Driver gets rigorous punishment for death of pregnant woman

Udupi, Aug 6: A tanker driver who caused the deaths of a pregnant woman and others has received a sentence of 1 year rigorous imprisonment with Rs 6,500 fine from the district court.

On June 12 in 2014, the driver of a tanker lorry A S Jalaluddin Shafiq drove his vehicle with high speed and hit an auto rickshaw near Santhekatte petrol pump in Udupi district. Before that he overtook many vehicles recklessly.

The auto rickshaw overturned as a result and the occupants- a pregnant woman, her cousin and another person were injured. Later all the injured persons died in the hospital. Only the auto driver survived with serious injuries. The deceased woman who was 9 months pregnant carried a female child.

A case was registered at Udupi traffic police station and trial was held at JMFC court. The court which heard the case delivered the verdict based on arguments and counter arguments. The court said that it was proved beyond any reasonable doubt that the driver caused the deaths of four people with his reckless driving and sentenced him to one year rigorous punishment of jail and levied a fine of Rs 6,500.

    The fellow killed four lives (including Baby)and he is survived,.And he gets only one year rigorous punishment and 6,500Rs fine?four lives are only 6,500Rs worth?He should have got life Long instead of one year,and compensation to all of three Familys.May God give the three souls mercy.

    Do we believe this is what a man gets as punishment for killing 03 people.!! Drive recklessly, kill 03 people & damage few other vehicles - gets just 01 year rigorous imprisonment & some petty fine..! What a law & what we expect of these kind of judgments. Isn't it easy for drivers to continue to do what they do,b'coz they know punishment would not be that harsh to them..!

    I would have been happy if a substantial amount of compensation awarded to the deceased families by the court with the jail term of one year and a fine of 6500/-. Here the govt benefits rs 6500 and the victims family gets only eye wash and no compensation...is it not miscarriage of justice and mockery of the judiciary. Day by day the citizens are losing hopes in our system, institutions and administration, which is a dangerous sign and may lead to anarchy and revolt...ache din.....my friend

    Do we know the meaning of rigorous punishment ?? 1 year Jail & 6500 Rs fine... Is it rigorous punishment ?? In UAE blood money in accident cases is AED 200,000 which is equal to almost Rs, 35,00,000.

    Our's is a democracy country..we are not applying any shariah law.
    Accident not occur purposely.
    There are many reasons behind.
    Should given chance to survive by a driver..after repent.
    All the matters will be seen from all the angles.
    It's also utmost duty of the government to widen the roads abiding all the safety regulations.
    We cannot able to blame entire on the drivers.

    If terrorist is hanged..there are people who stand besides to protect..where are now these people ..to save a poor guy.

    To comment it's easy..while facing same circumstances is difficult.
    No doubt we are having good judges around..we should proud about our judiciary...not like in other countries.

    @Harsha,
    Out of so far 34comments, no one except you favoring to the driver of this accident. Whether u has drive through NH66 so far? I feel you haven’t. Otherwise u r opinion should have not in favor of the driver. I’m not blaming all drivers but 90% of express bus and truck driver always drive recklessly, overtaking, drive in speed lane, honking from behind, recklessly taking u turn, changing lane with indicator ete. I have faced several incident myself while driving through NH 66 by express buses. Pls sit at the steering and drive though NH66 at least 50KM, then no doubt your opinion will change and u may repent what u has commented.

    Money cannot buy life.... But still owing responsibility for death matters. What about that family who lost 4 members in a single day ? Gross negligence by any driver must be punished. In my judgement he should pay Rs 40 lac to family members of deceased. Rs 25,000 as Traffic fine. Rs 25,000 fines to courts. If fails 10 years imprisonment.

    Dear Bro, please read news first. It's not a mere accident where driver at no fault. Here driver drove his vehicle with high speed and hit an auto rickshaw. Before that he even overtook many vehicles recklessly. This is a case of gross negligence.

    Rash/reckless driving in India, which has been causing so many tragic deaths/serious injuries and ruined so many families/livelihoods, needs to be curbed ruthlessly, with most stringent punishment.

    The type of punishment handed out in Western & Gulf countries, which include long-term imprisonment, cancellation of DL and heavy penalties, should be introduced in India and strictly implemented, without any consideration about the status, financial/political clout of the guilty driver.

    For what given to be given life imprisonment. Here three persons died and not four..if i am correct. One year imprisonment is the right one..as it's not at all mistake of Tank Driver.

    Santhekatte itself is very dangerous junction where in plying of vehicles from all the sides. Incoming from Kundapur/Udipi/Kalyanpur/from inside roads - after having liquor..confusing one and all. Vehicles plying from outside do not aware it's a lot of people around due to narrow roads. Better remove homes/shops which is adjacent to bus stop and do it wide to avoid many more accidents. Give them good compensation.

    Why they didn't removed Navin Bakery during the expanding of road..?? Some of rickshaws stands where they wants..in the middle..to cross the roads.

    Its not an accident but accident due to reckless driving and if you read the news, the driver overtook many vehicles recklessly before crashing on to the rickshaw killing the full blown pregnant woman and in the process her child too was killed..Had the driver been careful and attentive, I am sure he could have averted the accident...Yes I agree with you that there are narrow roads and difficult conditions..I too drive in the same vicinity with presence of mind and so far I didn't crash on to anyone...Negligent driving leads to accident and accident kills people and its culpable homicide without intension and needs to punish the errant driver...You have taken the life of humans very lightly but I don't..Life is a gift of God and no one has the right to take it away in this manner..Hope you understood my point of argument..Good day..

    After all Life and Death is in the hands of God. As agreed..precaution also to be taken by the government and also driver. Every time we won't blame entirely on driver..without having any valid reason. Do you think we are far better than judges. May be you are driving for same route from long. What about others. After all it's considered to be a highway. What steps taken by the authorities up to now. Did they installed any Signals..to curb speed of the vehicles. Again it's called santhekatte..having people all around every time. People are crossing..from one end to another.
    When outside vehicles plying, they are not much aware of local roads..that's the main cause of accidents. Why local leaders come forward and agitate for good cause.
    Let people who visit Milagres Church take the initiative..will join by one and all.

    @Harsha, before counter attacking some one’s comment, carefully read the news. It is in simple English language “Before that he overtook many vehicles recklessly”. Because of his reckless driving he killed three people and Child still to be born (Not know the fate of the fetus that woman carry). If he is a driver, he should be able to drive what so ever may be the road condition, narrow, congested ete. .
