Vijay Mallya will not be deported, UK tells India


New Delhi, May 11 (PTI): Britain has told India that it cannot deport Vijay Mallya, who is facing money laundering charges in the country, but could consider an extradition request for him.

The UK government's response came nearly a fortnight after India made a request for the deportation of Mallya, whose Indian passport was revoked in a bid to secure his presence for investigations against him under the Prevention of Money Laundering Act 2002.

There is also a non-bailable warrant issued against Mallya.

"The UK government has informed us that under the 1971 Immigration Act, the UK does not require an individual to hold a valid passport in order to remain in the UK if they have extant leave to remain as long as their passport was valid when leave to remain or enter the UK was conferred.

"At the same time the UK acknowledges the seriousness of the allegations and is keen to assist the Government of India. They have asked GoI to consider requesting mutual legal assistance or extradition," MEA spokesperson Vikas Swarup said.

The extradition can happen under the 1993 treaty or any other necessary assistance under the Mutual Legal Assistance Treaty (MLAT) signed in 1992 between India and the U.K.

However, India was hoping to get the liquor baron, who is facing arrest over allegations of defaulting bank loans of over Rs 9,400 crore, through the expeditious route of deportation and not go through the lengthy process of extradition.

    He is like a dangerous ticking bomb which could go off any time (explode, & severely hurt many others) - rather than go "Tuss".

    As I understand it, VIJAY MALLYA is NOT a wilful defaulter... The company (an artificial person as recognised by law) went into losses for the reasons beyond Vijay Mallya's control. Being Limited Liability Company, I don't understand why Vijay Mallya should be held personally liable for the losses, as far as he was bonafide. We all know the reason for Kingfisher Airlines loss.. His flamboyant lifestyle is HIS personal affair, he spends HIS money as he pleases..

    The BJP government's election platform was to publish the names of those who had stacked billions of dollars in Swiss Bank accounts to evade taxes in India, and now they are in power why are they not publishing that list?

    Besides, Swiss Bank accounts the new scandal was the leak of the Panama documents wherein names of several prominent Indians were published, but what is the government doing? Nothing.

Indian High Commission in UK knows the laws of UK very well. This was a drama played by BJP to buy time so that Mallaya is given UK citizenship in times to come. If our MEA is not aware of UK laws it should change the ill informed Minister and the foreign secy. We do not need inefficient and ignorant officials for running India.     Extradition is a lengthy process under 1993 Extradition treaty and UK government can refuse to extradite a person on various grounds and it may never happen until and unless the person is a terrorist and threat to the country.

    So, it’s official now….. This is what India wanted….. So now….4,000 crores offered by Mallya is gone….Mallya himself is gone…. Kingfisher is gone….and even there calendar is also gone!!!! But my Banker still insists me to produce “Khata” even though I am not at all defaulted with my EMI for home loan till date!!!! Whereas same Banker still sends their yearend greetings cards to Mallya I believe!!! Now both BJP and CONGiss blame each other in Rajya Sabha that….one sanctioned loan during their tenure and another one allowed him to run from India and we watch Rajya Sabha proceeding in our TV Sets

    Not everything sensible from S. Shetty, Mundkur.
    UPA Govt. did not sanction loans to Mallya\his companies but Bankers did.
    But BJP surely changed the notice to all points of exit from India to enable Mallya to escape and informed him of this arrangement too. Immediately, very next day of after his meeting with FM he vanished to emerge in UK...!!!

    I feel the banks should have accepted the loan amount of 5000 crores as proposed by Malya and waive off the interests.
