Court's notice to NIA, terror accused Shah on Delhi Police application


New Delhi, Sep 21 (IANS): Delhi Police on Monday filed an application in a city court seeking opportunity to be heard before any decision on the plea of Sayyed Liyaqat Shah, arrested by it for allegedly planning to execute attacks here in 2013, seeking discharge in the case on basis of the NIAs report giving him a clean chit in the matter.

According to court sources, District Judge Amar Nath, during in-camera proceedings, issued notice to National Investigation Agency (NIA) and Shah on Delhi Police's application and listed the matter for November 6.

Delhi Police, in its application, requested the court to give them a opportunity to submit their arguments before deciding the report filed by NIA in the case and Shah's plea seeking discharge.

Police also requested a copy of the witnesses' statments annexed with the final report to prepare their argument.

The NIA on January 24 dropped charges against Shah in a charge sheet filed against Sabir Khan Pathan, who is absconding, alleging that he was responsible for placing weapons and explosives in a guest house near the Jama Masjid.

Delhi Police alleged that on the basis of his disclosure statement, the Special Cell raided the Haji Arafat Guest House and recovered arms, ammunition and explosives.

The NIA filed a charge sheet against Pathan under charges dealing with forgery and various section of the Arms Act and the Explosive Substances Act.

Shah through his his lawyer Asim Ali filed a plea seeking discharge in the case last month.

Arrested by the Special Cell on March 20, 2013 while he was returning from Pakistani Kashmir to the Kashmir Valley via Nepal, he was later released on bail.

Jammu and Kashmir Police had protested the arrest, saying Shah was returning home as per the state government's policy of allowing people, who had gone to Pakistani Kashmir in the early 1990s, to come back.
