SBI seeks Vijay Mallya's arrest, seizure of passport: Report


Mumbai, Mar 3 (PTI): Top state-run lender State Bank of India (SBI) has sought arrest of Vijay Mallya, and also impounding of his passport, as the bank approached Debt Recovery Tribunal (DRT) seeking action against the UB Group promoter for defaulting on loans.

State Bank of India, which heads the consortium of 17 lenders to the grounded Kingfisher Airlines, moved the Debt Recovery Tribunal in Bengaluru against the airline's chairman Mallya in its bid to recover over Rs. 7,000-crore dud loans from him.

According to sources, SBI has moved four applications at the DRT in Bangalore, seeking impounding Mallya's passport, getting him arrested, securing the lenders' first right on the payout from Diageo and getting full disclosure of his assets in the country and abroad.

The immediate objective of the lenders moving the DRT is to secure a first right on the $75 million severance package that Mallya will be getting for quitting Diageo-owned United Spirits (USL) as its chairman last week.

An SBI official confirmed to Press Trust of India that they have moved the DRT seeking right on $75 million severance package, as the borrower Mallya who has already been declared by the bank a wilful defaulter, has decided to leave the country and settle down in London.

Mallya and Kingfisher Airlines owed Rs. 7,800 crore to a consortium of 17 lenders led by State Bank which had an exposure of over Rs. 1,600 crore to the now defunct airline.

Since January 2012, the loan was not serviced. Other lenders include Punjab National Bank, Bank of Baroda, Canara Bank, Bank of India, Central Bank of India, Federal Bank, Uco Bank and Dena Bank among others. Last year, SBI declared Mallya as wilful defaulter. Last month, Punjab National Bank had also declared him, his group holding company United Breweries Holdings and the long-defunct Kingfisher Airlines as wilful defaulters.

As part of a deal, Diageo said it would pay $40 million immediately to Mallya with the balance being payable in equal installments over the next five years. It will also absolve Mallya of all liabilities over alleged financial lapses at the company founded by his family.

Last year Diageo auditors had found that Mallya had diverted Rs. 7,200 crore of United Spirits Limited (USL) funds to the airline, which was again diverted elsewhere.

The England-based Diageo is the majority shareholder of USL with a 54.78 per cent holding, excluding the 2.38 per cent owned by the USL Benefit Trust.

Mallya personally held a small stake of 0.01 per cent in USL at the end of December 2015, while his group firms owned further 3.99 per cent stake. However, more than half of these shares are pledged with banks.

The 17-member lenders consortium led by SBI has also decided to auction Kingfisher House in Mumbai on March 17 this year in a bid to recover a part of Rs. 6,963 crore debt due from Kingfisher, as lenders since January 2012 has recovered around Rs. 1,200 crore by selling pledged shares of group companies and other physical assets.

Banks are charging 15.5 per cent compounded interest on this principal amount, which has not been serviced since January, 2012.

    First arrest the top brass of these banks for lending public money. lso the Minister who probably had called up these banks to lend the money to VM and other industrialists.

    Many of these officials may have retired by now and enjoying the kickbacks during their retirement. We should not allow them to go scot free.

    Not just SBI but every institution whom he owes money to should file case and attach all his assets to recover the money of the common people and arrest him until the whole debt is repaid. He enjoyed enough with public money and let him spend time behind bars and he should also reveal the names of the bank officials whom he bribed to get these hefty facilities without proper securities.

    Recently the CEO of the Tyco corporation in the U.S. was released from the jail after 7.5 years of massive milking of his corporation one million dollar birthday party for his wife, $ 60000 bathroom shower curtain etc, lived in a 16 million luxury flat in Manhattan but now living in a 2 bed room apartment paying rent.
    Now he is a totally changed person.
    For some egomaniacs, certain hard lessons are the only panacea to transform their lives in the right direction.

    He's not Roadpathi. He's still CROREPATHI. Ask Why??. Diago is paying him approx. 500 crore INR (disclosed amount) for coming out of USL Baord. It's only disclosed amount, but nobody knows what is the actual amount. He's also offered Property in UK by USL. So is he a Roadpathi??
    Besides that he has sprawling properties all over the world. From New Zealand to South Africa. European countries, Every where. And his son is still in Board of Directors.
    So, now Mallya may not be the KING OF GOOD TIMES, but he's is still a KING, but a LOST KING.

    This businessman and many others who are defaulters, Banks must take action against them and confiscate all their properties and bank accounts\wealth they have and recover with complete Interest\expenses incurred for recovering all that.
    Why Banks just write off huge loans taken by these humbug business\political people? Is there no collateral while granting loans?

    Bank NPAs have grown nearly seven fold from from Rs44,967 corore in 2009 to Rs.3 lakh crore in 2015 and PSBs are incurring losses.High Value frauds are increasing. Govt should take take serious steps against offenders to save public money. Bank should not pass burden to its customers by increasing service charges.

    Crores of loans are written off, but a rickshaw driver defaults one installment bank launches their team to rickshaw stand to humiliate him and even arrest.
    Court should form a separate team of experts to go in depth of all such loans and check how they have been given.

After an month he returned $5000 to the bank and they charged him $250 as interest for him. Manager asked him why kept Ferrari car as security reason.     All defaulters should be taken in to task. With the public money collected by banks some people spend their life lavishly. Who will compensate these losses. End of the day it will be absorbed by the profits earned, which will affect the earnings of investors and public. Every bank should be strict in this matter. What collateral guarantee bank is acquired for this loan? Bank authorities are equally responsible. Thorough investigation is required in all loan default cases.

    This reflects law is common to the rich and the poor. Sad story of most people who are in liquor business - they end up in failure in business. Though it is highly remunerative for the businessmen, it is equally destructive to the people and their families. State Governments should ban liquor manufacture even though it is one product which earns high revenue in terms of duties/taxes. If Gujarat can sustain the revenue loss from liquor and develop industrially, why not other States? The pressure will be on the Head of state to find alternative means of covering up the revenue loss. Mr Mallya should clear his dues and leave gracefully.

    vijaya malya should become inspirational model for those farmers who think about suicide due to non payment of small bank loans. After cheating big amount to the banks he still very happy because of our flexible legality.
