2008 Malegaon blast: Pragya Thakur's bail plea rejected


Mumbai, Nov 9 (Mumbai Mirror): A special NIA court on Saturday rejected the bail application of 2008 Malegaon blast accused Pragya Singh Thakur.

Thakur, in an earlier application, had listed several grounds for seeking bail. But she had cited poor health as the main reason.

Thakur was diagnosed with breast cancer two years ago and she had earlier said that her condition had worsened in jail.

On Saturday, special judge SD Talekar accepted the prosecution's argument that she had been given necessary treatment, said special public prosecutor Avinash Rasal.

"The also agreed with our argument that her application on this particular ground had already been dealt with by the High Court. Thakur's bail application was rejected just like the others," Rasal said.

Thakur was represented by advocate Prashant Maggu.

Judge Talekar observed that prime facie there was merit in the case against Thakur.

The police have described Thakur as a key conspirator in the blast that killed four people. She allegedly provided the motorcycle that was used in explosion.

In her earlier applications, Thakur had rejected the police claim, saying she had sold off the bike two years before the blast. She also said that she had no idea who was using the vehicle.

But the prosecution has maintained that there are no documents to prove the sale. Also, according to the law, the person in whose name a vehicle was last registered should be held responsible for its use.

Last month, the court had turned down the bail pleas of prime accused Lt Col Prasad Purohit and three others. They sought the reprieve saying they had been falsely implicated in the case because of "a deep-rooted political conspiracy".

The accused also relied on a recent order by the Supreme Court, according to which their bail application needed to be decided independent of the Maharashtra Control of Organized Crime Act, under which they have been charged.
