 percent on average false cases across India

    Also almost all IPC related to violence are not gender neutral so any woman harassing a man is unaccounted for and no legal clause supporting this. Men are silent sufferers and there is no men rights ministry at centre ( even animals has one ). Make laws gender neutral and see the number of female offenders in jail ,as simple as that !

    @Ashwin surathkal. First of all , per marital sex is not new trend , its been there since ages , the difference is just that people are now more vocal about it. Generations change but the pristine qualities remain always adored and cherished. The Chastity , Purity and Virginity matters specially in a girl , no matter how liberated or forward thinking the generations become ( eg :: virginity secret society in US ). I agree media plays a crucial relationships in promoting stray relationships , but it can be regulated too. The cultural or values parents inherit on children do matter here. Parents in certain communities promote early marriages to counter this , on other side this generation too has runaway marriage cases even as young as 14. In both cases courts accepts and refrains from punishing ' child marriages'. India is country where per marital relationship is still a taboo , , so its wise to enact such laws where it can be punished severely.

    @Ashwin surathkal. Even a consensual sex under 18 falls under statutory rape and it carries same amount of punishment. Once this act is passed , Juvenile consensual relationships will be punished severely ( to an extent of life imprisonment ) , but m not sure its going to be gender neutral or not. As pocso is gender neutral , a girl should also be punished severely. The only exception clause being crpc 2013 , which states age of consent as 15 if girl is married , its been kept intact to save cultural early marriages which is positive. This act will significantly decrease pre marital relationships.

Our younger generation have different role models compared to what you/I had when we were small. I am not sure how many people will be truly religious these days where they used to be God fearing. The entertainment you're getting from TV, music, movies (both Bollywood as well as Hollywood) do not make our younger generation better. Look at the leading newspaper websites of India and you will have some idea. No law can stop per-marital consensual sex. we want some laws that stops rapes and not sex. because you simply CANT stop per-marital consensual sex because it is neither done in public nor newspapers get this news. Be practical.

    Nishaan, Mangalore, you're absolutely right. When MMS had that 13 party coalition which including big mouth Mamatha, he manages 10 years reasonably well. BJP cried a lot for everything at that time whether it is nuclear deal or rape laws or land bill or Lokpal. Congress failed to enact few laws due to that majority problem and had to obey to those parties even with 2 MP's. Now BJP is in majority and they looks like waiting for the 5 years term to complete. Modi surely seems to cover each and every country of the world before this 5 year term. Does they already know they don't get second chance??

The topic here is not the age of sex but rape. So, it is you who skipping the real subject and arguing for the sake of argument, not me. As far as the former point, I did not say its legal to have sex before 18, did I? I guess you know how to read and understand English. BTW, you look like an old fellow with no present knowledge of Indian cities. Children as young as 15 have sex. Do you have any statistics (since you're a man of statistics) of virgins under the age of 18 in Indian cities?? There is a difference between consensual sex and rape, even if they both are under 18. When it comes to crime you people want under 18s should be tried as adult (which I completely agree) and when it comes to consensual sex, you have to be 18,.. wow..what a rule!!. People are more smarter than those days you went to school in 1960s. A 16 year old can think more maturely than what you did when you're 16. Even voting rights came from 21 to 18 which was in your time 21 which says old people like you had less thinking capacity as youngsters.

    i was commenting about both rape crimes in west(in most of my comments) as well as south asia and also about the issue of teen pregnancy cases that occur there as there is system of dating before 18 years.

    as that issues was raised, that topic was discussed.thats it

    the bottom line is rape is as serious a social evil in india as in western countries.it is a global evil and not an issue of any country or a region.there should be harsher punishment for those who indulge in this crime.

    recently central govt has modified law to include juveniles who indulge in rapes to be treated as adults and tried in courts which is a good move.

    4 wives or 4 husband debate in this forum reminds me Mahabharat. Draupadi who had 5 husbands had 5 sons (upapandavas)from each and every pandavas. Prativindhya, Sutasoma, Srutakarma, Satanika and Srutasena are sons od Yudhisthira, Bhima, Arjuna, Nakula and Sahadeva respectively. I guess if Draupadi can tell who is who's father, then your may be women would be able to tell it too.. unless Draupadi is divine.

    Indians & other Asian people don't report most of the rapes fearing of family and society backlash, in Muslim majority country,where there is shaharia law, rapes are top high, but go unreported, as one of them will be uted, mostly likely its the girl (victim).when it comes to teenage or pre-marriage pregnancy Indians abort the child, shaharia will give death/stone to death fearing this crimes go un reported. Where as in the West girls give birth and raise the baby, many times as single parent.

Anyway, at least we can call ourselves as 4th developed country in the world and most developed country in Asia even if we go with your statistics.(those people who are divine and blindly talking so much about India are you listening??)     - The way rape is defined in western countries is not the same as India
    - Section 375 that defines rape in Indian Penal Code has been revised since 2013 (post-Nirbhaya gangrape December 2012).
    - The statistics (if reported and if recorded) will surely rise since India has a higher population with a sex ratio that has more males per females

You keep telling that you spend so many years in the western countries and traveled over 50 countries, don't your own brain cells working with all these experience and you still need Google to tell the simple truth that in any densely populated areas like India it is hard to commit crime like murder and gang rape in day light compared to those countries which are way bigger than India but have less than half a population than India.In India everything is happening when people are watching.. in buses, in street. Read those news about cops rape a model, cops molesting Israeli women tourist, cops beating women, cops beating is daughter, girls molested in the crowded bus, gang rape in the moving bus in a city like Delhi (everything is in public) ..etc ..etc.. How often it happens in the west??

    RAPE is happening due to lack of moral values. Government should introduce a special subject called "Learn Moral values" from LKG class like other subjects mathematics, social, science etc. Need to put a restriction that every Indian should pass this exam. Otherwise government should not allow them to utilize any facilities from private to public sector. NGOs , Social Service Organizations, Masjids, Mandirs and Churches should train and inculcate these moral value among the people to be good citizens of India. All types of Medias should play a vital role in cleaning the dirt from the society and promote the moral values.
    Islam has the solution to stop the rape and change the mindset of the people.

    RAPE PREVENTION TIPS:

    1. We need an overhauling of the judicial system and a re-assessment of priorities.
    2. Social Change and Legal Reform. Change the mindset of the people through religious values.
    3. Be clean in Heart, thoughts and intentions.
    4. Fear God, have faith in day of judgment. Fear accountability on the day of judgment.
    5. Respect women as our mothers, sisters and daughters.
    6. The current mentality is that the law cannot touch you at home is to be changed.
    7. Parents / Families of boys and girls must give the right lessons to them and teach them to be gender sensitive.
    8. Females to follow hijab dressing code (i.e. dress code safeguarding the modesty and chastity of women). Gents to lower their gaze, they have to avoid unnecessary seeing or mixing with females.
    9. Stop misusing women in TV advertisements, Cinemas, internet and social medias.
    10. We also need to treat a crime as a crime.
    11. Police should be honest and systematic about tackling crime against women.
    12. Ban the Cigarettes, beedi, drugs and alcohal.

    Men are the one who are given strength by God to protect Women. So we are not suppose to hurt a Women, instead we should take care of their respect and safety always.

    If everyone is allowed to have four wives, older than 7 years, the rape statistic would drastically come down in the entire world. Only those who have moral authority can give lecture of rape cases. The constitutionally protected class are not included in this statistics, otherwise India would be No.1 in this category. What is considered rape in one community is not rape in another community. That is called banana Republic. In the US even touching a women inappropriately will include in the statistics of rape and molestation. Women have more protection and respect in the USA than any other country in the world.

    - Having more wives does not reduce the number of rape
    - The sex ratio of the entire world is 101 males per 100 females. Allowing males to marry more females will create a situation where you will have some men with more wives and many men with no wives which often results in war :)

    - It goes against Christianity (Matthew 19:4-5)
    - People in other religions can try the suggestion (e.g. in the Mahabharata, Draupadi had 5 husbands)

The same NGOs fight for these rights in Western countries too.. (Read HUN human rights) even when the terrorists are manhandled by the authorities (read Guantanamo Bay)which I am against myself.     ..I wrote FORD FOUNDATION like NGOs, not all NGOs..read properly..there are hundreds of NGOs which are created by some developed countries,just target developing nations which they think in future they will pose some threat economically..just google about you will find hundreds of evidence..its reality..USA has worlds most number of nuclear power reactors and they are continuously building but US based FORD FOUNDATION channels crores of fund to protest nuclear plant in INDIA!!..you know why, because these plants are built by RUSSIA..they fund every political parties for this cause..why NGOs like GREENPEACE, FORD FOUNDATION has to fund political parties like AAP..ANNA HAZARE who acts like modern Gandhi also funded by FORD..Do you know why deadly viruses,desease first start from poor african countries? because they are used like guinea pigs by power countries for their medical experience..read cases of syphilis experiment on Africans, which IS recently exposed in US..its not imaginary stories,its reality..

    @SHAKAR, According to your logic (Westernization, deviating from our culture) India should not be even there in the list that Sunil provided because India under the present rule going back to Vediac time. On the other hand each and every European country, including US and Canada and Asian countries like Singapore, South Korea, Japan, Taiwan, HK, including main land China, Australia and New Zealand who are more western than traditional should all the rape capitals of the world. Grow up mate, westernisation does not mean you have to rape and abuse drug.
