Mangaluru, Jul 31: Following protest by lawyers for his alleged assault on a collegue here on Friday July 31, Kadri police inspector T D Nagaraj has been suspended.

Police commissioner S Murugan has issued the order for his suspension, sources said.

Also, Mangaluru bar association president Chengappa informed that a case under non-bailable charges has been registered against T D Nagaraj in Urwa police station. At first, the police had said that a case would be filed on Saturday August 1, but the lawyers refused to delay the procedure and the case was filed by late evening.

It was alleged that Nagaraj had detained and assaulted lawyer Uttam Rai after the latter refused to let the inspector speak to his client alone in Kadri police station. Soon after the incident occured, lawyers gathered at Kadri police station and demanded Nagaraj's suspension.

However, the protesting lawyers were not satisfied with the suspension and demanded Nagaraj's arrest.

Chengappa also warned that any lawyer who comes forward to represent T D Nagaraj would be removed from the bar association.

Chairman of Karnataka State Bar Council P P Hegde who arrived at the spot said, "Inspector Nagaraj has behaved like an animal and he cannot be forgiven. Uttam Rai is not a criminal and putting him inside a cell and beating him up was not correct. He should be punished."

Mangaluru: Protest at Kadri police station as cop allegedly assaults lawyer

Daijiworld Media Network - Mangaluru (MD)

Mangaluru, Jul 31: Chaos prevailed at the premises of Kadri police station here on Friday July 31 after lawyers held a flash protest alleging that a cop had assaulted their colleague.

It is said that advocate Uttam Rai had gone to the Kadri police station along with his client regarding some case. Inspector T D Nagaraj reportedly said he would speak to the client alone, to which the lawyer objected.

The lawyers alleged that inspector Nagaraj used abusive languaged to send Rai out of the police station and assaulted him.

On the other hand, the police alleged that it was Rai who hit the inspector first.

As soon as the incident took place, lawyers gathered at the police station and demanded action against the inspector.

Speaking to daijiworld, inspector Nagaraj said that the police had received a letter in which some allegations were made against Bhuvi Enterprises. To investigate, inspector Nagaraj called Ratnakar of Bhuvi Enterprises to the police station on Friday. Nagaraj further said that he did not know that Uttam Rai who accompanied Ratnakar was a lawyer. "When I questioned them, I came to know Uttam Rai was the lawyer. I told him to stand out while I talk to Ratnakar, but he refused. As it was lunch time I asked Ratnakar to come back at 5 pm, to which his lawyer objected and insisted that the investigation should be done right away," he said.

It is learnt that when the inspector was walking out of his chamber, Uttam Rai blocked his way by raising his arm and waving, and inadvertently hit the inspector. The cop grew angry at this and detained the lawyer, it is said.

Even as the lawyers protested outside the police station demanding Nagaraj's suspension, president of Mangaluru bar association Chengappa arrived and held talks with ACP Thilakchandra and other police officials.

Dinakar Shetty, a member of Mangaluru bar association said, "This is a bad news for lawyers. The lawyer had come to the police station along with his client to do his duty. Inspector Nagaraj's action is shameful. Police should have patience. Uttam Rai was put inside a cell in the police station and three policemen beat him up. He is badly injured.

"Our lawyer went to the police station in order to provide justice. Uttam Rai is a nice person. He is a civil lawyer. The police have beaten him up as if he were a criminal," he added.

The lawyers took Uttam Rai to hospital, it is learnt. The protesting lawyers along with Chengappa demanded that police commissioner S Murugan visit the spot.

Demanding immediate suspension of inspector Nagaraj, Chengappa said that lawyers would hold a protest in the city on Saturday August 1 and that matter has already been informed to higher authorities in Bengaluru. "The inspector should be suspended immediately, arrested and produced in court. Till then we will continue to protest," he added.

DCP (law and order) Shantaraju who arrived at the spot tried to calm down the protestors and assured that he would talk to the police commissioner about the suspension of Nagaraj and three other cops who allegedly beat up the lawyer.

The lawyers may file a case in Urwa police station, sources said.

Police in DK are also using foul mouth. They dont care, having said that i dont think its appropriate to suspend the Inspector due to lawyers protest with out an internal inquiry. If lawyers are following clients to the police station for questioning ,are they doing only for wealthy clients or clients from all walks of life? Lawyers are not above law!

Police personnel in the department should be respected. The system of calling the lower level constables as POLICE PEDEs should be stopped. Emoluments of police personnel to be increased 2 - 3 fold and all should be designated as police officers with more responsibility and accountability. There should not be any scope for stretching hand for considerations. When this is achieved justice will prevail as in the western countries. Till then goods raj will prevail and the GOD too may find it difficult to save the have-nots.

When intl.terrorist Yakum memon had legal aid/lawers employed 24X7 why not SI Nagaraj be assisted with legal advise?Nagaraj is not a terrorist or antinational. Mangalore lawyers boycoting him to assist is against the basic principles of legality. Nagaraj has all right to defend himself.....Police commisioner should act on this point.

Kindly don't abuse lawyers without knowing facts.. Every lawyer has legal right to b present in the station at d time of questioning.. Don speak without knowing background of nagaraj.. He has bad history.. Lawyers did not protest against police.. But protest was against nagaraj n to take action against.. There r many honest n Gud police officers.. So also there r several Gud advocates.. Don blame community.. Many comments r very sadening..

Appreciate the way protest held and the action initiated by Head of Police. Cops have no authority to touch a person or abuse a person. They should learn to behave. The cops on duty should not use abusive and slang language and should not have ego. The Cops have to be friendly in nature and do the duty as per law of the land. The advocate looks very much disturbed by the treatment underwent in police station. Cops must learn to give respect first and then start enquiry. They are also Govt Servants and their bread comes from the tax paid by common man.

The problem is, after dealing with hardcore criminals, cheats, scoundrels, murderers, etc. these policemen are conditioned to use third degree methods to get out the truth from them hence it is very difficult for them to control their 'conditioned' behavior in general!!

And if policemen behave with all the way you have described the criminals will sit on their heads!! Jai Hind!!

I Feel first of all Lawyer is wrong here. When a Police want to speak the client why lawyer has to be there presence. Someone already said, Need not tell anything without lawyer. If this is our law then that itself shows, how crook our law is...

What's wrong in talking with (client whoever he is) directly and privately, inside the police station. At least Police will get some truth.

Further, Most of the people fear to go police station, because of their own attitude. Here also a Client has come noon to talk and Inspector is telling him to come back at 5 PM. Do they think, others don't have any other Job? and due to this only many lawyers are involving in police stations too.

    Regards,
    Oliver

CCTV inside the police station will serve as the evidence. If this is missing , then either the police have tampered the evidence or are reluctant to install one .

Without the evidence - I do not think it is fair to accuse the lawyers of any wrong doing. It is plausible that police are misleading the public with untrue version( blaming he lawyer). Therefore the pressure is on the police to prove that indeed they are in the right.

Police are known to behave high highhandedly. It is difficult to believe that the lawyer behaved unprofessionally. Unless there is evidence for this.

Look at the comments here. Barring one or two, almost everyone is against the lawyers. I am so glad and happy about it. This shows how corrupt these robbers in robes are. These lawyers are the last seat of honesty, they lie, twist and fabricate things according to their convenience.

Inspector Nagaraj was just doing his duty. An inspector has the right to question a person who has been under the radar of a particular crime/mischief. How I wish if we all could stage a protest against these lawyers and support Inspector Nagaraj in getting his job back. Perhaps, this would be small token of acknowledgment for our guardians, the police.

These lawyers have broken the law. Imagine if there was a law & order problem & the cops had to move out in their jeep, they would have been prevented in performing their duties. This is wholly unacceptable & a case must be booked against all those lawyers who prevented the police to do their job. The lawyers can get a FIR filed, instead of resorting to this un-parliamentary behaviour.

Disgusting.Everyday there is a protest. Here mistake was from both sides.Ratnaker when he came to Police,he/or lawyer had to introduce themselves before Hearing.Police also are at present in bad light. They too are not thinking twice before raise Hands .and both are not supposed to do so.As lawyer what right he has to hit Police if at all?Now they fight like cocks to Show who is better.and they Forget why they are come to Police.Important Thing is forgotten and can wait till their protest Ends .Really who is Govt.servants and who has to help citizens?Do they not have some cameras installed in Police Station?better do immediately when not.Lawyer must have feared the truth will be out when he talked to Police alone, wanted to extract some lac or thousands from Client.

Because of corrupt lawyers many middle income group people have suffered a lot.

If 100 cases registered against rape, murder, robbery, goondaism, 80 people come out and clear their case with out any punishment and now roaming in the city and continuing their business due to corrupt lawyers.

There are some good lawyers, who help poor people with out taking much money and fight for their right.

Inspector Nagaraj may right.Police stn is not court to entertain lawyer on behalf of accused or any other issue.Another thing is that here the issue is blown up beyond as the lawyers think that they are above all like media persons.Media and lawyers have similar attitudes.i.e., above all....another group with similar attitude is politicians.Peple should keep these trio alway at distance.i.e, police, politician and paperwala!(P3s)
Good advocates, police, paperwals are very few amongst us today.
