Mangaluru: Justice Saldanha recalls DySP's 'role' in church attacks; decries illegal cattle transpor

Mangaluru, Jul 9: "There is a communication gap between the police officers and the government and hence instances of police officers committing suicide are on the rise," said Justice Michael F Saldanha, former judge of the Bombay high court.

Addressing a press interaction at Gallerie Orchid here on Saturday July 9, Justice Saldanha said, "In normal cases we complain about the atrocities meted out by police personnel but we do not think about their welfare and hence become prone to the suicidal mindset. Even DySP Ganapati suffered from depression for many years and eventually took his life. The thought of suicide does not strengthen all of a sudden. He must have undergone many experiences that led him to commit suicide.


'Role' of DySP Ganapati during church attacks

The retired judge also pointed out that three police officers, namely DySP Ganapati, who was the Kadri circle inspector then, SP Satheesh and Jayanth Shetty were the ones who 'implemented' the 'state-sponsored' violence on many innocents in Kulshekar and Permannur. "As per the video footages of CNN and BBC, when the prayer session was in progress the police entered the church and sealed the place. When all were sitting quietly they started the lathi charge on nuns and the other people. The police also went to the altar and beat the priest and the alter was vandalized. When I enquired these officers they said that they had the then home minister Dr V S Acharya for support and no one could harm them," he said.

"In Kulshekar DySP Ganapati ordered lathi charge in the girls' school premises which was run by nuns and the nuns were beaten black and blue. As many as 51 people suffered head injuries, 70 people had one or more fractures and as DySP Ganapati said, he was transferred from the Kadri station," Saldanha recalled.

"Any life lost is sad. I personally do not support death penalty. If there are people who abetted DySP Ganapati's suicide they must be subjected to inquiry. A man who is about to die does not lie. Public inquiry must be launched if an atmosphere of trust has to prevail. Whether it is CBI or CID, none of the agencies can do justice to DySP Ganapati," he said.


On illegal transportation of cattle

Saldanha also pointed out that cattle are being illegally transported to Kerala and slaughtered. "A farmer rears the cattle like his child in the farm. But a few people come with all the weapons and take away the cattle in an inhuman way right in front of the farmer. The first thing they do is break the legs of the cattle and tie their mouths. About 4-5 cattle are stuffed inside an Omni and transported without any fear of the law. In the last 5 years, more than 30,000 cases have been registered against such people but none of them has been convicted. The reason being the ridiculous laws we have.

"We are the number one country in the world in beef export but we do not have even a single farm rearing cattle for export, like the ones in western countries. In the Middle East, the Indian cattle meat is sold stating it is a green meat as the cattle graze on greenery. But do we need to sacrifice our cattle to feed the Middle East people."

"To overcome this, we need to change our food habits. We need to launch a national campaign to support vegetarian food and bring a national policy for food consumption. This will be a solution for all the issues," he opined.

    People here speak as if they have volumes of evidence. Why don't you depose before a court and provide your submissions? 3 of the 4 MLAs from Mangalore are from minority community. Why did they not take up this case and fight for justice. This kind of self fulfilling satisfaction based on the death of a police officer is purely being opportunistic and nothing more.

    As far as Christian community in Mangalore, i reiterate that i have immense respect for them, I appreciate the contributions of the community to Mangalore. At this point, senior lawyer Mariamma Thomas and the church priest intervened. In the end, women, children and nuns filed out of the church in an orderly manner according to Ganapathy’s instructions. The police lathicharged the women, children and the nuns who were in their habits, even as they filed out in a disciplined manner. The nuns were assaulted until their hands and legs were swollen,”

    What I read in news today is that Ganapathys wife Pavana has pointed out a minister and 2 officers in the episode. However Police are hesitating to file FIR according the to news. If news is true Whats going on here ? Wheres the law and justice? Whats this play going on? Is CM feels his seat is more important than Law and order and is he trying to protect accused? Tomorrow same thing may happen to us.     DySP Ganapati had earned a bad name for his partisan attitude in teh aftermath of 2008 Church attacks.

    At the behest of sanghiees and Acharya, he led his forces inside churches and brutally beat up women, children and men who had gathered for prayers.

    It was reported that more than 60-70 people suffered from Head injuries, concussion and serious bone fractures.

    POst this incident, we all know what happened to Acharya, Yeddi, Mahendra kumar.

    Anyways R.I.P dear DySP.

    The moral of the story is never attack any places of worship and never raise your hands on religious people.

    Don't lie.

    Church is not a place for anybody's cover up or to keep any arms and ammunition as you may do.

    Any tom, Ram Rahim can check about the arms and ammunition's or the cover up of anything inside the church is kept. It is a holy place and nothing to do with all these things or commodities.

    It was a Sunday people were praying and people were inside when this DySp a RSS cheila with BD and VHP men in Police Uniform threw stones to Christians to provoke Christians. This DySp forcibly entered inside and ordered to produce a dozens of our youth and shut them inside the jail and slapped the cases for no reason.

    In the interview with TV9 DySp has lied that he never entered the church. They entered inside the church compound and the church and beat our youth and nuns mercilessly.
    It is nothing to do with his cases in the court against the DySp.

    The Churches attacked devil was following him to commit murder like the Judas of the Holy Gospel.

    FOR THE OTHER POLICE CULPRITS THEY ARE ALREADY UNDER DEPRESSION CHURCH ATTACKED BHOOTH UNKO LAG GAYA HAI.

    The police never raised the lathi on any women there in the church. They were just asked to leave the premises immediately. Infact police helped a women who fell down while running away. Videos don't tell lies .
    I don't understand why empty soda bottles were stored there in such big quantities. Even bricks and stones too were heaped there next to the bottles.

    I am no one to pass judgements. What i said was my observations, both on what happened that day and on the video clips available.
    Nuns and women were not beaten by the police.
    All inside the church were not innocents. the people who vandalized the police vehicle were among the ones inside the church.
    What police should have done in that case? Should they have waited for stones and bottles flying towards them from the church??

    There is no enough evidence to suggest that deceased DySp Ganapathy had Depression .He had contacted a Neurologist not a Psychiatrist .Neurologist treats Nerve disorders .If he had severe depression then there is a cause for depression also which he has stated .
    He was under extreme stress and strain which lead to abettment of suicide and there is a legal document called suicide note and states who caused this abetment .
    In God,s court there justice is always delivered .I hope proper enquiry will be conducted and accused will be brought to justice .Or else people will teach lesson to the Govt of Karnataka and then the God will teach lesson to the accused and dethroned govt both through the newly formed govt .
    Commenting fowl about a soul ( Dr.V.S.Acharya) who is no more is not good because he is not present here to give his version about the case .

    DySP Ganapathy stated clearly in his press conference, before this suicide that 'He never demanded bribe in his career & he has his enough Ancestral property for livelihood'.
    In this case, why should he bow to any political or official pressure?
    If he was feeling suffocated, exhausted, stressed in his duty, he could have easily resigned from his job & lived happily with his family.

    Committing suicide due to family internal issues or due to burden of loan is understood or can be justified. But, committing suicide because of pressure from third party???

    Calling out people praying inside the Kulshekar church despite pleas from lawyer (Mariamma Thomas) and priests,beating innocent nuns, women, breaking their skull, bones...when later central govt (under pressure from US,France etc)sent home secretary to Mangalore to enquire, when home secretary visited Kulshekar church for hearing, Ganpathi(Who was suppose to provide him police security and was present in Kulshekar church)called all RSS guys(Being a RSS guy, he had all contacts with RSS) and created a ruckus in front of the home secretary who told to meet him in circuit house and refused to entertain RSS demands at church premises, Ganpathi even did not prevent people who barricaded union home secretary's car despite being appointed to guard him.
    His godfather at the time VS Acharya (once Ganpathy's RSS colleague) who was briefing newsman during church attacks about quote christians deceitful conversion unquote. Whatever you sow,will reap.

    Have you given any verdict in your career as a judge based on media/ reports/ gossip/ rumors.

    Surprisingly, this justice has not commented on corruption and all sorts of lowly acts making steady inroads in the higher echelons of the judiciary!

    At least recently one judge from Kerala HC and another from Bangalore HC rescued themselves for being offered heavy bribes by unscrupulous elements!! Now this might be just the tip of the iceberg as all are not like these two upright judges who straight forward refused to hear the case citing openly that they had been offered bribes!!

    The last hope for justice to the common man was the judiciary, which too has been infested by the cancer of corruption and malaise!! In such circumstances how can a common man hope to get justice what he can do is either revolt or commit suicide!! Very sad state of affairs as the powerful and rich are manipulating and controlling the masses by force!! The only hope for the poor to get justice is through some divine intervention!!

There were many instances that the soldiers were punished for not protecting women and children. Only beast can beat up Nuns, women and children that too during the prayers in the Church. Imagine how other communities have reacted when the Golden Temple and Babri Mosque was desecrated. Christian only prayed for God's forgiveness for those who do not know what they were doing.     what about punishing the real guilty? Attacks on places of worship is condemnable. But why resort to violence. And when section 144 was in force why gather in large number place of worship. Guilty should be punished the guilty who waged war against government officials and the public, those christian families in Falnir and elsewhere who sheltered culprits who attacked and ran when chased. Their vehicles were damaged because they tried to run using them and when chased left and ran. and those who did this get released from jail and cases ped just becoz minority status. What an ex judge is this not spared even dead just for cheap gimmic. The media in Mlore know what exactly happened. shame on u people who use religion for politics and accuse others.

    Following are my general comments and views after reading all news papers.
    Our nuns and Christian brothers suffered due to church attacks. However I will definitely not raise this tool now as it will dilute the current case where accused is being saved and may let the accused go free.I am not saying accused is culprit but what I am saying is why is not being questioned and why statement is given to protect him. This is totally unacceptable.Tomorrow it may happen to any of us. We all Christians have the obligation/duty to condemn church attackers and punish them but same time we must also to ensure Guilty being protected is immediately questioned and interrogated and law and order is put in place which is miserable now. Lets not divert the subject.God will protect us if use our wisdom rightly and he knows all our intentions/Actions of all of us. Lets not play with him. Regarding Ganapathys Depression who caused it Doctors must tell and we are not doctors to give opinion. Morever lets keep this subject out of politics.

    I oppose and condemn who vandalize the places of worship. I also condemn pointing fingers right away to BJP, RSS and Hindus after each and every stone being ped at churches.
    Coming back to the subject, let us accept the facts. Some people thew stones and vandalized police vehicles. They came inside and hid inside church among women and children. Church was a safe haven for them because they thought no police will enter the church. But they forgot that it was not their favorite appeasing party in power.

    Tell me what police should have done?
    If I was the DySP, and even if it was a temple, i would have done nothing different. I am no Bhajaranga dal, neither succumb to the stories that innocents were attacked by police in Kulshekhar church.

    well said Justice Saldanha. I have great respect for you. However, you must be also aware that, during British system of policing, there were two categories made. "Superiors and Subordinates"!! andybody SP and above is superior, one who suprevises, orders and gives direction. he is either IPS and only a President of India can sack him.. another is "suboridanates - DySP and below (inspector, constable etc)" they have no decision makign power. they simply take orders and act as footsoldier, who do all the hard work, of maniataining law and order, FIR/chargesheet framing.. so, now as DySP, how much Ganapthy can act on his won? they take orders from Police superiors.. how is he alone made the scapegoat?! was he 'depressed' from then? and what about 184 people who pleted stones on Police vehicles.. ? and wasnt the same church atatck across mangalore, chickmagalur, coorg district too? who is the other DySP in these locations? why Rana and george, repirmanded him ?

    Mental depressed person can say anything without any meaning. His family should have taken ganapathi to a doctor for treatment to save his life. We simply blame based on his notes which may have written to take revenge due to reasons. Policemen should act transparent without any bias towards caste or religion. Depression is a great Killer to many and it has to be treated soon. Depression and anxiety can cause with many reasons and common when we do wrong towards others fears always haunts to depression and anxiety.

    He didn't take the higher officers permission to enter religious places & to beat people including women & kids.
    Section 144 if not specific is applied on the streets only. If it is ambiguous by not specifically mentioning assembly of people peacefully for prayers inside a building then it is null & void as well, which doesn't give powers to the police to attack people inside such places which biased Somshekar Commission too found wrong.

    I hope know it is clear to all those who were accusing Mr.Poojary's press conference...DySP was just following the then home minister Acharya's orders...and then got harassed by George...Police has no other option than to obey the orders...the orders have come from the home ministry for Lathi Charge...DySP is just a gun the trigger was pressed by VS Acharya...why DySP and other police was harassed by George...If the police follows the orders will be harassed by the future govt...if the police dosent follows the orders than he will harrased by the present govt...
