Debts case: Vijay Mallya has left India, Centre informs SC


New Delhi, Mar 9 (PTI) : Liquor baron Vijay Mallya, who is facing legal proceedings for allegedly defaulting loans of over Rs 9,000 crores from various banks, has left the country a week back, government today informed the Supreme Court.

"I spoke to the CBI little while ago and it told me that on March 2 he (Mallya) left the country," Attorney General(AG) Mukul Rohatgi told the bench comprising Justices Kurian Joseph and R F Nariman.

The bench issued notice to Mallya and sought his response within two weeks on pleas filed by a consortium of banks seeking direction for freezing his passport and his presence before the apex court.

Since the court was informed that Mallya has already left the country, probably to UK, the bench allowed the plea of AG that the notice to him can be served through his official Rajya Sabha Email ID, Indian High Commission at London and also through counsel representing him before various high courts, Debt Recovery Tribunal and also through his Company.

During the brief hearing, the AG said that amount of more than Rs 9,000 crore was due to various banks and on one or the other pretext Mallya avoided to settle them.

There have been various proceedings going on against him in debt recovery tribunals in Bangalore and Goa, he said.

When the bench wanted to know what was the petitioner seeking, the AG said there was a need for a garnishee order and there was also a need for disclosure on behalf of Mallya.

Rohatgi said the banks were seeking an order that Mallya should appear in person before this court and also sought a direction for freezing his passport.

The AG said that Mallya has assets, both movable and immovable, abroad which are far excessive to loans secured by him here.

At this, the bench wanted to know how the banks have granted him loan under such circumstances.

The AG said the loans were granted keeping in mind that Kingfisher Airlines had a fleet of aircraft as well as brand value and loans were given also on the basis of the logo and the aircraft were attached to the third party.

    I read most of the comments but I didn't find any realistic comments. Why banks are not able to catch Vijay Mallya (VM) & howcome he left freely india? Simple answer: whenever a person borrows a loan from the bank is against some mortgage of assets. On this the loan is allotted only from 50% to 70% of the assets value. If loan is unpaid then have the right to take the possession of assets and auction it. Same thing had happened with VM case. So VM as left the assets to bank for recovery against. So where is the question of fraud?? Now banks are at fault. So they are not able sue VM. It's simple. Now govt should take bank into task & take legal action...

Given by Lender (Banks) to a Business (King Fisher Ltd) Official of the business Vijay Mallya pledged his Blue Chip UB group stock as security. Stock price goes up & down in the stock market. In a business loan Lender (Banks) have only recourse on pledged stock & assets of the Business (King Fisher Ltd) Lender (banks) only can get pledged stock & assets of King Fisher Ltd. This case will continue for another 20 years with motions & appeals. Final judgement Banks will not get any personal assets of Vijay Mallya. (Good Luck to the Lender)

    Mr.Albert, basic banking rules are same for personal & business. In the case of VM business what you are saying is correct. Again banks are at fault, they have to do regular intervals inspection, check & balance on the stocks which might have not recorded. By this report the bank management immediately has to take measures which they might have not done. With this it's a clear case of negligence from the bank. For this you cannot hold responsible for the borrower..

    If at all, our home minister, SC and other responsible agencies had taken the matter seriously, Mallya could have been black listed, pending settlement of his dues with the banks.
    Shame on the part of our Central government. Only noise.
    How this will effect in the share market especially, Nationalized banks share price.?

    WHO EVER HE MAY BE CONCERNED BANK /OFFICIALS SHOULD BE MADE RESPONSIBLE FOR FINANCING WITHOUT PROPER SECURITY AND KNOWING WELL THERE WAS DEFAULT FROM MALLYA'S SIDE AND NOW EMPLOYEES ARE LOOSERS BECAUSE OF BANKS OVER FINANCING TO BE MADE GOOD.
    THERE IS NO QUESTION OF HUMANITY.

    |Its banks responsibility to recollect the money without harming the business and employment. Here banks are doing totally reverse. He requested GOVT for bail-out . But govt objected it. So he has done right thing.
    There are many bank defrauders in india, why all they are not arrested.
    There are people banks helped them to make fraud on commission basis .
