SC directs Karnataka to move HC for lifting stay on Yeddy

Bengaluru, Nov 30: In what may turn out to be setback for former Karnataka chief minister B S Yeddyurappa in his quest for honourable rehabilitation in the BJP over the various scams damaging his reputation, the Supreme Court on Monday directed the State Government to approach the Karnataka High Court for lifting the stay on the Lingyat strongman on continuing the investigations into the three alleged land-scams.

A division bench of the apex court comprising Justice J Chelameswar and Justice A M Sapre, in its order, directed the counsel for Karnataka Government to move the High Court for vacating the stay on the alleged land denotifications by the BJP leader.

"We will simply adjourn it today and see what happens there," the apex court bench said. The High Court is likely to hear the cases on December 1.

The cases involved denotification of land acquired by Bangalore Development Authority for formation of Banashankari V stage, BTM IV stage and for extending Mahalakshmi Layout.

The former BJP chief minister came under the scanner after the Lokayukta registered three FIRs against him and some others in June 2015 for charges of corruption and various offences under Karnataka Land (Restriction on Transfer) Act.

In three separate special leave petitions before the apex court, the State Government contended that the High Court ought not to have stayed the investigation into the complaints made before Lokayukta on the basis of the Comptroller and Auditor General report, highlighting "misuse of authority with a corrupt motive thereby causing heavy loss to the state exchequer".

Karnataka sought a direction for setting aside of the September 15 order of the High Court, saying it had "virtually stalled the entire investigation" while acting on a plea by Yeddyurappa.

Yeddyurappa, it may be recalled, had recently said at a meeting that he should no longer be termed as 'tainted' after the High Court's decision holding that the former State Governor H R Bharadwaj’s decision on permitting investigation without verifying the contention of the former was wrong.

The BJP leader, who has been elected to the Lok Sabha from Shimoga, had been denied a Cabinet berth due to the corruption cases pending against him. The BJP national president Amit Shah had appointed Yeddyurappa as the national vice president.

However, it is common knowledge that the BJP leader is keen on becoming appointed as the next State President of the party to get the organisation ready for the ensuing assembly polls in 2019 and become the chief minister again, if the party emerged victorious.

    Those saying Yeddy is now free or charges and Yeddy himself declaring that he is now pure is like saying tiger is vegetarian!. High court has cancelled governors sanction only because governor didn't follow certain rules while giving sanction. Yeddy is extremely corrupt and everyone knows that. Otherwise he would have immediately filed case in court claiming damages because he was wrongly fixed!. He knows very well that its better to be quiet and pretend like he has forgiven everyone!

    Everyone knows Ex CM Mr. Yeddurappa is corrupt, they also know that he has done some really good work for his community and his district of Shivamogga, just visit Shivamogga & his constituency Shikaripura, just staying in coastal Karnataka, you can't pass comments. Mr. Yedurappa is strong and mass leader of Lingayata community, which will play a crucial role in deciding yr 2018 assembly poll, unfortunately Karnataka also plays cast politics in diplomatic way (not like backward state like Bihar). You go around corners of Karnataka and ask a small kid from Ligayata community, they will endorse Mr. Yedurappa as their mass leader, BJP lost 2013 assembly poll due to Mr. Yedurappa, he took away more than 10% votes from BJP, same again when he rejoined, he was able to regain those vote share in big numbers, there was Modi wave, but its more to do with Mr. BSY, just look at how he won Shivamogga Lok Sabha seat by such record margin in Karnataka history, after knowing very well about his corruption, voters still endorsed him.
    He will definitely will be chosen as Karnataka BJP president, we don't think he is interested in Central Minister post.
    It so sad that a corrupt leader like Mr. Yedurappa has so much popularity and charisma, we have never seen a leader always in news, no matter whether he is in power, in opposition, in jail, in court or any where.
    You love him or hate him, you just can't ignore the guy.
    God save our democracy from these corrupt leaders.

    In our country corrupt leaders earn more popularity. They are backed more by their caste. Take the case of Lalu Prasad Yadav. Being convicted and under jail term, he conveniently won by allying with Nitish Kumar. The caste factor played a major role here.

    When BJP was in power in karnatak, starting from operation kamala, disqualification of MLA's by speaker Bhopaiyaa each of such cases were there in courts. Trial courts sentences were revered by HC and HC sentences were reversed by SC, for all series of such cases.

    Judiciary was supposed to uphold law. How can law be interpreted differently by three courts? Same law, same evidence, same arguments, but three different verdicts. Actually, it makes people believe judiciary itself plays active part in denying justice, making it prolonged and unjust.

    They are not at all ashamed of scams and scandals. Even Lalu being corrupt, convicted and jailed, still casteism prevailed in Bihar. It won't be surprising if same trend is repeated in Karnataka.

    I strongly agree with your comments.
    you me and every one know that Mr. Yadiyoorappa was corrupt and what ever happend with his case was not good. Any way we have to accept the verdict of Court.
    But you may see here some of our fellow readers blaming Mr. Modi for BSY's relief without knowing Lokayuktha is under State govt. and not under central govt.

    Today people mentality became like if there is any road accident in srilanka they will blame Mr. Modi.

    They dont know real reason to blame any one.

    It is highly possible Modi could be blamed for accident in Sri Lanka - why - He is mostly out of the country and makes many visits outside India, here and there.
    Can not at all rule out him causing an accident anywhere outside India including Sri Lanka.....!!!

    Anytime there is a need for the PM to comment on various matters in the country, they say he will be back after a day or two or a week and then it may extend to one month even, if he likes his stay abroad.
    You may have heard people terming him as "NRI PM of India".
    But then people say anything and every when they like Modi so much...and miss him very much most of the time...
    Next, all national matters will be attended to on digital India from abroad.
    ( Why one has to be in India itself to look after National affairs!!!)
    I am really concerned (1). Pak is taking advantage of the absence and incidents happen practically every second day at the border.
    But I am optimistic that he will iron out (flat) every problem in the years to come until he is our PM. Good luckji.
