Mangaluru: Family awaits compensation from 10 years, court orders seizure of govt office property

Mangaluru, Jan 11: A family from Adyapady, Bajpe has been running pillar to post for the past 10 years seeking compensation that was due to them for the land they had given up for the expansion of Mangalore International Airport.

Now, the court has ordered seizure of the movable property of the assistant commissioner's office until the full compensation amount is paid.

Joseph D'Souza of Adyapady had given up 4.5 acres of his agricultural land in 2005 for the expansion of the airport, and he was supposed to get a compensation of Rs 59 lac. However, the family did not receive the amount, except for Rs 13 lac as first installment in 2006. The family was also given 12 cents of land in Bajpe, where they built a house.

Since 2006, Joseph has been visiting government offices in an effort to receive the remaining amount of Rs 46 lac. He then approached the court, which ordered the revenue department to pay the compensation. However, it did not happen. Joseph claims that he never offered bribe to any official all these years.

Thereafter, the principal civil judge (senior division) who heard the case ordered the seizure of the furniture and other property of the assistant commissioner's office. Accordingly, court officials along with the aggrieved family arrived at the AC's office.

After the furniture and other items are seized, time will be given to the assistant commissioner to clear the compensation and release the seized items. Otherwise, auction will be held in an open court.

Meanwhile, assistant commmissioner Dr D R Ashok spoke to the family and sought 15 days' time to clear the compensation.

Speaking to daijiworld, Dr Ashok said, "I will write to the government on this matter. Once the amount comes from the government, I will submit the same in court to be paid as compensation and release the furniture."

    Mr. Joseph D'Souza had to give away his agricultural land for the international airport and fight for the compensation for a decade. Can he ever get similar agricultural land for the compensation declared, i.e. Rs.59 Lakhs for 4.5 acres? What about interest on delayed payments and litigation expenses incurred by him? The Government Officials ensure to get their salaries increased yearly. Besides,increase as per 'Pay Commission' Any sympathy/compensation for the displaced, by way of employment etc.. as the monetary compensation is not at all as per market value.

    I congratulate the Court and the Plantiff.

    The DC's officials are responsible for this litigation. These officials do not understand that their salaries are paid by the tax payer. Yet they case harm to the tax payer forcing them to go to Court. In many cases the litigant dies during pendancy of the case. Officials come and go with promotions. Where are our politicians whom we elected ? Where is Mr. Bava, Mr. J.R. Lobo , Mr. Khadar and District Minister Mr. Ramanath Rai ?? Are they now hiding ?? Mrs Christina Dsouza has met Mr.Ramanath Rai and Mr. J.R.Lobo several times on this matter of enhanced compensation. They had promised to look into it but never bothered to do so.

    All these elected representatives are a real Thugs and a black spot on Humanity. They have no feelings whatsoever for the poor people's plight. They have not lost their land so they are not bothered. These Congress MLA's and ministers making merry when they are in power but who knows if they ever sustain to keep power in the coming days. Honorable court has given the best judgement ever against the Government. I hope the family gets the remaining amount of compensation ASAP.

    Items in AC office is not at all enough to cover the compensation. To be Seized properties of all related Govt officials personal property also. Bring them to the road, then only they may learn a lesson slightly. What do you say?

    This is not the only one case but there are so many cases that their vast properties have been seized and they received compensation for peanuts. I have heard this real cases from others those who have lost their acres of land but no proper compensation and cases are in the courts to claim proper compensation.

    Praise the Lord!

    I am also one of the victims of this trap and I am withholding my name for some reasons. Because of the corrupt officials involved in the racked and their debauchery my property was attached in my absence by the authorities for no valid reasons. I was shocked to learn that my property had been acquired for the rehabilitation of the Bajpe Airport. I ran pillar to post and plead authorities but efforts were in vain.

    Only after recounting my true story to Mr. J.R. Lobo and the Mangalore Airport Director, Mr. M R Vasudeva, I got a reprieve from the order. I would like to thank whole-heartedly Mr. Lobo as well as Mr. Rao for saving my property. May Almighty bless them always.

    I think, all these requests should be made online- status of pending task, time lag to complete task and document requirements should be made online. So no body has to go physically with these corrupt officials or talk.
    India has intelligent skilled people, highly caliber youths which are absorbed by US and other developed countries. Why we do not absorb these skills in our own country to develop our own technology. If these requirements/administrative requirements go online, concerned department directly question to designated officer or the applicant directly where necessary.

    Very disgusting indeed. Now, even if those furniture etc are auctioned, are they enough to get the balance 46 lac? Not even 10% of that they will get. Whole system of acquisition should be revamped. Why govt should be involved at all like a middleman. Those who want land may it be Airport authority or a Company let them directly deal with land owners once approval to acquire from the Govt is obtained. Let the compensation come directly from the end user.

    Just goes to show how rampant corruption is still in force. The Government knows how to seize / snatch people's assets for its welfare and various expansion programmes but over and above knows pretty well how to deprive people of their benefits. It will never compensate promptly without any hiccup and often the middle class are the biggest sufferers. It is high time people united and got their act together. May be there are still so many pending cases .. skeletons are now falling out of the cupboards.

    This is a disgusting episode and where in insensitive of Government officials have delayed the payment to the landowners. The court should have ordered the attachment of the property of all concerned officials responsible for the delay. Mere attachment would not serve the purpose but demotion and suspension would. I pity the couple for loss of opportunity of utilising the money had it been paid to them on time.
