Cabinet clears law for shops, malls, cinemas to remain open 24x7


NEW DELHI, June 30, DHNS : The Union Cabinet on Wednesday approved a model law which allows shops, restaurants, cinemas, banks and other such establishments to be open round the clock for 365 days.

The establishments have been given the flexibility to open and close at their convenience.

The law also provides for women to be employed on night shifts with mandatory workplace conditions such as adequate protection of their dignity, cab services, shelter and ladies toilet. No discriminations shall be made against women in the matter of recruitment, training, transfer or promotions.

The model law exempts highly skilled workers like those in IT and bio-technology from daily working hours (9 hours) and weekly working hours (48 hours).

Mandatory facilities, including clean and safe drinking water, lavatory, creche, first aid and canteen, are to be made available by group of establishments, in case it is not possible by an individual establishment due to space constraint or otherwise.

The law covers all premises – barring factories – or shops with work related to printing, banking, insurance; stocks and shares brokerage; theatres and “any other public amusement” which is currently not covered under the Factories Act 1948. It will cover only establishments employing 10 or more workers except manufacturing units.

However, the implementation of the Model Shops and Establishments (Regulation of Employment and Conditions of Services) Bill, 2016, will depend on the states, as it only acts as an advisory to the state governments which will have the option to either adopt the model law or make changes to it according to their local needs.

The Cabinet nod to the model law, which was approved by the Labour Ministry, has, however, invited sharp reactions from the trade unions.

    It's optional and not mandatory, It's too early to pass on negative comments now, by and large it must help everyone as longer working hours are available for shopping, there will be reduction of congestion on roads, as many people may opt late night shopping after their work, besides more people on roads may reduce the crime rates too. Women may have advantage to work at evening and also do the home work too

    The very first and best move of the Govt. Appreciate PM's reforms and the new vision.

    In fact it is very convenient to consumers to avail the services and facilities at anytime of their choice, be it shopping, movies, banking, dining, social gatherings (now cut off tome 11pm) and so on and so forth.

    This is going to be the real Ache din. Congrats to Mr. Modi.

    If we look this from side then this is a good move by the govt but if we look the other face then comes reality what about the employees who work in these kind of firms,what about their salaries and OT.Corporate sector companies will benefit by this,by making employees work on the same salary and if the employee ask for increment then he will thrown out or will be said that we are paying u as per govt rules that is monthly Rs5000 to Rs6000. Let the govt make good labour rules then we can say this is a good move or else shame on the govt because most of the companies (nearly 90%) are owned or shares holded by these political people and remaining 10% are the companies who help the political people during elections.These people will never allow govt to change the labour rules which wil l directly benefit level1 and level2 employees,this is what happening in reality,if we ask a employee who works in these kind of firms then we will know the reality.If this comment gets uploaded then there will many daiji readers who will press disagree button without knowing the grass root level problem,which in reality i have faced and i gone to labour dept and nothing out come has come and spoke to many political people who did'nt even cared about it.

    Crimes happen when there are few people on the streets. When there is more influx of people on the streets crime percentage is less..

    Going as per your logic crime rate should be more during Ramzan time, since food shops are open till early morning (4:00 AM)

    It will over run formula of keju's odd-even. Half the people will prefer to travel on night. Not much crowd will be there in morning hours or even vehicles. Also keep open religious places.

    God is never sleep in life time as per religious scriptures. What's the use then to keep all religious places closed. Let it be open 24 hours..if people to seek a separate blessing all alone quietly. When the people divided in both sessions..there will be less crowd..on the road and in transport system. Elderly people have nice time to visit..as they less prone to sleep.

    What does this mean? Malls across the country will be using more electricity, already a few states have electricity problems, this will just end up using more instead of saving it this will lead to more load shedding for us.

    Also, why can't India have time zones? That way electricity would be saved in some time.

    But yeah, this is good for late night hangouts.
