Karnataka govt moves SC against Jayalalithaa's acquittal


New Delhi, Jun 23 (IANS): The Karnataka government on Tuesday moved the Supreme Court challenging the state high court's verdict acquitting Tamil Nadu Chief Minister J. Jayalalithaa, her aide Sasikala Natrajan and two others in a case of disproportionate assets.

The Karnataka government has urged the apex court to stay the operation of the May 11 verdict.

"Pass an ex-parte ad-interim order of stay, staying the operation of impugned final judgment and order of May 11," a petition by the Karnataka government said in its prayer for interim relief.

The Karnataka government contended that the high court committed a "grave mistake" in arriving at a figure of Rs.24,17,31,274 while a total of 10 loans taken by Jayalalithaa and others and the companies they were associated with was Rs.10,67,31,274.

It is because of this "grave mistake" in the calculation that the high court erroneously concluded that the disproportionate assets were only to the extent of 8.12 percent of the income whereas it was 76.7 percent.

Contending that the reversal by the high court of the trial court verdict convicting Jayalalithaa had resulted in "miscarriage of justice", the Karnataka government said that apart from other infirmities, the "grave mistake" had led to the acquittal of Jayalalithaa and others including V.N. Sudhakaran and J. Elavarasi.

The Karnataka government has questioned whether Jayalalithaa's appeal against the trial court order convicting her and others was maintainable without making Karnataka a respondent.

The state has contended that because Jayalalithaa and the others did not make the Karnataka government a party to the case, it could not appoint a public prosecutor to pursue it.

The trial court in Bengaluru on Sep 27 convicted Jayalalithaa of possessing assets disproportionate to her known sources of income and awarded four jail terms and fined her Rs.100 crore.

The case dates to the period from 1991 to 1996 when Jayalalithaa was the chief minister of Tamil Nadu.

    I think it is not a good move from Karnataka government as I will create problems for kannadigas in Tamilnadu or those travelling from Karnataka to Tamilnadu if Jayalalitha gets sentenced again.Any case subramanium swamy or the DMK would have appealed in the supreme court.It would have been better to let them do that and wash the hands rather than putting head in to these

    It was Subramaniyan Swami who had filed a criminal case of disproportionate assets, against Jayalalitha in 1996. At last she was acquitted by the Karnataka HC on 11-5-2015. After the acquittal Subramaniyan Swami announced that he would appeal to SC against the verdict of HC. My question is
    Where is he now? Why has he shut his mouth now? Is BJP protecting a third lady (after Swaraj and Raje)? any answers???

    It looks the Judiciary and the CBI are inside the cage of Chaaiwaala P.M.,

    Two cases are still reeling.

    One is Jayalalitha case.
    Second one is Salman Khan's hit and run case.

    I think in these two cases the judiciary is failed.

    Anyway Karnataka has done a good job to move to Supreme Court.

    Here is a Maharani of the 21st century who is by throwing bread crumbs at her subjects has gained their trust. Now and then she offers some freebies to innocent people in TN and they think she is their Amma. This amma can remain in power only by appeasing the poor people. This is the sad state of affairs in India. All these politicians have exploited the masses(most of them uneducated) by promising the moon during elections and then ditching them. This trend will go on until all people are educated and are able to think for themselves.
    Each and every politician in india have amassed wealth in crores with the expense of common people. I am surprised that our Finance Minister is batting for guys like Dushyant singh(son of Vasundhara). They all are in same boat. Jaitley himself has earned in crores and still does in BCCI and in Delhi Cricket Board. They know well that if they don't support each other, all will be exposed.

    Only congress has the guts to fight against corruption. Be it be 2G, CWG, Coal gate, the cases were registered even against ministers and there were people gone to jail. Today under Modi many are on bails and cases not progressing at all. All big talk against corruption is just slogan.
    End of the day BJP delivers, what they delivered in bofors case, 'CASE CLOSED'. Such a shame.

    Raj/Udupi - it may take another 36years. Here is rebuttal for all pro-bjp voices.
    1) Jaya was provenly corrupt for both BJP and Congress, today BJP is siding with her and Congress is fighting her acquittal. That proves the point, who is in favor of corruption and who is not.
    2) Chota Modi and Dawood Ibrahim, both have one thing in common - both are absconders. If BJP leaders meet such absconders, enjoy 5star hospitality of theirs, what can be more worse than that?
    3) Dushyant Singh - Vadra, politician Dushyant singh buys junk Rs.10/- share for 96,000 per share from Chota Modi. This is simple commercial transaction as per Jaitley. Businessmen, Vadra buys farm land from farmers and sells it to DLF for profit. That is corruption, for BJP. Okay, but being in power both in centre and state, till now BJP is yet to register any case against Vadra.

    So, all this proves beyond doubt, BJP speaks something and does something. Exactly like Bangaru Laxman getting caught red handed accepting bribe, still walked away without any criminal cases against him.

    That is why, I say it could take 36years more, unless you grow up faster.
