Lok Sabha passes black money bill


New Delhi, May 11 (IANS): The Undisclosed Foreign Income and Assets bill, providing for heavy penalties for stashing black money away in foreign accounts, was passed by the Lok Sabha on Monday.

Moving what is called the Black Money Bill for acceptance by the lower house, Finance Minister Arun Jaitley rejected the opposition's demand of referring the bill to the Standing Committee, saying delay in enacting the legislation would provide opportunity to offenders to transfer unaccounted overseas wealth quickly to unknown destinations.

"The Bill (introduced in March) has no connection with domestic black money," Jaitley said replying to the debate on the bill.

"For the first time, unlawful, undisclosed income abroad has been taxed under this law at a tax rate of 30 percent with an additional 30 percent penalty on it," he added.

Explaining that a time-frame will be provided as a "compliance window for declaring and paying penalty", Jaitley said that failure to meet the compliance timeline will attract an additional penalty of 90 percent for a total tax liability of 120 percent on the quantum of black money abroad.

Besides, law provides for rigorous imprisonment of up to 3-10 years for perpetrators, he added.

The finance minister said India was foremost among a large number of countries that were taking interest in the G-20 initiative on automatic transmission of information with regard to monetary transaction.

Admitting that there was no official estimation of black money within India or stashed away abroad, Jaitley told parliament last week that the government was examining the reports of three institutes on the matter.

"Varying estimations of the amount of illicit money moving out of the country have been reported by different persons/institutions. Such estimations are based upon different sets of facts, data, methods and assumptions, leading to varying inferences," he told the Rajya Sabha in a written reply.

"However, there is no official estimation of the amount of black money stashed abroad or black money taken out of country," he added.

The previous United Progressive Alliance government had in March 2011 asked the National Institute of Public Finance and Policy (NIPFP), National Council of Applied Economic Research (NCAER) and National Institute of Financial Management (NIFM) to estimate unaccounted income and wealth inside and outside the country.

An unofficial estimate of illegal money stashed away overseas puts it somewhere between $466 billion and $1.4 trillion.

    Based on opinion expressed by few eminent legal & tax experts (yesterday in CNBC 18), unless the clarification/ explanation emerges this law is draconian in nature.
    Please note that wrong disclosure / concealment & abetment may result in imprisonment (one can avoid imprisonment provided he proved himself as innocent or ignorant, however the cost of proving is another mighty opportunity for corruption & political intimidation)

    Almost all political parties support fight against black money, but b'coz of above apprehension all opposition parties in unison to suggest discussion on the bill in the standing committee of the parliament. But the Million $ ? is - why BJP is in a hurry to pass the bill without discussing it in the standing committee of the parliament.
    Without prejudice ...,
    May be this bill give an opportunity to the ruling govt’s an opportunity to consider as a useful tool of political intimidation & bargain.

    If i am not wrong south korea also has $1.25 trln foreign reserves.its bcoz of unprecendented scamz in last decade india is still lagging behind else it wud have crossed this land mark couple of years before.after modi bcame reserve shot up from 278bln to 345 bln within a year.

    No govt, Congress or BJP has the intention or ability to touch or stop black money within the country. It is so much ingrained in our economy that it is a tumor in the brain of our economy. You remove the tumor, the patient will die.
    If at all any future PM will try to take action, first the politicians have to modernize jails with AC, TV, Phone and internet. Don't know when they might end up there.

    This Bill is only for Black Money in foreign countries, but they have all vanished by now.
    Black money inside India won't be touched as they need donors for election fund (from now they will be contacted to donate without any disclosure of party funds).
    Hawala transactions invented by Gujarathi Business people even before banking started won't be stopped or accounted for, otherwise Adani will be behind bars too.
    Laws in India remain in Books & will be only used against small people(fish).

    Exactly! Hawala business was invented by Gujarathi businessmen in the early 1950s in the gulf. My old uncle, who went as teenager to work as clerk in gulf, used to send whatever money he could save thro' hawala transaction, via gujarathi hindu (not muslim) businessmen... Gujarathis are masters in hoodwinking govt and doing #2 transactions.

    The new Bill, although intended for black money, is named "Undisclosed Foreign Income and Assets bill".

    The name of the bill alone implies that all the income earned by NRIs and assets owned by them need to be disclosed to the Indian Government (tax department). If not disclosed, the income and assets could be considered black!

    Hope the Gulf residents, especially businessmen, must step in early to clear the air, and suggest any amendmends necessary before the Bill is turned into an Act. Otherwise, there might be undue harassment by the officials out to make a few quick bucks based on the confusion created.
