Udupi: 91-year-old woman wants justice, SP Annamalai clarifies

Udupi, Apr 19: A 91 year old lady named Savithri Bhat has been a subject of mental torture from her son over a property issue as alleged by her at Udupi press club on Monday April 18.

Speaking to media persons she revealed that currently she resides at Shivalli village and is taken care of by her younger son, Krishna Bhat. She has eight children among them, six daughters and two sons.

 




Krishna Bhat says two years back Savithri Bhat approached the human rights commission on the same issue and got an order from the assistant commissioner (AC) for her son to vacate the house.

The elder son Keshav Bhat lives on the top floor with his family. Savithri is under constant harassment by him for his share of the inherited property.

The land in question is 35 cents which has been divided into nine parts to be shared by her and her children. According to Krishna Bhat, she has legally distributed the property among all of them, but instead of caring for his mother in her old age, Keshav is torturing and ill-treating her for money. Savithri now owns four cents of land and a house.

The house has three door numbers namely 8-3/50, 8-3/50(a) and 8-3/50(b) respectively, but now just one door number (8-3/50) stands registered.

She has urged the assistant commissioner, Kundapur sub-division to pass an order to add the other two door numbers as well.

She alleges that even after two years, her son has not vacated the house and that no action has been taken by the superintendent of police and the concerned department.

Savithri has all the required legal documents to prove that she is the owner of the property.

This elderly mother wants her son to vacate her house and free her of all trouble caused to her by him. The SP of the district must intervene in this property dispute and take immediate action against Keshav Bhat.

Udupi, Apr 19: Replying to the statements made by 91 years old Savithri Bhat and her two children in Udupi on April 18, which appeared in media, superintendent of police (SP) Annamalai has given a statement.

"Savithri Bhat and her two children walking in scorching sun were brought to his office by Legal Info Pages. Her two children, two women and others had started quarreling in my office. I advised that it is not proper to fight in connection with looking after the mother and I would take her home and look after her if they could not. Nobody is allowed to fight in my office. I respect those who visit my office, particularly the elderly. Let the Legal Info Pages clarify if I insulted her or her children”, the statement reads.

As regarding the press statement by Savithri Bhat that the police are not vacating her son Keshava Bhat from the house denying justice, the SP stated that it is illegal to vacate house No. 8-3-50a without clear orders from Kundapur assistant commissioner (AC). “Udupi circle inspector Srikanth has given a written statement that the house will be vacated if separate orders are issued by Kundapur AC to this effect. Udupi circle Inspector has also issued clarifications regarding the complaints by her and her children to the human rights commission, women commission and Lokayuktha.” The statement continues.

“Regarding the statement by Savithri Bhat that I am wandering around in bicycle without providing justice, I have already stated that it is illegal to get the entire house vacated without orders from the court. Therefore, I have not done it. Nobody can question me regarding the work that I do during my spare time”, he stated in the statement.

“Regarding her allegation that I have not provided justice as the wife of late V S Acharya telephoned me and pressurized me, I state that it is unfair to drag the name of just politician V S Acharya in the case after his death. They have not telephoned me or influenced my action. A case for claim of damages will be registered against those who falsely accuse me or the police department or those who induce such allegations without evidence in the future,” SP’s statement concludes.

    Please do not put allegation on SP without substantial evidence. He is known as an upright officer. He has to work within the legal frame work. It is pity that a 91 year old lady is made a pawn for the fight between her sons or children. It is nothing but greed for property is the cause for issue. It is duty of all sons or children to look after the 91 year old and give her a peaceful life than dragging her into litigation. Respectful family members or relatives should join together and solve this issue amicably.

    Infact a very sad story. Whatever the intention of the 91 year mother may be, son's should understand the state of mind of their mother and help her in leading a peaceful and happy life. Afterall the property is belonging to the father, which legally becomes the ownership of the mother. Son's should be ashamed to stay in parents house and mistreat their own mother. Human right activists need to get involved and give the mother a peaceful and loving life from all her children.

    Now days there are no relations front of property and prosperity.
    Old people need peace of mind. How long she will live.
    Sometime old people want to live their own way in old culture and now generation want their own way too.it will not match, so main thing understanding and adjusting. 91 means she is very old, she need someone with her too. And after death his share he can take, but old mother can change her mind and may she will write paw to others than he will not get, so may he harasses I don’t know, (now days like that happening too. Who have much and they want more too. Old people respect who stay far away than who stay with them too)

    Who living together only know each other may love, hurt, pain, harrace. What cooking, eating throwing inside the house we cannot comment or blame. I was in the side of mother or either son side,
    I know old people are like holding umbrella each side of rain. Closed with them and taking care of them also not comparable, even with poverty ridden person sacrifice their life just to take care with paw after that who went to earn come back with wealth and show temporary make up love they will change their side and even they change mind and fight with them for the rights for them, it was happened still. There is no value that who spent everything for them. no use. We some are victims in that way

    To all parents out there, In this day and age majority of our children are not going to take care of us in our old age. So please don't divide and give all your property and money away to your children, before your death. This way you are in charge of your property and money and in times of difficulty you can still sell a portion of your property and live happily. So give them a good education and let them fend for themselves..

    Unless a Adult Child is d disabled He or She should not have any property right until the death of both parents. Once the husband dies all property should become the lawful right of his wife and she should have right to sell or donate the property and the decision should be her with proper counseling from non Government agency.Adult able children should create their own property or live with in their income & ability. Once both parents passes away the complete property should be auctioned to the highest bidder and the proceeds should be evenly distributed among all children.

    Sri, karkala, please note that as per Hindu property Law, daughters have equal share in fathers property. So dont discriminate son and daughter, they have equal rights over fathers property unless fathers has made a will when he is alive.

    @vikas- probably law came to existence very recently. Hindu tradition is that sons share fathers property equally. Kotta hennu kulakke horage. It is making things complicated for old age parents. Sometimes old age people talk according to convenience by changing side. I mean between 80-90years she maybe living with elder son and then shifted with younger son!

    During old age parents expect or wish to live in peace and with comforts under the care of their grown up children but here this old mother is under constant troubles and mental torture.
    I hope she will get justice and also the rebellion son will not harm her once human rights commission succeeds in evicting Keshav. People are crazy about money and sometimes ready to inflict untold miseries or even threaten life of others. God forbid.
