Mangaluru: Rape convict gets 10 years of rigorous punishment

Mangaluru, Dec 6: Mangaluru 6th additional district and sessions court has sentenced a rape convict with 10 years and 6 months of rigorous punishment in a rape case and other two cases on Saturday, December 5.

Mahesh from Kotebagilu (27) in Moodbidri is the person convicted and sentenced.

Mahesh had raped a college girl from Kotebagilu after befriending her through Facebook social media. In the Facebook account, he had claimed that he was a site engineer and his name was Praveen while he was actually a coolie worker.

Before the rape, Mahesh had told the girl that he wanted money for his project and he would return it very soon. The girl gave her necklace and Mahesh availed a loan at a bank after pledging the necklace on June 3 in 2013. Then Mahesh got back the necklace from the bank and sold it a shop for Rs 25,000 on June 10 the same year. Later he also took an earring and a ring from the girl.

When the girl demanded that her jewellery should be returned. Mahesh told her to come near a college to get her it back. When the girl refused to come alone, he took her by his scooter to an old beedi branch and raped her on June 16, 2013. He threatened her that he would kill her if she revealed about the rape to anybody. He also told her that he belonged to scheduled caste and he would lodge a complaint against her on atrocity. The girl lodged a complaint on June 28, 2013 against Mahesh at Moodbidri police station.

A K Thimmayya then inspector at Moodbidri police station registered the case and filed the charge sheet.

D T Puttaranga Swamy from the Mangaluru 6th additional district and sessions court heard the case and delivered the judgement.

Under section 376 of IPC (Rape), the convict has received rigorous imprisonment of 7 years and Rs 10,000 fine. If he fails to pay the fine, he will serve an additional period of 3 months. Under section 420 of IPC (Cheating), the convict has received 3 years rigorous imprisonment with Rs 3,000 fine. If he fails to pay the fine, then he will serve 1 month ordinary imprisonment. Under section 506 of IPC (Criminal Intimidation), the convict has received 6 months of ordinary imprisonment. Rs 10,000 will go as compensation to the victim, the court said.

Judith Olga Crasta was the prosecutor in the case. 14 persons had testified in the case including the bank manager and the parents of the victim.

    He had the guts of asking Money from Girl and telling he is a engineer.why should one tell lies when one meets the Girl?Always be straight Forward.He sold someones necklace.Girl also could have think a bit before giving her necklace.when he is a" engineer" and wants Money from Girl,is something wrong.Over that threatening of he is a lower caste.He is not only a lower caste ,but also a lower class fellow.live withsomeones Money.His punishment should have double of present one.whether she will get back her Necklace and other ornaments.?Girls ,be careful in falling love with such "engineers " and loosing your modesty and wealth.Prove first what is White and black.

    If all the rapists of DK / Udupi are sent to jail for 10 / 20 years, then peace will return immediately.... There is no need for the Police dept to struggle for 3 years.....

    Imprisonment is nothing but mockery of the law. Our tax money goes to about 4 lakh prisoners in 1382 jails in India. Today, simple imprisonment means "doing no work" and rigorous means "doing some work."
    By interpretation, rigorous imprisonment means hard labor. During British era, convicts were given to break rocks and making roads. Almost all roads to hill stations were made by British using these convicts.
    Instead of feeding these parasites as govt guests, they should be made to work, and also, they should be made to fear that prison in India is really what it really meant to be.

    what? only 10 years. can anyone give guarantee after 10 years he will not commit the same crime? Rs. 10,000for victim? what is this peanuts or what?before releasing him from jail after 10 years kindly chop off his banana just like ladies chop off onion in the kitchen so that people like mahesh never think about rape!!!

    We think we are educated and take our own decisions thinking that parents are dumb.I f she would have though of the effort her parents put to bring that necklace for her and the value of money she would have at least asked her parents before giving that necklace to him. Education throws all the values to wind and now only parents can support her. Its an eyeopener to any youngster bypass parents for their selfishness.
