Karnataka govt to file appeal against Yeddyurappa's acquittal


Bengaluru, Apr 20 (PTI): Spelling fresh trouble to former Chief Minister B S Yeddyurappa within days after he was made the state BJP chief, the Congress government in Karnataka has decided to file an appeal in the Supreme Court against his acquittal in a raft of corruption cases by the High Court.

An order had been issued on February 24 on filing the appeal, which the state anti-corruption ombudsman Lokayukta had also recommended, Law Minister T B Jayachandra told reporters here.

"Lokayukta had also recommended it. In that background, the Home Department has taken action and issued the order," he said, adding, the appeal would be in relation to 15-16 cases against Yeddyurappa.

The Siddaramaiah government's move comes almost within two weeks after Yeddyurappa made a fiery return as the state BJP president for a fourth time, setting an ambitious target of winning 150 of the 224 Assembly seats in the 2018 polls.

His appointment to revive the fortunes of BJP had come after the Lingayat strongman got a breather from the High Court in January this year, when it quashed the proceedings against him in relation to 15 FIRs registered by the Lokayukta police over denotification of lands in alleged violation of rules.

After Yeddyurappa's return as BJP chief, Siddaramaiah had indicated recently that the government was mulling filing the appeal and the Law Department would take a decision.
Yeddyurappa was forced to step down as Chief Minister in 2011 over graft charges, following which he quit the party to form his own outfit, Karnataka Janata Party, which failed to make a mark except to cause damage to BJP in 2013 polls.

He returned to BJP following the announcement of Modi as party's prime ministerial candidate ahead of 2014 Lok Sabha polls. Biding his time, Yeddyurappa had made no secret of his desire to become the state BJP President and got the post recently with no challengers to him with his pan state image and combative style.

With Yeddyurappa already going on the offensive against the Siddaramaiah government after taking over the mantle of presidentship, the new development is expected to raise the political temperature in the state.

    Appeal or no appeal! It won’t make any difference for Yeddyurappa. When a corrupt leader like Lalu can win in Bihar, why not Yeddy in Karnataka? People of his caste will not let him down. The caste factor in Karnataka’s Ghat region is as strong as in Bihar.

    In some or many cases, SC rules party guilty where as HC ruled not guilty and vice versa.
    Does it mean the Judges at the HC not good enough or giving biased decisions?

    j.anata, I too strongly believe that people like Yeddy who are extremely corrupt, arrogant always in resorts when in power should never be allowed to gain power positions at all costs. So I strongly support Siddhu government in this issue. Even almost all BJP leaders (except Shobha) had said Yeddy is corrupt when he went out of BJP!. Now just for a single purpose of getting hold on power, they have made him state BJP chief and not because of the love for him!. Unfortunately people knowingly elect corrupt means, we dont have any right to talk of corruption in any case or any party!

    Appeal in this case is absolutely necessary so that our future is secure from corrupt and bootlicking leaders...for general people, this move by the Congress govt may look as revenge, a political step. But let's first examine the argument that Court put forth while quashing the cases against Yeddy. It did not tell that Yeddy was not involved in corruption but quashed the case saying that the then Governor did not have Cabinet approval when he allowed Yeddy to be prosecuted. Now how on earth, this argument by the Honourable Judges be held right? Would any Cabinet give approval and recommend the Governor to prosecute its own Chief Minister? What logic is that? Presently there are 2-3 such recommendations pending before the present Karnataka govt against Siddhu. So if he decides tomorrow to given permission to prosecute Siddhu without taking Cabinet approval and recommendation, would he be wrong? if the Governor needs the Cabinet recommendation to permit the Law-enforcement agencies to prosecute the CM on corruption or related charges, will ever CMs or other political leaders be tried and punished for their crimes?
    This is why challenging Yeddy's acquittal on these grounds is necessary. The appeal is questioning the judgement by the Court that Governor cannot allow prosecution of the CM unless the Cabinet recommends and approves such action. The honourable Court has set a bad precedence and it should be challenged and curbed right in the bud so that corrupt CMs and leaders do not get any shield in the future. If Yeddy is clear as crystal, why he should be worried?

    FEAR can do anything. This is the example. Siddana's govt. fears about BSY's prospects in next assembly elections. So they are going to SC. On the one hand CONGI govt. in state is losing credibility, and on the other hand they are playing dirty mud slinging politics using law. They are try to Malign the opposition using Law as the weapon. But they don't know how it is going to HUNT them back again. Look at what have you done:
    1. De-notifications of Lands to favor family members which runs in crore of rupees.
    2. Covering up corrupt officials, setting up ACB to weaken Lokayutha.
    3. Favoring govt. tender to CM's son, when it is against the law which again runs in crores of rupees.
    4. These Question Paper Leaks, handling these protests of PU Lectures. etc...
    This list goes on. In spite of all these. Shame less faces, now go to file petition in SC. Lets see how muck luck is on your side. People are not blind, even walls have eyes these days. Watch out.
