Udupi: Women's group raids flat, catches married man with paramour

Udupi, Nov 16: A women's group made up mostly of beauticians on Monday November 16 raided a flat at Kinnimulky and caught a married man allegedly having an affair with a woman and handed them over to the police.

It is said that Shailesh Shetty (40) (name changed) of Mudrady had hired Pooja (26) (name changed) about five years back to help his wife, a beautician, in household chores. Over the next few years, Shailesh's wife helped Pooja take a beautician course and the couple even helped her start her own salon, it is gathered.

In course of time, Shailesh allegedly started having an affair with Pooja, and about six months ago, they took a flat at Kinnimulky and used to frequent there. A neighbour, said to be a lawyer by profession, noticed them going to the flat often and grew suspicious. She kept a keen watch on them for about three months and also informed the women's group of beauticians.

On Monday, when Shailesh and Pooja came to the flat again, the women's group on receiving information raided the flat and caught the couple red-handed. They then informed the police who came to the spot and took away the couple. Shailesh's wife was also informed.

It is learnt that Shailesh's wife, unable to cope up with the news of her husband's alleged infidelity, took ill and was admitted to hospital.

Sources said that police at first were unwilling to accept a complaint against Shailesh, as he reportedly has political connections, but the women's group approached SP Annamalai and based on his instructions, a complaint was filed.

It is also gathered that Shailesh's marital life was not a happy one and that his wife had filed a case in court demanding monthly maintenance from him. The couple has a seven-year-old child.

Shailesh and Pooja were later released. No FIR was filed.

    Although morally wrong by most people's standards, this arrest will not stand the test of the court. The IPC Section 497 on adultery, unbeknownst to many, applies to men (and only men!) if and only if the woman is married. Since it appears from the facts in the article that only the man is married, he has not violated section 497 and will have to be released. These laws are archaic from Lord Macaulay's days and have a strong gender bias, but is the only one that holds today unless and until amended in the future.

    On second thoughts, considering all the facts, there is high possibility that these so called self styled beauticians could be operating some other side business under the garb of beauty salons, as is very common in metros like Mumbai, and this show off may be due to some dealings gone sour!!

I believe it's totally Wrong to have an affair in marriage life .. if this group of people are so interested in others life .. they could have talked with him personally with the help of some good and well educated social workers and try to help him out. If they are thinking they have done a great job buy catching them in this way thay are wrong.
    End result between husband and wife is not going to be the same anymore.. How can that wife trust her husband anymore..

For they just window dress the outer. 2.If the inner is not beautiful then what use?Beauty is only skin deep.Therefore this beautician fell into the Shettys trap or lap or whatever. 3.Feel for Mrs.Shetty.What would have Mr.Shetty done if Mrs Shetty had done the same thing? 4.For the child's sake the adults should sort out this sordid matter.How you ask Aa?     After reading all the comments below, I came to a conclusion that extra marital affairs is OK in the society.....! I am really surprised to see the comments and LIKES.What neighbour woman did is a right or wrong is a different question BUT what these two people did a right thing...? Whose privacy is raided...? If Shailesh was sleeping with his wife in his house, anybody will dare to obstruct their privacy...?

    Law doesn't operate on emotional or moral values of society, but it has its own limitations beyond which it cannot interfere inside the 4 walls of bedroom.
    It is for the couple to sort out their problems or alternative recourse. It is not for somebody else to interfere & create drama on behalf of one party & get patted on back for breaking the law themselves that has to be looked at here also.
    Here the law cannot decide what they did was morally right or wrong, but decide whether they broke existing laws of the land only.

Nobody is supporting or encouraging anyone to have extra marital affairs, they r only telling that it is their personal matter and 3rd person have no business to interfere on such matters unless wife or husband complains against each other. In this case wife has already filed case against husband for maintenance that means their relation is no longer continuing and hence what wrong is it on husband side to have another relation when his present relation with his wife is going to end. If ur comment is to be agreed then even unmarried boys and girls should not love anyone, and hence moral policing is right .. Is it?

    This headache should be stopped right now or else they will start creating all types of nuisance. I think the earlier when moral policing used to happen then nobody filed case against them which indirectly gave encouragement to them leading to more moral or immoral policing.     Consensual, but Adultery is punishable as per the law of our land!

    Section-497- Adultery “Whoever has sexual intercourse with a person who is and whom he knows or has reason to believe to be the wife of another man, without the consent or connivance of that man, such sexual intercourse not amounting to the offence of rape, is guilty of the offence of adultery, and shall be punished with imprisonment of either description for a term which may extend to five years, or with fine, or with both. In such case, the wife shall not be punishable as an abettor.”

    Section-498- Enticing or taking away or detaining with criminal intent a married woman “Whoever takes or entices any woman who is and whom he knows or has reasons to believe to be the wife of any other man, from that man, or from any person having the care of her on behalf of that man, with intent that she may have illicit intercourse with any person or conceals or detains with that intent any such woman, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both”.

    Here it doesn't apply as nowhere we can find the female here is married, other than having illicit relationship with married man which is only deceiving his wife, who herself has filed for divorce case.
    Most probably this was done to get the divorce with evidence to be produced in court. Point to remember here is a Lawyer is involved, rest can be left for assumption of the readers.

    As per the law when it comes to husband and wife, only one of them can file complaint against each other for adultery. No one else has any right to interfere or file complaint. I dont understand how SP Annamalai gave instructions to police to file complaint. Case should be filed against these womens and also the lawyer for spying on another people's personal matters. If SP Annamalai has given instructions to file complaint then he is bound to give proper reasons for giving such instructions. The law is clear with regard to adultery, only husband and wife can file complaint and nobody has any authority. This simple law if he doesn't know then who else can we expect to know. When a divorce case is going on then it is normal for husband and/or wife to seek love from another person to decrease the mental pain and depression, what is wrong with that? Once husband and wife are fighting in court for divorce then they should be free to seek another relation because the case might take many years. Why should or how can they wait for so many years without love from others who might give them what they cant get from their present spouse.

    If they are married without dissolving the first marriage, then it is adultery.
    If Pooja complains he cheated her, then it is adultery.
    If his wife files for divorce on the basis of this incident, then it is only ground for divorce.
    If 2 adults indulge in this consensual act then it is only morally adultery, but not an offense!They are not running a brothel here.
    By the way 2 people entering a flat doesn't prove they are having consensual sex, unless a hidden camera is placed inside their bedroom to capture evidence which is illegal too!
    Now others assuming it to be adultery barging in with police & arresting them on flimsy ground is a crime too.

    This case is something to be solved internally amoung those three than reaching out to Police Station.

    - Sailesh first wife was not happy and filed a case against him,wit this Sailesh also will not be happy either.
    - Pooja Sailesh Raazi tho kya karage Kaazi.

    But keeping his wife unaware of things is nothing but cheating and this is against law by all means.

    Congrats to Women's group..... and a mission well accomplished. Since there is no F.I.R. filed, perhaps this is not a cognizable offense as both are adults.

    However this is a clear case of infidelity and the poor wife has already taken this to heart and is hospitalized.

    Hope the erring man and woman will tender apologies to the aggrieved wife and that the man will retrace his steps and try and be a good husband.

    Complaint should be filed against those Beauticians who "Raided" the flat for illegal trespassing, invasion of privacy, criminal intimidation and breach of peace.

    It is not illegal to visit a friend in India.

    These Beauticians should mind their own business and should not involve in policing after making women look beautiful.

    @ar Mangalore,what do you mean strict rules for Apartments?One cant live in ones own four walls?need anybodys permission when want to invite visitors,?Of course illegal Business ,or some Business with women thats not having legal permission ,thats understood.But own house /flat you can talk,do what you want.or do you mean Need a watchman to Register who is talking to whom ,what he is doing inside?horrible.like military Campus.Afterall Police had no Need to Arrest him or woman.when they meet each other,or even have contact ,is not anybodys Business.private is private.when his wife has Problem with her husband she should solve with husband either by divorce or through lawyer.I would file a case against These Ladys for getting into their private Business and calling Police.
