Kundapur: Govt employee held for cheating woman with false promise of marriage

Kundapur, Jun 7: The police on Sunday June 7 arrested a government employee for allegedly taking advantage of a woman by making false promises of marriage.

The accused, identified as Rakesh of Kundapur, was arrested based on a complaint filed by Veena (name changed) of Kumta in Amasebail police station.

In the complaint, Veena alleged that Rakesh had promised to marry her and developed physical relationship with her, but then ditched her.

As a government employee, Rakesh is based in Kumta and in course of time came to know Veena. Their friendship developed into a love affair and after assuring to marry her, Rakesh had physical relationship with her. However, he later went back on his promise, stated the complaint filed by Veena.

Based on the woman's complaint, the police arrested Rakesh and booked him under sections 376 and 417 of IPC. He was produced in court after medical examination.

Meanwhile, the families of Veena and Rakesh intervened and tried to get them married and settle the matter. Both were called to the circle inspector's office on Sunday, but eventually, the efforts failed.

    Developing physical relationship before marriage even-though not encouraged by religion and society, has been practiced in various forms from time immemorial. as they say prostitution is the oldest profession. but it takes two to tango. if the girl agreed to the physical relationship then she cannot blame the boy later. she is equally responsible. this age of fast communication, internet age and social network it is highly likely that impressionable minds fall prey to physical pleasure before marriage, there is enough material available on television, internet etc to make having physical relationship glamorous, but we should also not forget that it is a human need. it is but natural for 2 human beings to be attracted to each other, this is not only about opposite sex but true in case of gay and lesbian relationships too. the more you try to police these things the more are the chances of it happening. the mindset has to be changed by providing proper sex education and counselling to impressionable minds starting from school, when the kids attain puberty and natural curiosity to explore their own bodies and that of the opposite sex (these days same sex too). overall there needs to be a change in the way we address these issues at home, school, societal levels, we have to progress as society and not go back to the dark ages!

    Why do men never file a complaint when the girl has all the fun and moves on to find better guys? I've personally experienced this and i know a lot of people who have experienced this as well.

    I hope the man is not held guilty because this should not have been a police case at all. She trusted him and she's at fault.

    There has to be an end to this injustice towards men. Women want equality? Make equal laws for both of them instead of making gender biased laws!

    Why ro develop physical relationship prior to marriage. MEN Usually ditch the girls after developing physical relationships. They always try to taste a new thing. If men force on you then get pregnant so that these people can be taught a very good lesson in the court of law.

    This was an act of mutual consent. 2 adults got into a relationship willingly, developed physical intimacy, the girl may have assumed she will marry him, as it turns out the boy may have changed his mind due to any reason, he is allowed to do so, just as many girls do. this case should be treated in an unbiased way if the boy is guilty the girl is also equally guilty. either you let them off with counselling or you jail both of them, whatever you do use the same yardstick, there is a serious problem in our judicial system that girls are taking advantage of be it in false rape or false dowry cases. this law is never used by the ones it is designed for, but by the urban educated girls with malafide intentions.

    You seem to be waging a 'lone' battle
    for the 'males'. here laws are very strange. In case of accidents also see..case is always put against 'big vehicle'!So whose is 'big' he faces trouble. same case in these sex matters and all. They seem to think 'male' always have the upper hand...Might not be the case at all...but the general belief is that male has it and we go along with that. Times have changed ...isn't it Rohan??

    Both are equally responsible in the love & sex game. What made her think that sharing physical relation would increase their love relation? Veena should have given some time listen to her inner voice before taking an extreme step of yielding to physical compulsion. In most of such incidence girls wake up when it is too late. Did she take approval of her parents or elders before starting the relationship with the boy? Ultimately game turns into forced rape. What is the best solution now ? Tying wedding knot.

    Why the laws are so biased !? , if a girl ditches the boy , she can arrested under false promise of marriage !? . Yet to come across a single case like that. May b a boyz life is too cheap in front of Indian laws. @shankar , even in the case of minor girls lots of mis use is happening . Minor girls elope consensually , later trap boy under Pocso charges. On the flip side Adult women who elope with minor boy are not even prosecuted under law. Eg :: A 40 year old woman got had a affair with a minor boy , later they got married. A lady teacher eloped with 8 standard student and then got married. you can google for more information.....

    When Veena complained about the man's evading from his promise for marrying her, she got him arrested. On what charges ? RAPE. Well, there are several men whom their lady partner left for a better one. What charges will be filed if all those men complain ?

    Women like Veena must understand that sex is an ultimate joy one in a relationship which you need to experience after a marriage takes place, not upon verbal promise of it. Veena is fooled, not raped. I am not sympathizing with you, I say, you deserve it !

    As for Rakesh, why is he covering his face in all the pictures ? Fear of being defamed ? What fame have you earned after all ? Men like Rakesh, please be warned - you deserve to be booked (though not as fiercely as rape,) because its your duty too to refrain from extreme relationship which can still be enjoyed after you fulfill your promise of marriage - not go on nibbling until you are finally trapped and are in no position to get out of it. You are exposed to some extent, I hope you have learned a lesson.

Is it the binding agreement that a person has to marry a women if he had relationship with her?     Secondly, please analyze the two parallels I have pointed out, i.e. one who is dragged out, gagged and raped and the other with the woman in this news, in order to decide whether this case is rape or otherwise.

    The physical relationship was on mutual consent. Hence it is not rape, unless the girl is minor. So 376 is not applicable.

    As per the Supreme Court directives, I don't believe it is right for the police to arrest this man.

    An adult gets into a relationship - physical, emotional, spiritual, whatever - fully knowing that it is not a contract. A promise made by one party to another is not necessarily a legal contract.

    The fact that one party feels cheated is not sufficient to hold the other party guilty. It is quite possible that that the party that feels cheated has misconstrued his/her expectations as legally binding contract.

    So I request the police to release the man. Based on the contents of the article, he has broken no law.

    At a social angle, it is possible that he wanted to get married. But, just like many married people find incompatibility, it is possible for unmarried people to find incompatibility too. So, an unmarried pair is within their right to go separate ways when at least one of them relaises that he/she won't be comfortable continuing with the relationship.

    Arresting such a person is against the provisions of the law.

    The man has been booked under sections 376 and 417 of IPC.

    The section 376 is for rape. It is clear that no rape has taken place. The Supreme Court has made amply clear that consensual sex cannot be termed as rape. Even common sense would suggest that.

    The section 417 is for cheating. Cheating is defined in IPC is only when some property is concerned. Reneging from a promise of some sort is not cheating.

    So, the police have got no case whatsoever. The man should get hold of proper lawyer.

    I hope the women is also equally responsible as she is not a kid. If she believed what he said and gave herself to him then its not because of promise but to enjoy. She too should have control over herself when everyday we hear such cases and SC has ruled that cases of sex with mutual consent should be dealt with care if both are adults and know the consequences.

    whether this marriage will be everlasting is a question.In the first place the fellow had started physical relationship without making any signs of get marry.second cheated her.That Shows he didn't have the Intention of getting married.only a time pass.The Girl also did wrong without making sure of marriage Intention .Hope they will stay together.

    Any girl / woman should refuse the physical relationship before marriage. Ask the man whats so urgent, get married first and then physical relationship. Do not believe in trust, promises etc.

    Yes definitely he cheated her and can be booked under section 417/420 for cheating.
    But why 376? Why Rape? Why is everything in India being considered as Rape?
    Dint she give contention to the physical relation, then how is it Rape?
    Rape is just being used as a casual word in India.
    I admit that rapes happen alot in India but at least 30% are falsely termed as "rape".
