Bengaluru: HC Chief Justice recuses from case after bribe offered

Bengaluru, Jul 7: At a time when more and more incidents of offering bribe for getting work done are coming into the open, a man reportedly visited the government quarters provided to the state high court (HC) chief justice (CJ) and offered bribe for delivering favourable verdict pertaining to land dispute pending in the HC.

This was revealed in the open court by HC CJ, S K Mukherjee, when the case stated above came up for hearing and the advocate for the petitioner began to place arguments. He also recused himself from hearing the case as bribe has been offered to him in this case.

The offer of bribe was made in a review petition filed by Umrah Developers, a city-based realty firm, against revenue department and Bangalore Development Authority (BDA). On Tuesday July 5, when this review petition came up before the division bench of which the CJ was one of the presiding officers, advocate, Padmanabh V Mohale, began to place arguments on behalf of the petitioners. The CJ asked the advocate to stop arguments, asked his assistant to bring a visiting card that was given to him by the stranger at his residence from his office, and said that this person had visited his government quarters on Palace Road on Monday to lure him with bribe for delivering favourable judgment in this particular case. He also said that the person concerned was conversing in Bengali language. He then arranged to provide a copy of the visiting card to Mohale.

The case pertains to 1.2 acres of and Umrah Developers had bought in 2008 through auction process for Rs 2.1 crore. Later, BDA acquired this land for setting up Kempegowda extension, and offered to provide alternative site or money to the firm. The firm questioned this step through high court. The single judge bench of the HC had ordered BDA to issue alternative land to the firm. The firm then approached division bench of the HC with review petition.

Mohale tried to convince the bench that the person named in the visiting card has nothing to do with the case but in vain. The CJ was found remarking that the doors of his house are always open for visitors but not for issues like the one mentioned above.

    What is the moral of the story a citizen should learn, when a Judge rescues himself from a case for bribe offered? Is it abdicating responsibility or the person is corruptible or the person is honesty personified? I fail to understand if it has any moral value. Instead an investigation into the incident and punishing the guilty would be appreciated. The man who offered bribe should have been taken into custody and interrogated since there are good number of security personnel at the house of the CJ.

    The judiciary is slowly losing its place of clean and able department since corruption is peeping among the judges too.

    Trying to corrupt it is very disturbing. Must be taken very very seriously.

    Is this the only case? There might be several cases where justice delayed, denied due to bribe, political and religious pressure. We might cheat people but almighty always watches us!! Whole world might be against truth and justice but let us not give up our sincerity. Deep within the experience of our peace no one can take out.
