Bengaluru: Love marriage - High court rules in favour of couple, warns parents filing fake cases

Bengaluru, May 21: In a verdict in a case delivered recently relating to a couple who had a love marriage against the wishes of the girl's parents, the state high court has sounded a stern warning to parents who try to subvert the legal machinery by filing fake cases against the persons concerned. It has cautioned the parents that their children who have reached the age of majority have every right to marry persons of their choice belonging to any community or religion, and that the parents cannot use law to meet their ends just because they do not approve of this relationship.

The case relates to Santosh (24) and Zareena Begum (19), both from Dakshina Kannada district. Santosh is a bus conductor by profession, while the girl was a BBM degree course student. Santosh had married the love of his life in the presence of his friends, well-wishers, and family members on November 19, 2014, duly keeping the parents of the girl in the dark.

Feeling frustrated and seething with anger at this development, father of Zareena had filed a complaint of abduction against the youth in Ullal police station. The police had not only registered the first information report, but also filed charge sheet in the third JMFC court in Mangaluru. The youth approached the high court, seeking to quash the FIR registered against him.

Advocate for Santosh, appearing before a high court bench which took up the case, argued that this marriage happened in the presence of many close ones with the total consent of the girl. The advocate, Arun Shyam, also pointed out that the police, in spite of not being able to find any supportive documents or evidence about the abduction, had unnecessarily registered FIR and filed charge sheet. He argued that this action of the police was bad in law. He noted that because the youth and his lover belong to different religions, their freedom is being compromised, and the girl is facing threat to her life.

The high court said that it is clear from the case that the girl had married of her own accord, and that she had not been kidnapped. 'The father of the girl has misused legal provisions to register a false case against the youth. The police, without going into the genuineness of the case, acted mechanically in registering the FIR. Major girls and boys have the liberty to enter into live-in relationships and have physical relationship, and this is not a crime. A girl who is major is free to marry and live with a person of her choice, and no law forbids persons from marrying people belonging to any caste, community, or religion,' it stressed.

The bench ordered the police to make certain that in case of inter-caste marriages without the approval of families, the couple do not face harassment, violence, or threat. The police and legal implementation authorities should take steps if anyone is found to be infringing on the liberty of the couple in such cases, the bench directed.

    Ashok, Australian system is different. Dont compare it with Indian. Its easy to love and hard to live. At certain stage you will realise you need your family/parents. It happens when he or she gets a baby. A girl need that support more than a boy. No law can stop them somewhere they will realize the pain. Its easy to say love and marry. May be parents are villains at that time. In the long run its very hard. The guilty feeling will drive you. When they become old by age they will understand the feelings of the parents. But parents wont be there.

    I do not understand this argument about faith here. Ramesh says why it is difficult for a woman to accept her husbands faith. Lydia says it is hard for inter religious marriages to be successful because of faith again. I live in Australia which is a multi-religious society and my neighbors of last 20 years are: father Catholic, mother Muslim. children went to catholic school but when the they turned 18 one embraced Buddhism and the other became atheist. They are one of the best family I have seen when it comes to love and unity. They support each other and no one ever thought faith stops them loving each other. If we keep faith for ourselves and share love, we still can live. You can celebrate any festival that doesn't mean you have to belong to that religion. In India, for example Keralites irrespective of their faith celebrate ONAM every corner of the world when Onam is basically a Hindu festival.

    Everyone who comments here forgets one thing. No parents would heartily like to have their son or daughter an inter-caste marriage.

    Weather rich or poor, conductor or collector, BBM or Vth std., the parents always have dreams of their loved ones and desire to have the marriage of their kids in usual manners and in compliance with their own religious rituals.

    We are just readers and the real pain the parents of both boy and girl going through due to this mix cocktail is grave and serious. No parents would like their kids bring bad name to their respective family.

    Finally, 99% of the inter-cast and 70% love marriages of same religion go collapsed miserably.

    The mad love remains till the physical union of two for few weeks and or months and then the steam slowly gets evaporated and by then too late to think their mistake.

    Girls who are highly educated than boys or girls from wealthy families are easily lured n trapped by cab drivers, bus drivers-conductors, security guards at home-college-offices, auto drivers, domestic helps, school van drivers-attenders etc. This trend is very common in past one decade or so and specially found in urban-semiurban environment. A slum guy somehow manages to have a high end bike or car which is not his own, and shows-off wit cigarette in hand with some of his chelas around to project this guy in heroic appearance. These guys wait near college gates, bus-stops, dabha paanipoori juice centers where posh gals frequent often. These guys will be in jeans cooling glass wit best of hair style know the trick to make some gals fall for them. A long drive in high cc motor vehicles with some nice monouvres coupled with ice cream dairy milk chocolates would impress such pretty gals. These days teen girls feel something amiss if they don't have a guy for protection n satisfaction. Once girls fall in trap, guys will use all dirty criminal tricks to make life hell for pretty gals.

    Lack of attention from elders at home for gals coming from nuclear families make them find care outside home. If someone shows slight interest in her n do all routine flattening stuff, she will behave according to his wish. She will finally say u r everything to me....so far I was neglected.... I love u more than my parents blah blah....

    Real test of life comes once kids r born n how financial matters taken care off. Guy will slowly loose interest in his love he chased . ...All hell breaks loose

    RELIGION shouldn't play the role of villain in any love story.
    ITS individual choice whom to love,religion has nothing2 do.those fanatics trying to impose their archaic laws on others must take notice here & shut-up from dictating do's/donts to others.
    POLICE must not bow to any groups/sanghs & go strictly by law.
    AT THE same time this verdict should not be taken as free-license to do whatever by love birds.parents have invested huge on you & they do want you to take safe & sound place.so in a youthful exuberance & love fever dont forget those who made you something.be extremely careful while choosing your life partner.

    I said im not against to any love or love marriage, even i support those who are in love. Otherwise they will ruin 4-5 lives. So it is better to go with them and support them. Converting and non converting totally on the individual. Here there is a possibility the boy will change his religion, it is not necessary that girl should change her religion, girl will give birth to children and teach them to follow her religion.

    Well, the girl has chosen her life partner and with her consent went on to marry him. That’s it, let her go and let her live her life and by sacrificing her faith and family for her chosen life partner…, she has built her own heaven in this world. If this decision of hers is a right one or wrong will be felt and realized by her in sometime from now where she will have no way to return back to her lost faith…, but possibly to her family where she may have to live her life in misery!

    We say, religion & faith is man-made! But, we cannot live without religion and faith which is most important in our life. But one thing is for sure that, religion and faith is left to the INDIVIDUAL to decide and at the end of everything the INDIVIDUAL is all by himself/herself responsible for their own deeds and accountable. So why to bother in what he or she is doing and why can’t we let this couple live their life and enjoy for now in whatever they are doing?

    One question to everyone here, anyone of us have read or know anything about these love marriages once they complete one year or so after their marriages? NO…!     Marriage is no joke. All is sweet and lovely until you have a child. After that, in rising responsibilities, you need parents especially for the girl to support emotionally.

    Once married, its difficult to practice one's original faith due to differences in the faith followed by those around her. Apart from this, a child is comfortable following a father's faith because he/she is inheriting father's family name, not mothers. Thus there is gradual drift towards faith of husband which again may invite accusations such as forced conversion.

    Love is blind true but its not blind to problems arising in the aftermath. Young boys and girls, please think of a broader horizon, not just that is around you to succeed in life. Complete your education, secure joy by when you will be able to judge on the basis of your income that gives you a status in the society.

    ..i dont know why there will be difficult for wife to follow husband's faith..particularly in the above cases, girl leaves behind her whole family..and normally families try hard to get back her, later completely abandons her..this is happened with Hindu girls also(as far as i know)..so i dont think for her & kids there will be clash of faiths..but yes, success of these marriages (eloping case) are very low & particularly girls are in the receiving end finally..Hope for the best..frankly speaking, when it comes to Hindu-christians its rather easy matching since more or less faith/ tradition/culturewise there are similarity..in fact my family have two members who followed Christianity earlier..one of my uncle happily married (arranged) christian girl nearly 26 years back and one of my cousin married last December..

    If a Hindu Bahamian marries a lower caste member, the differences are least, so are if a Catholic marries Protestant, Marthomaite. A Sunni Muslim will ignore differences in a spouse from Shia group. However, the differences become barriers when a Hindu marries a Muslim, or Christian and vice-versa.

    The trouble is much intense to children because they become Na Ghar ka Na Ghaat ka. Even if they survive childhood, finding a match for them becomes an herculean task.

    Law and order should be same to everyone. So everyone can love and marry of their choice of person. People (youngsters) should think 100 times before they love and marry. Without completing education / or no job then they marry then it will be failure. Parents also support them till they stand on their feet, should not oppose.
