Mangaluru: Naushad Kashimji murder - 3 sentenced to life, 2 get seven years in jail

Mangaluru, Nov 27: The third additional district and sessions court on Friday November 27 sentenced three of the five convicts in the murder of advocate Naushad Kashimji to rigorous life imprisonment.

Dinesh Shetty of Nayataru Village in Beltangady taluk, Ritesh alias Reetu and Ganesh, residents of Kodikal in the city, Pratap Shetty from Kavoor and Subrahmanya from Kadri were convicted on Wednesday November 25.

Among the five, the first three accused, Dinesh, Pratap and Ritesh were sentenced to rigorous life imprisonment under IPC sections 302 and 120 B, and Rs 20,000 penalty each. Failure to pay the fine would result in another five years of rigorous imprisonment.

They were also sentenced to seven years of rigorous imprisonment and Rs 5,000 penalty under Arms Act sections 3 and 25.

The other two convicts, Subrahmanya and Ganesh, were sentenced to seven years of rigorous imprisonment under IPC sections 201 and Rs 10,000 penalty each. Failure to pay the penalty would mean another three years of rigorous imprisonment in jail.

Subrahmanya and Ganesh were also awarded six months of rigorous imprisonment and Rs 5,000 fine under IPC section 202. They would spend additional five months in prison if they fail to pay the penalty.

The amount paid as penalty by the convicts would go to Naushad Kashimji's wife and children.

Naushad, who had appeared on behalf of Rashid Malbari, a close associate of Dawood Ibrahim and many others, was shot dead near his apartment at Falnir on April 9, 2009.

Speaking to reporters, Naushad's brother Sameer Kashimji welcomed the judgement and said, "It is a victory for justice. The verdict is satisfying to a certain extent, but the actual perpetrators are still at large, and the ones convicted are just the supari killers who had no grudge or enmity towards Naushad. The real killers also should be arrested. Nevertheless, this judgement is a lesson for all involved in the murder. 

He also thanked and congratulated public prosecutor Narayana Sherigar and said that he had done an excellent job in bringing the guilty to book.

    an eye for an eye, all the murderers should be sentenced to death and no life sentences. Because any other person will not think of doing a murder again because he will know that once he is caught he would be hanged to death only. A terrorist a murderer and a rapist should be hanged to death only. Also if you get a clue also about the person who made to do this murders or terrorism will definitely stop. There should be no dates and time taken to decide, arrest them and pass the death sentence.
    No lawyers no supreme or High Courts should interfere in this matter. This all depends on the lawyers taking the bribes and help freeing the culprits who ever it is they should not think twice on such matters. Do your duty loyally. You get salary for your duty and don't go after bribes and all that.
    Also if such lawyers or ministers also take bribes should also be hanged to death only. Then only our Bharat will be Swach Bharat, as Modi calls it, but he too is vice versa, and that is wrong only.

    I hate cheaters liers murderers and terrorists. I also hate the Ministers and Police Departments, doctors lawyers all these so called professionals who commits through bribes snd kill the innocents. All these people also should be should be hanged to death if found guilty, no life imprisonment. Only thieves can be given life imprisonment, because they will not come out to repeat same crime again.

    lawyers job is to appear for his clients irrespective of the nature crime. Legal remedy is a fundamental right to every citizen.That is why as a lawyer Mr Naushad Kashmji has not done any mistake in taking the case of Rashid malbari alleged associate of Dawood ibrahim. Killing a lawyer in the broad day light was terrifying act and against Legal process. I welcome the verdict and i also agree that actual perpetrators of the crime needs to be booked

    People like Sadananda Gowda cleared from all the corrupt charges, enjoying with his son's wedding, expensive cars etc. All Sangha Parivar-BJP leaders roaming in AC cars, taking rest in their big bungalows, their children studying in big institutions and enjoying their life. But they are brain washing poor youths and motivating them to kill the people from other religion and engage with other crimes just for their political mileage and for the publicity of their organizations. These youths will lose their good days, young age in the jails and their family members will suffer. Finally who is the beneficiary of this murder and what these youths got???
