Mangaluru: Assault on lawyer - Police given three days to arrest inspector Nagaraj

Mangaluru, Aug 1: A day after Kadri police inspector T D Nagaraj was suspended following intense pressure from lawyers for allegedly assaulting their colleague in the police station, Mangaluru bar association president Chengappa on Saturday August 1 addressed a press meet at the court and demanded Nagaraj's arrest within three days.

Advocate Uttam Rai was allegedly assaulted by inspector Nagaraj when he gone to the Kadri police station with his client. Following the incident, lawyers staged a strong protest outside the police station until Nagaraj was suspended and also demanded his arrest.

"When Uttam Rai had gone to the police station with his client Sandeep Shetty (along with Ratnakar of Bhuvi Enterprises), inspector T D Nagaraj insulted him with abusive words and snatched a gold chain worth Rs 5,000 which he was wearing, cash and mobile phone and hit him on his chest, temple and stomach and also kicked him. He also threatened to open a rowdy sheet against Rai and get him debarred from the bar council," Chengappa alleged.

"Inspector Nagaraj also pushed Rai inside the lockup and not only assaulted him, but also insulted the entire lawyer community. The Mangaluru bar association members who came to the police station to discuss the issue were also ill-treated. They then held a protest outside the Kadri police station," he added.

"The higher police officials, realizing the seriousness of the issue and bowing to the demand of the lawyers, suspended T D Nagaraj immediately. Also, a non-bailable case was registered against him in Urwa police station under IPC sections 323, 341, 504, 506, 384, 386, 394, 511 and 34. We have also been assured that the accused police inspector and other police personnel involved in the case would be arrested," he said.

The FIR filed in Urwa police station also alleges that inspector Nagaraj had demanded Rs 10,000 from Uttam Rai's client, but the latter told him that his client was poor and unable to pay the sum.

Chengappa also added that the lawyer Uttam Rai has been admitted to a private hospital in the city.

He further said that T D Nagaraj has got himself admitted to a hospital and filed a counter case against Uttam Rai under IPC section 353 for obstructing official duty. "The police had assured that no counter case would be registered but they have gone back on their word. This is a false case and the bar association strongly condemns it," he added.

"This incident should not have happened. We have our own way of working. We are permitted to assist our clients to police stations. It is not a crime. Ordinary people feel scared to go to police station and that is why they ask lawyer's assistance," he said.

"There were many meettings with the DCP and the ACP to settle the matter but we did not compromise. We protested mainly to create awareness in society. All are equal before the law. We will not allow inspector to Nagaraj to be let scot free. We have given the police three days' time to arrest him, and if they do not do so, the entire State Bar Council will hold a massive protest," he warned.

"We thank DCP Shantaraju and ACP Thilakchandra for their pateince and good work. We hold awareness camps on law for people, and in future will do it for the police department also so that such incidents do not occur again. CCTVs should be installed in every police station to stop corruption in the police department," he added.

Mangaluru bar association vice-president Yashodhara Karkera, general secretary Raghavendra H V, treasurer Yatheesh and others were present.

    For police inspector, it may be quite routine to assault. But for Mr Utham Rai, it is a life long bitter memory of being assaulted.

    that itself shows the feelings of general public towards advocates.

    how many times we see advocates driving in wrong side,without helmets/ three people in two wheelers.... thats too wearing karikotu....

    we are seeing the advocates in electronic media... from jethmalani to unknown....we are seeing arguments of famous advocates in tv.....

    there were advocates who wanted to support for nirbhaya delhi rape case culprits... for kasab...for veerappan...


    dear lawyers, you are not above law.

    fr healthy nation, stop alleging police....theu work harder than you... at odd hours....

    PLEASE CHECK THE INCIDENCE OF BP/SUGAR/CHOLESTEROL/KIDNEY/LIVER/HEART / VARICOSE VEINS OF POLICE... poor people, they sacrifice their life to maintain law & order of the nation...


    ok..... what about the lawyers who argue supporting criminals..

    WHERE IS THE ADVOCATE OF RASHEED MALBARI, WHO IS ABSCONDING NOW AS PER MEDIA REPORTS... can the same advocate who secured bail for rasheed malbari should be posted in police department to catch him again... then only these advocates will understand the pain of police....

    forget the bad incidence... let us all work with unity, without caste/region/gender bias for a healthy nation.

    let inspector Nagaraj & the Mr.Advocate compromise & let us go ahead with good work.

    Even the accused has the right to defend himself. Knowingly or unknowingly attitude of the inspector is wrong towards visitor may be th visito is the lawyer or common man. whatever the inspectors sincerity rude behavior of the inspector condemable. Same time we have many instances in our society where the lawyers are rowdy back rounnds. If the same thing happened to common man will any balck coat come to help without any fees ? Other hand we need a inspectors to beat lawyers also.

    Basically police personnel are working 24X7 unlike other working class personnels under lot of pressure.They have difficulty in making things both end meet.Present even will definitely down their porale and concentrate on their duty heartily.I wish that with present developments it will imossible for them to do theeir duty sincerely.If they do so their family will be rendered helpless/homeless.Kindly therefore police people,please take note of the developments unfolding in Kudla
    and be careful and not to indulge that renders your dear and near ones/dependents hopeless.Dont think too much about law and order and concentrate on your professional safety unless govt,dist admn looks helpful.

    There should be cc TV or all interrogations must be recorded to prevent police brutality.
    Police job is stressful and most of them thinks being rude or aggressive is part of the job and justifiable. We need to change.

    Mangaluru is a place where criminals move freely with the help of these criminal liar lawyers and the innocents are behind the bars.Directly coming to the point firstly i would like to tell the public that never support the criminals instead support for where there is truth.In this incident i would like to tell that instead of arresting a sincere and a uncorrupted Inspector TD Nagaraj i feel its better to arrest the lawyer who is spreading violence and corruption in mangaluru city.Coming to the point of yesterdays incident i would like to question the lawyer why he had to misbehave with a government officer on duty that too in his own station.This is for you MR Uttam Rai if a stranger would enter your house n misbehave and do all sort of hungama would you keep quiet.Definitely not. You would have done much more than what the Inspector did.

    Rightly said....I had once approached Mr. Nagaraj at Kadri Police Station and he was very cooperative and understanding. As a citizen we were well treated and our problems were heard patiently. I found him to be a honest and upright officer.
    These liar lawyers are showing off their ego and always protecting the criminals. THE CRIMINAL CASES IN OUR CITY WILL COME DOWN IF THESE LAWYERS ARE HONEST TO THEIR PROFESSION AND DO NOT FIGHT THE CASES OF GENUINE OFFENDERS. Now the Bar council is asking its lawyers not to fight the case of Nagaraj....How funny ???..."Ukta Chor Kothwal ko daante" !!!

    What about many cases in Mangalore, Bangalore, Chennai where lawyers were on the wrong side and assaulted Police, commoners etc!?. Why not take similar action against those!?. Lawyers are using their clout to settle scores it appears in this case!. Even the lawyer involved in this has to be thoroughly questioned!

    All confusing.Lawyers want to get somehow or other Police inspector to Arrest.But I ask why?he is not a criminal.If he had hit him ok,a wrong decision and was not supposed to do.noone hits without reason and lawyers reasons are bit petty.Gold chain costing only 5,000Rs?and why he didnt introduce himself as his lawyer?comeon Lawyers,dont Show your big arguments.you can handle as in court,peacefully.not with muscles.Afterall Police seemed not a criminal to Arrest,but try to handle other criminals and put them behind bars.

    According to Newtons 3rd law FOR EVERY ACTION THERE IS AN EQUAL AND OPPOSITE REACTION.Since the lawyer created a scene in the police station the inspector must have reacted.and if the inspector wouldn't have done it tomorrow all the criminals will behave like animals in a place of law and order... action should be taken on the lawyer for behaving like an animal with a sincere police officer instead of arresting a police officer...if the lier lawyers are on protest then i think even the city police should show their power in bringing back their colleague for his duty..

    If I recall correctly in an earlier statement it was said that the the police Inspector did not realize that the person accompanying the accused was a lawyer..... Now the officer is accused of a number things.

    These people in black court are big liars and are dangerous. So many of us go to police stations but they dont snatch chains and cash as claimed by Utham Rai. This lawyer went to station to defend someone who is accused of cheating and must have tried to bribe the police or something like that. Just because they have an asociation they cant take law in their hands. The police dept should protect their colleague.

    I am puzzled by the accusation made against inspector Nagaraj.If such thing happened(narrated in the report)he should taken in to task by the rule of land.I am puzzled because in 80s and 90s such things are common from police depart end.If PSI gone for 80s/90s situation like then I should say he must be dealt with.Any how I have some doubt with the treatment by PSI because we are living in 2015 and PSI must known consequences of his action.Hope this case will settle in good note.
