Puttur: Culpable homicide- Man gets 3 years jail for death of wife

Puttur, Dec 17: The fifth additional district and sessions court in Puttur which had convicted a man of culpable homicide not amounting to murder on Wednesday, December 9, has pronounced the quantum of punishment.

Justice M Ramachandra on Wednesday December 16 said that the convict Fernard Monteiro will face an imprisonment of 3 years and 15 days as punishment.

The defence had requested to let the convict be released by considering the time spent in custody as a full punishment. The prosecution had demanded 10 years rigorous imprisonment. Fernard Monteiro has been in judicial custody since July 2013 and he has to spend another 7 months in jail to complete the term.

History of the case

As per details of the case, Fernard a resident of Kapinabagilu brought pork meat on June 6 in 2013 and told his wife Rosalina Lobo to cook it. Rosalina said that she would prepare it, once the work of heating the water for bath is over. Fernard, who got angry with her for delaying the cooking, took a sickle and injured her on her head. When Rosalina managed to grab the sickle and threw it outside the house, Fernard poured kerosene on her and tried to burn her. Rosalina who was injured in the act was admitted to hospital in Mangaluru and died on June 11 in 2013.

Fernard was arrested on July 11 the same year by Uppinangadi police and a charge sheet was filed subsequently by then circle inspector of rural police station Suresh Kumar.

In the trial held at the sessions court, the judge came to a verdict that Fernard was responsible for the death of his wife. The court decided that it was a culpable homicide not amounting to murder.

    The same kind of incident happened in Bangalore where A techie was abetted to suicide by his wife but courts ruled wife cannot be held responsible . clearly discriminated verdict in favour of one gender . Again here putting onus on husband for all the mess , the courts are always silent on violence infuriated by wives . The dv and 498a act itself is not gender neutral and government is drafting draconian Marital rape bill !. No wonder vociferous wives will cry ' rape' every morning and trap them under ' life imprisonment' . It can get bad to worse , at least men should wake up and sign the petition opposing marital rape bill ( which is available on change•org ) and mass signature campaigns to law ministry . Wake up before its too late .

    Section of 304 IPC says Whoever commits culpable homicide not amounting to murder, shall be punished with imprisonment for life, or imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine, if the act by which the death is caused is done with intention of causing death, or of causing such bodily injury as is likely to cause death

    or with imprisonment of either description for a term which may extend to ten years, or with fine, or with both, if the act is done with the knowledge that it is likely to cause death, but without any intention to cause death or to cause such bodily injury as is likely to cause death. I guess immaturity of our advocates are increasing day by day !!

    May I change your statement a little ? Our system is so corrupt, you can get anything in the jail for money.
    Give gangasara to them, they will allow one to get pork and sanna.
    Give red label, one can get mutton biryani or beef sukka.
    Give black label, one can get a girl for him for the night.
    Give blue label, they will allow one to go to his girl in the night.

    I heard the green label sells for 5 figures at Crawford market and it is "Aukaat se jyada karcha karna" for a common man. It is better to remain calm, eating raagi mudde in the jail than giving this label.
