Centre backs Delhi LG Jung, says not mandatory to consult CM on services


New Delhi, May 22 (PTI): Amid the escalating LG-CM feud, the Centre today backed Delhi Lieutenant Governor Najeeb Jung making it clear that it was not mandatory for him to consult Chief Minister Arvind Kejriwal on matters like appointment of bureaucrats.

In a gazette notification issued today, the Union Home Ministry said that the LG will have jurisdiction over matters connected with services, public order, police and land and he may consult with the Chief Minister whenever he thinks necessary in issues of services using his own "discretion".

It is well established that where there is no legislative power, there is no executive power since executive power is co-extensive within legislative power, it said.

"Public order, police, land and services fall outside purview of legislative assembly of the National Capital Territory of Delhi and consequently the Government of NCT of Delhi will have no executive power" on such matters, accordingly to the notification.

The gazette notification said the LG shall in respect of matter connected with public order, police, land and services exercise the powers and discharge the functions of the central government to the extent delegated to him from time to time by President provided that the LG may in his discretion obtain view of the Chief Minister of Delhi in regard to the matter of "services" wherein he deems it appropriate.

It also said that the Anti-Corruption Branch police station shall not take cognisance of offences against officials, employees and functionaries of these central government services. This will supersede a 1998 notification.

The appointment of senior bureaucrat Shakuntala Gamlin as acting Chief Secretary by LG last week had triggered a full-blown war between the ruling AAP and the Lt Governor, with Kejriwal questioning the LG's authority and accusing him of trying to take over the administration.

Kejriwal had also sought the intervention of Prime Minister Narendra Modi in the matter even as he accused the Centre of using Jung to run Delhi.

The gazette notification said the Union Territory cadre consisting of IAS, IPS service personnel is common to Union Territories of Delhi, Chandigarh, Andaman and Nicobar islands, Lakshadweep, Daman and Diu, Dadra and Nagar Haveli, Puducherry and states of Arunachal Pradesh, Goa and Mizoram which is administered by central government through the Ministry of Home Affairs.

Similarly, DANICS and DANIPS officers are common services calling to the requirement of the Union Territories of Daman and Diu, Dadra and Nagar Haveli, Andaman and Nicobar islands, Lakshadweep and NCT of Delhi which is also administered by the central government through the Ministry of Home Affairs.

"As such it is clear that the NCT of Delhi does not have its own state public services, thus 'services' will fall within this category," the notification said quoting Article 239 and 239AA of the Constitution.

    Now both the national parties have some understanding pushing AAP for failure.

    Now LG has been used by BJP in center as a sweet revenge for defeat while Congress watch it in distance.

Delhi comes under NCT which has not attained 100% statehood, There will be always scope for tussle between LG and Chief minister if the opposite parties ruling Delhi and centre , Earlier occasion both Delhi and centre was ruled by congress led UPA govt so such issues didnot come to fore

    If Kujli is a good administrator, he should find ways work with his opponents. He should keep his ego aside and try to convince LG and fulfill his demands. If LG follows the text book of Constitution nothing can be done. LG has a team of legal advisory. kujli should not try to challenge him. What ever may be the issue LG is higher in his rank than CM. Kujli should try work with him rather than to oppose him.''

    Centre government, we don't need your own article stipulating that particular article. Show us where in Indian constitution that particular article giving provision to appoint bureaucrats as deemed suitable to LG. Another thing, if you were following Indian constitution so closely why LG have to appoint Gamlin as replacement whereby no one from that post has gone on leave as per your administration has made up this story. So why this drama and back door politics if you were so confidant that you are going by Indian constitution ???.

So ultimately it goes down to saying that "Transfer/Posting in Delhi is a million dollar business" and AK has crushed this which congress and BJP find it difficult to digest. Take my words seriously BJP leaders that AK is not going to sit quietly he has absolute mandate and he is going to make this notification null and void and also your life miserable including modi for next 5 years.     Last time A.K was ruling Delhi, both BJP and Congress were out to dethrone him. When he resigned for inadequate MLA numbers and non co-operation by Congress and BJP, BJP'ans were shouting from roop top, that A.K. has no guts, not capable, therefore didn't rule.
    Now when he is having clear majority and ruling, centre and LG Jung, unduly interfering, insulting the mandate of people.

    (1) As from the date of commencement of the Constitution
    (Sixty-ninth Amendment) Act, 1991, the Union territory of Delhi
    shall be called the National Capital Territory of Delhi (hereafter in
    this Part referred to as the National Capital Territory) and the
    administrator thereof appointed under article 239 shall be
    designated as the Lieutenant Governor.

    Chief Minister at the head to aid and advise
    the Lieutenant Governor in the exercise of his functions.

    The constitution and the rules are not formulated by BJP. In 1991 who was in power at centre?
