Bengaluru: HC notice to state government on PIL seeking end to Kambala

Bengaluru, Feb 19: Karnataka High Court has admitted a Public Interest Litigation (PIL) filed by People for the Ethical Treatment of Animals (PETA) India seeking an end to the famous Buffalo Race or Kambala, popular in the coastal parts of Karnataka.

After hearing the matter, the High Court issued notices seeking responses of the State Government and other respondents, including the Animal Welfare Board of India and District Committees of Kambala in Udupi and Dakshina Kannada districts.

Senior advocate for the petitioner, Anand Grover, argued that the State Animal Husbandry and Fisheries Department on December 17 issued an order permitting Kambala events despite a 2014 Supreme Court judgement, which held that such events are inherently cruel, violate the Prevention of Cruelty to Animal Act, 1960, and hence cannot be allowed.

"Buffalo bulls are forced to run in Kambala events through the infliction of fear and pain. India's Supreme Court has already confirmed that such events are inherently cruel," says PETA India Director of Veterinary Affairs Dr ManilalValliyate.

"PETA will continue the fight to protect the bulls from abuse and we are hopeful that justice to these animals will be served, as events involving cruelty to animals have no place in civilised society,’’ he said.

In 2014, the Supreme Court had acknowledged bulls are not anatomically suited for races and similar activities. Making them participate subjects them to unnecessary pain and suffering, so such events were prohibited.

The apex court had also stated that when culture and tradition are at variance with the law enacted by Parliament, the law would take precedence.

As many as 65 non-cognisable offence complaints and one FIR were filed at just three events inspected by Animal Welfare Board of India (AWBI) during 2014-15 Kambala events.

The AWBI inspection reports contain a scientific assessment of the welfare of buffaloes when they are forced to participate in Kambala events.

The reports further points out different forms of cruelty inflicted on the animals with photographic evidences, such as being subjected to verbal and physical force including shouting, hitting with hands, slapping on face, violent pulling of thick nose ropes (in some cases 2-3 nose ropes inserted through the same hole in the nasal septum), rough handling by pushing and pulling the animal, overpowering, tail pulling and restricting the movements of the head using a wooden pole tied to the horns of both the animals.

Many of the buffaloes that finished the race frothed at the mouth, salivated heavily and displayed increased respiration rates, establishing that buffaloes are anatomically unfit for running, PETA claimed.

    PETA : Peoples' Entertainment's Tragic Assessment....
    It is not a child`s play to rear a set of buffalos for race (Kambala). This assessment of cruelty and whipping is utter tragic assessment by people who not from the ground. The owner of the Buffalos knows the pride in rearing them, caring for them, seeing to it that they are fit and healthy at all times... Typically the Racing Buffalos are not used t plow the fields. Kambala is not equal to cock fight or bull fight. It is only a race and without fear or pain ( not amounting to torture) nothing moves....Putting ropes in the nose? should there be gold rings? How does one tame/train a Buffalo?
    some ground reality and work culture is needed unless we completely go mechanical in Indian agriculture.... PETA should plan and make necessary arrangements to provide Tractors and Tillers to farmers all over India and probably then can we think of PETA and let the animals roam free....

    Kambala may be better than rearing animals for meat, kambala may be better than bull fight, kambala may be better than tearing apart a goat like in the north as a sport and may be better than that of a sport in TN that involves calf or a bull...
    Kambala is a race and for that matter even Human race is a sport of extreme stress and pain ( not amounting to torture, can be self inflicted...)
    Y ban a sport that only happens once twice or thrice in a year or in 3 months of the 12 months...?
    Rearing buffalos for Kambala is not every ones cup of tea, one needs land, workers, care takers and need to feed the animals 12 months like children to see them sport and run just for 3 months....
    In Kambala PETA may be Peoples' Entertainment's Tragic Assessment. It is my assessment that Kambala may be left alone as a pure sport and there is no torture as assessed and made to believe.....

    Bad News kambla lovers like me, yes they treat buffalo's badly may be for 2-3 months, but remaining 9 months they take care of them like their kids. What about cruelty on human beings ?? is that can be banned ??

    Good decision by High court to end Kambala. This has been an old tradition run since decades.This buffalo race is fun for some but the cruelty towards these animals is too much.

    Where is the cruelty in this buffalo race,small beating is there to bring them cool and to listen to the mater nothing else, there baffalos has been taken care very well whole year more than thier child by spending lakhs of ruppies it is not easy task. to see these wonderful animal in this condition then kambla must continue or these type of baffalos will vanish for ever.

    Just give one single Buffalo bull of Kambala to this “the People for the Ethical Treatment of Animals (PETA)” and ask them to feed for 1 month. Lets compare the result of/between their justice and humanity that shown by each.
