Bengaluru,Nov 30: It is gathered that the state director general of police, prosecution, and director in the department of government lawsuits had advised the government against withdrawing a case filed against some people from Gokarn, who were facing charge of manufacturing a fake CD by using a person faking himself as Sri Raghaveshwara Bharathi Swamiji of Ramahandrapur Math, containing sexually explicit material. The law department had warned that withdrawal of this serious case may lower the respect and dignity the general public have about law. It also had said that there are chances of criminals indulging in similar activities again, and that there are no plausible reasons or public interest for withdrawing this case.

Against this advice, a meeting of the cabinet sub committee led by home minister held on May 6 this year, based on a request submitted to the home minister by the president of Gokarn Hitarakshana Samiti, had decided to withdraw case filed in Gokarn police station against the accused on April 1, 2010. This decision got the stamp of approval of the cabinet meeting on October 7, and official order was issued on November 4, it is learnt.

The above case was registered after secretary of Lord Venkataraana temple at Gokarn, Ganapati Krishna Hegde, filed a complaint that some people had been distributing fake CD and articles which had been prepared to malign the reputation of the Swamiji. Hearing of the case is presently in progress in Kumta court.

Normally cases not having supporting evidence and where interests of law are better served by withdrawing the cases, are alone considered for withdrawal. The department of law had clearly stated that this case does not fit into any of the conditions needed for deciding in favour of withdrawal. Still, the government has moved ahead and decided to withdraw this case.
